TO MARITAL RESIDENCE ON BEHALF OF RESPONDENT
The Plaintiff, Ronald A. Davis, through his attorneys, The Law
Offices of Patrick F. Lauer, Jr., makes the following Petition for
Rule to Show Cause pursuant to Pennsylvania Rules of Civil
Procedure, Rule 206.1 et seq., and Cumberland County Rules of Local
Procedure 206-1 et seq., and petitions the Court to issue a Rule
upon the Respondent as to why the Prothonotary of Cumberland County
should not be directed to execute the deed to the marital residence
on behalf of Respondent, and in support thereof, respectfully avers
as follows:
1. The parties in the above-captioned matter separated on or
about August 20, 1996, with the Plaintiff/Petitioner, Ronald A.
Davis, age 48, remaining in the marital residence at 303 Glenn
Avenue, Boiling Springs, Cumberland County, Pennsylvania 17007.
2. The Defendant/Respondent, Victoria R. Davis, age 43,
lives primarily with her paramour, Bob Ryan, at an unknown address
believed to be in Cumberland County, occasionally returning to the
marital residence without warning.

3. The few times actual service of process has been
accomplished upon the Defendant/Respondent, it has been effected at
the residence of the Respondent's mother, Betty J. Warner, 95
Buckthorn Drive,- Carlisle, Pennsylvania 17013.
4. In fact, the Plaintiff/Petitioner filed a Motion for
Exclusive Possession of the Marital Residence in November of 1997,
which was continued generally by the Honorable Kevin A. Hess
because actual service could not be made.
5. In-person service was, however, made upon the
Defendant/Respondent at the Buckthorn Drive address in November of
1998 of the Notice of a Pre-Trial Conference before the Divorce
Master, Robert E. Elicker, Esquire, and of his appointment by the
Honorable George E. Hoffer.
6. The Defendant/Respondent did not appear at the Pre-Trial
Conference, nor did she file a Pre-Trial Statement or Inventory and
Appraisement.
7. Shortly after the Pre-Trial Conference, the parties did
reach an agreement where she was to pick up all of her
"collectible" items from the marital residence in exchange for the
Plaintiff/Petitioner receiving 100% of the proceeds from the sale
of the marital residence. A copy of a memorandum of the agreement
in the hand-writing of the Defendant/Respondent is attached h~reto
as Exhibit "A" and incorporated herein by reference.
8. The "collectible items" are believed by Petitioner to
have an approximate value of $20,000.00, and were picked up by the
Respondent during early February of 1999.

9. On or about February 5, 1999, the parties jointly entered
into a listing agreement with Central State Realty to list the
marital residence for sale at $87,000.00. A copy of the listing
agreement is attached hereto as Exhibit "B" and incorporated herein
by reference.
10. On or about February 16, 1999, Central State Realty
secured an offer to purchase the marital residence for $87,000.00
less a total of $3,005.00 in Seller help toward Buyers' closing
costs. A copy of the offer is attached hereto as Exhibit "C" and
incorporated herein by reference.
11. When notified of the existence of the offer on February
17, 1999, the Respondent hung up on the Plaintiff/Petitioner the
telephone twice.
She has refused to take the calls of the
Plaintiff/Petitioner or of Central State Realty.
12. The Respondent is not represented by counsel; however, on
February 28, 1999, the concurrence of the Respondent was sought by
the undersigned counsel pursuant to Local Rule 206-2(c). See
Exhibit "D" attached hereto and incorporated herein by reference.
However, no response has been received to date.
13. Communication between the parties has been sporadic, at
best, over the years; and it is believed, and therefore averred,
that the Respondent will simply refuse to respond to all entreaties
to liquidate the marital residence, pursue an equitable
distribution of the marital estate, or finalize the divorce action.

! expressed an J.nterest J.n waiting as long as thirty days beyond the .
offered (and customary) five-day acceptance period, to give the
parties time to get the necessary documents in order; and that
there are other buyers who have expressed an interest in the
property. See letter of Norm Dellinger attached hereto as Exhibit
"E" and incorporated herein by reference.
16. The marital residence is titled in the entireties, and
the above-captioned divorce action is pending; both of which
independently require either the signatures of both parties or a
court order to transfer clear title. See deed to marital residence
attached hereto as Exhibit OOF" and incorporated herein by
reference.
17. The Plaintiff/Petitioner cannot afford to maintain the
marital residence and has not been able to maintain the property
adequately for some time as his expenses exceed his income.
18. Should the sale fall through, the default of the Sellers
obligation under the listing agreement will likely make the
parties, and therefore the marital estate, liable for the Agents'
Fee of 6% of $87,000 for producing a buyer ready, able, and willing
to buy, whether the property is sold or not; equating to some
$5,220.00. See Exhibit "BOO at paragraph 10(a).
19. Despite the agreement of the parties referenced in
paragraph seven above, the Plaintiff/Petitioner is willing to place
the net proceeds of the sale of the marital residence in escrow
pending equitable distribution by the Divorce Master.
WHEREFORE, the Plaintiff, Ronald A. Davis, petitions the Court

