NOTICE TO DEFEND AND CLAIM RIGHTS
YOU HAVE BEEN SUED IN COURT. If you wish to defend
against the claims set forth in the following pages, you must take
prompt action. You are warned that if you fail to do so, the case
may proceed without you and a decree of divorce or annulment may be
entered against you by the Court. A jUdgment may also be entered
against you for any other claim or relief requested in these papers
by the Plaintiff. You may lose money or property or other rights
important to you, including custody or visitation of your children.
When the ground for the divorce is indignities or
irretrievable breakdown of the marriage, you may request marriage
counseling. A list of marriage counselors is available in the
Office of the Prothonotary, Cumberland County Courthouse, 1
Courthouse Square, Carlisle, PA 17013.

1. The Plaintiff is Barbara M. Flot, an adult individual,
sui juris, who currently resides at P.O. Box 43, Lemoyne,
Cumberland County, Pennsylvania, 17043.
2. The Defendant is Howard W. Flot, an adult individual, sui
juris, who currently resides at 795 Scenic Circle, New Cumberland,
York County, Pennsylvania, 17070.
3. Plaintiff has been a bona fide resident of the
Commonwealth of Pennsylvania for at least six (6) months
immediately prior to the filing of the Complaint.
4. The Plaintiff and Defendant were married on March 1,
1969, in PittSburgh, Allegheny county, Pennsylvania.
5. There has been no prior action for divorce or annulment
of the marriage between the parties hereto in this or any other
jurisdiction.
6. The Plaintiff and Defendant separated on August 30, 1996.
7. Both the Plaintiff and the Defendant are united states
citizens.
8. Neither the Plaintiff nor the Defendant are presently
members on active duty of the Armed Forces of the United states of
America or any of its allies.
9. The plaintiff avers that the grounds upon which this
action is baRed is that the marriage is irretrievably broken.
10. The Plaintiff has been advised that counseling is
available and that the Plaintiff may have the right to request that
the Court require the parties to participate in counseling. Being
so advised, the Plaintiff does not request that the court require
the parties to participate in counselling prior to a divorce decree
being handed down.
WHEREFORE, the plaintiff requests the court to enter a decree
of divorce.
COUNT II
CLAIM FOR EOUITABLE DISTRIBUTION OF MARITAL PROPERTY
UNDER SECTION 401 OF THE DIVORCE CODE
11. All of the averments in Paragraphs 1 through 10 are
incorporated herein as though each was set forth under Count II as
in Count I.
12. The parties own marital property which needs to be
equitably distributed.
WHEREFORE, Plaintiff requests the Court to enter a decree in
Divorce:
A. Dissolving the marriage between the plaintiff and the
Defendant;
B. Equitably distributing all marital property owned by
the parties; and
C. For such further relief as the Court may determine
equitable and just.
