AND NOW, comes the Plaintiff, Eddie Albright, III, by his
attorneys, Zeigler & Zimmerman, P.c., and states:
1. The Plaintiff, Eddie Albright, III, is an adult
individual residing at 423 East King stroet, Shippensburg, PA,
17257.
2. The Defendant, Drian Keith Kunkleman, is an adult
individual residing at 42 Kunkloman Lane, Shippensburg, PA, 17257.
J. On October 3, 1996, Albright, the owner of a 1994
Kawasaki motorcycle, had his motorcycle parked in the parking lot
of the Rustic Inn, in Shipponsburg, PA, while he was inside the
Inn.
4. At approximately 10:00 PM on October J, 1996, Kunkleman
without permission placed himsolf on Albright's motorcycle and
while on the motorcycle carelossly, negligently, and/or recklessly