AND NOW comes the Plaintiff, Ronald A. Davis, by and through
his attorney, Jeanne B. Wigbels, Esquire, avers the following:
1. The Plaintiff, Ronald A. Davis, is an adult individual
who currently resides at 303 Glenn Avenue, Boiling Springs,
Cumberland County, Pennsylvania.
2. The Defendant, Victoria R. Davis, is an adult individual
whose current address is unknown. It is believed that her mailing
address is 22 Sinclair Road, Mechanicsburg, PA 17055-7508.
3. Pursuant to 23 Pa. R.C.P. S 3502(c), Plaintiff requests
that he be granted exclusive possession of the marital residence
for the following reasons:
a. The Defendant has already established residence
outside the marital home;
b. The parties can no longer amicably reside in the
same residence.
c. The parties have previously agreed that Plaintiff
shall remain in the marital residence.
d. The Plaintiff is raising the parties' son, Kyle Davis
(DOB 8/6/83), and the child should continue to remain in

respectfully submits the following special issues to the attention
of ~he Court: The Plaintiff has had difficulties securing the
parj:icipation of the Defendant since the separation. The only
marital asset to be distributed is the marital residence and its
corfesponding mortgage.
(12) Proposed Resolution of the Economic Issues: Plaintiff
suggests an overall division of the marital assets where Plaintiff
retains 50% of any net equity (less costs of refinancing) in the
marital residence and, by paying to Defendant a specific Transfer
.!\mount, conveys to Defendant an amount granting her 50% of the
marital property. Any future capital gains tax issues of the
remaining assets would pass along with the corresponding asset.
Plaintiff to refinance the mortgage, thereby removing Defendant's
name.

RE: Pre-Hearing Conference Memorandum
DATE: Thursday, December 31, 1998
Present for the Plaintiff, Ronald A. Davis, is
attorney Matthew J. Eshelman. Also present is the Plaintiff,
Ronald A. Davis. victoria R. Davis has not appeared in these
proceedings nor has she filed a pre-trial statement. Mr.
Eshelman provided the Master with a copy of an affidavit of
service showing that the Defendant was served personally with a
notice of today's conference on November 17, 1998.
A divorce complaint was filed on March 20, 1997,
raising grounds for divorce of irretrievable breakdown of the
marriage. Because the Defendant has not participated to date in
these proceedings, it appears as if Mr. Davis is going to have
to proceed under Section 3301(d) of the Domestic Relations Code
and his counsel will file an affidavit averring that the parties
separated August 20, 1996, a period in excess of two years. The
divorce complaint also raised the economic claim of equitable
distribution. No other economic claims have been raised in the
action.
The parties were married on December 31, 1983, and
are the natural parents of one child, Kyle, 15 years of age, who
lives with the father.
Husband is 48 years of age and resides at 303 Glenn
Avenue, Boiling Springs, Pennsylvania, where he lives with the
son of the marriage. He has an 8th grade education and is a
painter for Ralph E. Jones Painting. He brought along a pay
statement today from his employer showing a year to date gross
of $43,000.00. He has not raised any health issues. He is
requested to provide updated income information by the date of
the hearing showing his current income at that time.
Wife is 43 years of age and the only address we
have for her is c/o Betty J. Warner, 95 Buckthorn Drive,
CarliSle, Pennsylvania. Betty Warner is wife's mother. Wife
has an 11th grade education and according to husband is not
employed, She does have a polio problem in her leg as a result

of having had polio as a child. Husband also indicated that
wife has an alcohol problem and has been in and out of a
relationship with another man but continues to return to the
marital home on occasion which is disruptive to husband and the
son.
The parties own a property at 303 Glenn Avenue,
Boiling springs, Pennsylvania, where husband and Kyle are
living, The home has a value of around $85,000.00 and is
subject to a first mortgage in favor of Harris Savings Bank in
the amount of $50,000.00 and a second mortgage in favor of
Harris savings bank with a payoff of around $20,000.00. Husband
is paying $669.00 per month on the first mortgage which includes
taxes and insurance and $211.00 per month on the second
mortgage. Husband has indicated that he would like to retain
the house but has been unable to accomplish any communication
with his wife regarding the interest that she may have in the
house and how an agreement may be worked out to allow husband to
remain considering her claim for equitable distribuiton.
Husband has suggested that one option in allowing him to be able
to maintain the property for a period of time would be to defer
wife's interest, whatever that may be in the property, until the
son is graduated from high school or is 18 years of age,
whichever is later. In any event, we will have to consider
different options that may be open to us in allowing husband the
opportunity to continue to remain in the house with the son for
a few years until the son graduates.
Wife has, as indicated, been visiting the house
which is disruptive and Mr. Eshelman has indicated that he may
revive a previously filed petition to request that husband be
allowed exclusive possession of the residence pending the final
resolution of the current proceedings. Husband also pointed out
that he owned the house eight years prior to the marriage which
would be considered as a factor in the equitable distribution
showing that he did make a contribution to the marital estate.
We would need to have some idea as to the equity in the house at
the time of marriage to have a better understanding as to
husband's total contribution. Husband did indicate that he put
the property in joint names after the parties were married.
Husband has estimated that the household tangible
personal property is valued at around $3,000.00. He does
acknowledge that wife has a collection of Longaberger baskets
and dolls and suggests that she can have those items and he
would keep the other items of personalty.
The parties have two vehicles which are marital, a
1978 AMC Concord and a 1976 Monte Carlo. Husband has the
