CUMBERLAND COUNTY COURT ADMINISTRATOR'S OFFICE Cumberland County Court House Fourth Floor One Court House Square Carlisle, PA 17013 (717)240-6200 DAUPHIN DEPOSIT BANK AND TRUST COMPANY Plaintiff : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA NO.: VS, RONALD G, RUDY Defendant : CIVIL ACTION - LAW COMPLAINT 1, The Plaintiff is DAUPHIN DEPOSIT BANK AND TRUST COMPANY, a Pennsylvania Banking corporation with its principal place of business at 213 Market Street, Harrisburg, pennsylvania 17105, 2, The Defendant, RONALD G, RUDY, is an adult individual whose last known address is 659 Mountain Road, Enola, pennsylvania 17025, 3, On or about October 31, 1995, the Defendant, as Lessee entered into a Closed-End Motor Vehicle Lease Agreement with the Plaintiff and England CPJE, of Mechanicsburg, Pennsylvania 17055, the Dealer, as Lessors, for the lease of a 1995 Eagle Talon, 4, By the terms of the Agreement the Defendant agreed to pay to Plaintiff, as Lessor, the monthly lease payment of Four Hundred Thirty-three Dollars and Ninety-eight Cents ($433,98) beginning October 31, 1995 and on the 30th day of each month thereafter for a term of Sixty (60) months. . .. ~ 5, pursuant to the terms of the Agreement, failure to make any payment on or before the date it is due constitutes a default. A copy of said Agreement is attached hereto as Exhibit "A8 and made part hereof, 6, The Defendant defaulted under the Lease Agreement by failing to make the monthly lease payment due for July 5, 1996 and all monthly payments thereafter, 7, By virtue of Defendant's default, plaintiff took possession of the Vehicle which was then held in storage at 1111 Rt, 322, Dauphin, Pennsylvania 17018, 8, On or about September 6, 1996, plaintiff sent a Notice of Repossession to the Defendant, A copy of said Notice of Repossession to the Defendant, RONALD G, RUDY, is attached hereto as Exhibit "B" and made a part hereof, 9, Defendant failed to take any timely action in accordance with said Notice of Repossession, 10, The Vehicle was sold at public sale on October 5, 1996, in Dauphin County, Pennsylvania 17018, 11, After sale of the Vehicle and application by Plaintiff of the proceeds of the sale of the Vehicle a deficiency balance in the amount of Eleven Thousand Five Hundred Eleven Dollars and Sixty-six Cents ($11,511.66), plus interest as stated in the Agreement, remained due and owing on the Agreement, 12, On or about October 17, 1996, plaintiff notified the Defendant of the deficiency balance on the Agreement and requested payment of same, A copy of said Notice to the Defendant, RONALD G, RUDY, is attached hereto as Exhibit "C" and aade part hereof, 13, The Defendant has failed to make any payment to Plaintiff on account of the deficiency balance of the Loan, 14, In the event of default by the term. of the Lea.e, the Defendant agreed to pay to Plaintiff on d..and the total of all remaining monthly Lease payments, plus the total Purchase option price, plus all repossession costs, court costs, legal fees and all other charges which the Lessee is responsible for under the Lease; less any security deposit, insurance proceeds and the highest wholesale offer received by the plaintiff, 15, The balance due and owing from the Defendant to the plaintiff is the sum of Eleven Thousand Five Hundred Eleven Dollars and Sixty-six Cents ($11,511,66), plus attorney's fees and court costs, 16, plaintiff has frequently demanded payment of the balance due from the Defendant, but the Defendant has refused and neglected and still refuses and neglects to pay same, WHEREFORE, plaintiff demands judgment against the Defendant, RONALD G, RUDY, in the amount of Eleven Thousand Five Hundred Eleven Dollars and Sixty-six Cents ($11,511,66), plus interest, attorney fees, and all other sums due under the Lease, and costs of this action, ~Q~ Albert Z, Bogert, Esquire Attorney for plaintiff 317 Third Street New Cumberland, PA 17070 (717)774-1972 1,n (If 'J'j'1fiej 1......."'..'-' , . _.i~'I___. ....Jo{3/Jq5:_-- DAUPHIN DIPDSIT BANk AND TRUST CDMPANT 2UMlrkttSt,,,, H_bu...
