AND NOW, comes the Defendant. Roger Lose, by and through is attorney, Michael A,
Scherer, Esquire, and responds to the Complaint as follows:

6, Denied, It is denied that the Defendant breached the Agreement, To the contrary,
the Plaintiff breached the Agreement as more fully set forth in the New Matter herein,

7, The Plaintiff did not perform the work he was required to do pursuant to the
Agreement in a good and workmanlike fashion,
8. The concrete work performed by the Plaintiff to the Defendant's garage floor is
uneven, and contains dips and waves in the concrete in the area where the Defendant's garage door
should seal with the garage floor.

9, The Defendant has repeatedly attempted to havc the Plaintiff correct the defective and
unworkmanJike work, however the Plaintiff has rcfused to do so,
WHEREFORE. Defendant hereby requcsts that judgment be entcred in his favor.

7. Denied, It is specifically denied that Plaintiff did not perform the work it was
required to in a good and workmanlike fashion and strict proof thereof is demanded at trial.
8, Denied. It is specifically denied that the concrete work performed by Plaintiff is
deficient in any manner, is uneven, or contains dips or waves in the concrete causing
Defendant's garage door to seal improperly. Any problem with the garage door seal with
the garage floor is due to the age of Defendant's garage door.
9. Admitted in part and denied in part. It is admitted that Defendant has requested
Plaintiff to do further work on the floor, It is denied that such work was or is necessary to
correct defective or un workmanlike work and strict proof thereof is demanded at trial.
WHEREFORE, Plaintiff hereby requests that judgment be entered in its favor.
