6. It is denied that Defendant was negligent in its work and
it is denied that Plaintiffs sustained damages as specified and in
the amounts alleged in Paragraph 6 and Exhibit A.
NEW MA'l"l'ER
1. On or about June 10, 1996, at the request of Plaintiff,
Plaintiff and Defendant entered into a written contract for
Defendant to provide pressure grouting in the form of bentonite
spray along the rear foundation wall and a portion of one side
foundation wall of Plaintiff's property. A copy of the contract is
attached hereto, made part hereof and marked Exhibit 1.
2. Prior to contracting wi th Plaintiff, Defendant had filled
a rear window well area at a basement foundation wall window with
earth and had covered the window well area and the window with a
patio.
3. In filling the window well, Plaintiff improperly
installed block or other materials in area of the former window so
that the former window did not become a part of the foundation wall
and there were voids and openings in the foundation wall.
4. The former window well and basement window were hidden
from view by the patio and other material so that it was not
possible for Defendant or others upon visual inspection to

determine that there had been a window well and basement window at
that area of the foundation.
5. If Plaintiff had disclosed to Defendant the existence of
or condition of the former window well area and basement window,
Defendant would have been able to have taken measures to prevent
leakage of bentonite spray into the basement or would have been
able to specifically have forewarned Plaintiff that bentonite spray
could leak into the basement.
6. The overflow or leakage of any bentonite spray into the
basement of Plaintiff's property was the result of the negligence
of Plaintiff as follows:
a) Failing to properly install block or other material in
the former window well and basement window area 10 that
the former window did not become a part of the foundation
wall and there were voids and other areas through which
the bentonite spray could flow.
b) Failing to disclose to Defendant that there had been a
basement window and window well area that had been
covered up and hidden from view of Defendant.
7. Plaintiff failed to disclose to Defendant the former
window well and basement window and the condition of the basement
foundation.
