The prior Order of this Court dated April 18, 1997 is vacated and replaced with this Order. 2. The Mother, Angela M. Myers, and the Father, Jeffrey A. Grdjan, shall have shared legal custody of Nathan Tyler Grdjan, born April 14, 1995. Each parent shall have an equal right, to be exercised jointly with the other parent, to make all major non-emergency decisions affecting the Child'S general well-being inclUding, but not limited to, all decisions regarding his health, education and religion. Pursuant to the terms of this paragraph, each parent shall be entitled to all records and information pertaining to the Child inclUding, but not limited to, school and medical records and information. To the extent one parent has possession of any such records or information, that parent shall share the records and information with the other parent. 3. The parties shall consult with the Child's physician in order to obtain advice and a referral to a psychologist/counselor who can assist the parties in identifying the source of the Child's stress and take steps to alleviate the problem. The parties shall cooperate with the recommendations of the psychologist/counselor in an atterrpt to improve communication and interaction between the parties as necessary to raise their Child. 4. Pending further Order of Court or agreement of the parties, the parties shall have shared physical custody of the Child on an alternating weekly basis with the exchange of custody to take place every Sunday at 6:00 p.m. The party releasing custody of the Child on Sunday shall be responsible to provide transportation for the exchange of custody. The party who does not otherwise have custody of the Child during the week shall have custody on Wednesday from 5:00 p.m. until 8:00 p.m. and shall provide transportation for both exchanges of custody on Wednesday. The shared custody schedule shall begin with the Mother having custody of the Child during the week of August 23, 1998. The Father shall have his first Wednesday period of custody with the Child on August 26, 1998. 5. The parties shall share or alternate having custody of the Child on holidays as follows: A. <EUSDlAS: The Christmas holiday shall be divided into Segment A, which shall begin on Christmas Eve at 12:00 noon and end on Christmas Day at 12:00 noon, and Segment B, which shall begin on Christmas Day at 12:00 noon, and end on DecerOOer 26 at 12:00 noon. The Mother shall have custody of the Child during Segment A in odd nUJrbered years and during Segment B in even numbered years. The Father shall have custody of the Child during Segment A in even nUJrbered years and during Segment B in odd nUJrbered years. B. BA5"1'ER: The Easter holiday shall be divided into Segment A, which shall begin on the Saturday before Easter at 12:00 noon and end on Easter Sunday at 12:00 noon, and Segment B which shall begin on Easter Sunday at ". l() noon and end on the Monday following Easter at 12:00 r..c'.. The Mother shall have custody of the Child during Segment A in odd numbered years and during Segment B in even nUJrbered years. The Father shall have custody of the Child during Segment A in even nurrbered years and during Segment B in odd nUJrbered years. c. ALTI!RNATING IDtInAYS: The parties shall alternate custody of the Child on the following holidays from 9:00 a.m. until 6:00 p.m.: New Years Day, Memorial Day, Independence Day, Labor Day and Thanksgiving. The alternating holiday schedule shall begin with the Mother having custody of the Child on Memorial Day in 1997. D. FATIIER'S DAY/Iovulm's DAY: The Father shall have custody of the Child every year on Father's Day from 9:00 a.m. until 6:00 p.m. and the Mother shall have custody of the Child every year on Mother's Day from 9:00 a.m. until 6:00 p.m. 6. The holiday schedule shall supersede and take precedence over the regular custody schedule. 7. Each party shall have a one week period of uninterrupted custody with the Child during each surrmer vacation upon providing thirty (30) days advance notice to the other party. Unless otherwise agreed between the parties, each party shall schedule his or her period of vacation custody to coincide with that party's regular alternating weekly period of custody under the regular schedule. 8. The noncustodial party shall be entitled to contact the Child by telephone no more than one time per day. The parties agree to encourage their respective mothers to initiate the telephone calls when necessary or advisable to avoid conflict between the parties. 9. Each party shall notify the other party as promptly as possible of any medical emergencies or significant injuries/illnesses suffered by the Child during his or her periods of custody. 10. In the event either party believes that the alternating weekly custody schedule is not serving the best interest of the Child, counsel for either party may contact the Conciliator to schedule an additional Custody Conciliation Conference. " 11. This Order is entered pursuant to an agreement of the parties at a CUstody Conciliation Conference. The parties may modify the provisions of this Order by nutual consent. The Mother shall have primary physical custody of the Child. 3. The Father shall have partial physical custody of the Child as follows: A. On alternating weekends, beginning April 25, 1997, from Friday at 6:00 p.m. until Sunday at 4:00 p.m. B. During every week from Tuesday at 4:30 p.m. until the following Wednesday at 12:00 noon and from Thursday at 4:30 p.m. until the following Friday at 12:00 noon. C. On alternating Mondays (following weekends when the Father does not have custody of the Child) from 4:30 p.m. until 7:30 p.m. 4. The parties shall share or alternate custody of the Child on holidays as follows: A. Christmas: The Christmas holiday shall be divided into Segment A, which shall begin on Christmas Eve at 12:00 noon and end on Christmas Day at 12:00 noon, and Segment B, which shall begin on Chrietmas Day at 12:00 noon, and end on December 26 at 12:00 noon. The holiday and summer vacation schedule shall supersede the regular custody schedule. 7. The party releasing custody of the Child shall be responsible to provide transportation for the exchange of custody. Unless otherwise agreed by the parties, the exchange of custody shall occur at the parties' respective residences with the exception that the Father shall transport the Child to the maternal grandmother's residence at the end of his custody periods on Wednesdays and Fridays. 8. This Order is entered pursuant to an agreement of the parties at a Custody Conciliation Conference. The parties may modify the provisions of this Order by mutual agreement.
