mortgage contains and is a lien upon the property situate at 221 Old Slate Road, Dickinson
Township, Cumberland County, Carlisle, Pennsylvania 17324.
4. A copy of the Note is attached hereto and incorporatcd herein as Exhibit "B"
5. Plaintiff, in consideration of the said Mortgage and Note advanced to James R. Crist and
Vicki S. Crist the sum of One Hundred Thirty Two Thousand Dollars ($132,000.00).
6. The premises subject to said mortgage is more specifically set forth in Exhibit "A".
7. James R. Crist and Vicki S. Crist are the sole owners of the said premises securing said
mortgage. Allegedly, Vicki S. Crist is living in the house with her present husband.
8. Said Mortgage has not been assigned in whole or in part by the Plaintiff herein.
9. No judgment has previously been entered on said Mortgage in any jurisdiction, and said
instrument is less than twenty (20) years old.
10. That said Mortgage is in default because Defendants herein have failed to make the
following payments: a partial payment of$976,21 for July, 1996 and payments of$I,094,58 for
the months of August, September, October, November, December, 1996, January and February,
1997 plus late charges in the amount of $267.42.
11. The Plaintiff has given to the Defendants wriuen notice of intention to foreclose on said
Mortgage as required by law under Act 6, dated November I, 1996, a copy of which is aUached
hereto and incorporated herein as Exhibit "C".
12. The Plaintiff has given wriuen notice of default as required by the Homeowner's
Emergency Assistance Act of 1983, dated November I, 1996 a copy of which is auached hereto
and incorporated herein as Exhibit "D".
13. That due to Defendants' default the entire principal amount of One Hundred Twenty Nine
