I. INTRODUCTION
Deborah Thumma, plaintiff, ("the client"), by signing this agreement. retains Judith F,
Dolgos, Esquire ("the attorney"), to advise and represent the client in an action for divorce from
Tom D. Thumma. ("the defendant"). By signing this agreement the client and the attorney agree to
be bound by the following terms:
II. RETAINER FEE
This includes $250.00 to be advanced against costs which must be paid lIS incurred (cost
advance);
A non-refundable retainer of $500,00 is due at signing and may be returned by mail with
this Agreement if signed outside the presence of the attorney;
The monies advanced on the retainer will be credited toward worle done by the attorney in
pursuit of this matter and will be billed at a rate of $95.00 per hour, If the retainer should be
exhausted. the attorney will bill the client directly for worle done on this case;
Any monies advanced against costs which are not expended in suppon of the case shall be
fust applied to any outstanding fees owed to the attorney and the balance shall be refunded to the
clienL
Ill. THE ATTORNEY'S DUTIES
The attorney is obligated to advise and represent the client in the case. The obUaatiOll
extends only through the entry of decree by a court. After this point it shall DOt be ~suy for
the attorney to perform any funher services for the client in the absence of a new retlIiIer

IV. THE CLIENT'S DUTIES
The client agrees to provide all infonnation lInd papers requested by the attomcy and tll
cooperate fully in any proceedings related to thc case, including but not limited to attcnding
scheduled meetings and hearings, and participating in judicial or other proceedings as may arise
from time to time in the case. The client agrees not to communicate with the coun or administrative
tribunal without the attorney's consent The client also agrees not to misrepresent or conceal any
facts when communicating with the anomey.
V. TERMINATION OF REPRESENTATION
A. TIte Attornev's Riehl to Withdraw
The anorney may withdraw from representing the client if:
1. The client violates any of the duties in Section m (the previous section);
2. The client indicates an intention to give false testimony, or is found to have
misrepresented or concealed facts which affect the value of the case;
3.
The client directs the attorney to file any paper, or insists on advancing any claim or
defense which the anomey reasonably believes might subject her to sanctions:
The client makes a fiscally unreasonable decision as to settlement of the case;
4.
S. The client fails to honor the fmancial obligations set forth in this agreement; or
6. The attorney is required or authorized by law to withdl'llw from the client's case.
If the attorney withdraws for any of these reasons he will give the client reasonable advance
notice in writing of his intentions.

C. P~yments Reoulred Upon Termination
If the client discharges the attorney the client will pay the attorney any unpaid out-of-pocket
expenses and any outstanding fees immediately.
VI. PAYMENTS
The attorney will have complete discussion discretion to incur out-of-pocket expenses in
this case. and will ordinarily advance these sums on the client's behalf. The attorney will bill the
client for these expenses on a monthly basis. The client is ultimately responsible for such expenses
and agrees to pay them regardless of the outcome of the case by making regular monthly payments
against these bills. Unpaid bills will accrue interest at the rate of one and one-half percent (1.5%)
per month, These expenses include (but are not limited to) such items as the fees paid to courts.

expenses. long distance telephone. facsimile transmission. and photocopying charges; courier or
messenger service. and computer database access charges; and the cost of special exhibits and
supplies purchased for the case.
VD. CONFIDENTIALITY
The client understands that the attorney may consult with other attorneys. experts in other
fields. investigators and other concerning the case, The client authorizes the attorney to consult
with such persons and to divulge to them such privileged information as is necessary for them to
assist the anorney in connection with the case.

Dear Ms. Dolgos and Ms. Cantor:
By order of Court of President Judge George E. Hoffer
dated April 21, 1999, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on March 24, 1997, raising
grounds for divorce of irretrievable breakdown of the marriage
and indignities, and the economic claims of equitable
distribution and alimony pendente lite. No claim for alimony or
counsel fees and expenses has been raised. The motion for
appointment of Master, however, indicates that counsel fees,
costs, and expenses are before the Master but, as noted, no
pleading has been filed raising that claim.
I am going to proceed on the basis that grounds for
divorce are not an issue and that the parties will either sign
affidavits of consent or have been separated for a period in
exceS8 of two years. If that is not correct, please advise and
we will schedule a hearing on the alternative grounds Of
indignities.
Based on my assumption that grounds for divorce are not
an issue, I am directing each counsel to file a pre-trial
statement in accordance with P.R.C.P. 1920.33(b) on or before
Monday, May 24, 1999. Upon receipt of the pre-trial atateaenta,

A pre-hearing conference has been scheduled at the
Office of the Divorce Master, 9 North Hanover Street, Carlisle,
Pennsylvania, on the 1st day of October, 1999, at 9:30 a.m., at
which time we will review the pre-trial statements previously
filed by counsel, define issues, identify witnesses, explore the
possibility of settlement and, if necessary, schedule a hearing.

Divorce Master
has been advised that they have reached a settlement with
respect to the claim of equitable distribution.
Counsel
are going to place on the record the agreement with respect
to resolving the economic claim. The agreement as placed on
the record will be considered the substantive agreement of
the parties not subject to any changes or modifications
except for correction of typographical errors which may be
made during the transcription.
After the agreement has
been placed on the record, the court reporter will
transcribe the agreement and a copy will be sent to counsel
to make appropriate corrections of typographical errors, if
any. No substantive changes can be made to the agreement.
The parties will then sign the agreement
along with counsel affirming the terms of settlement as
placed on the record at this time.
Upon receipt by the
Master of a signed agreement, the Master will prepare an
order vacating his appointment and counsel can file a
praecipe transmitting the record to the Court requesting a
final decree in divorce. Ms. Cantor.
MS. CANTOR:
1. The parties agree that unless otherwise
specifically provided herein, this agreement shall continue
in full force and effect until such time as a final decree
in divorce may be entered with respect to the parties.
The provisions of this agreement will be
incorporated by reference but shall not be deemed merged
into any jUdgment or decree for a divorce.
This agreement shall survive any such final decree
of divorce and shall be entirely independent thereof and the
parties intend that all obligations contained herein shall
retain their contractual nature in any enforcement
proceedings.
2. The provisions of this agreement and their legal
effect have been fully explained to the parties by their
respective counsel.
3. The parties are currently joint obligors on a
Consumer Credit/Discover card obligation in the approximate
amount of $4,000.00.
Husband is the obligor on a Fingerhut bill at
approximately $1,100.00.
Husband agrees to assume the above described
debts and will either refinance them or pay them in full no
later than December 31, 1999. Husband agrees to indemnify
and hold wife harmless from said debts.
4. The parties are also joint obligors on a truck
loan through Members 1st Credit Union. Husband agrees to
refinance said loan no later than December 31, 1999. Upon
the refinance of said loan, wife shall execute all documents
necessary to transfer the title, registration and any other
necessary documentation within ten (10) days of receipt of
proof of refinance.

5. Husband represents and warrants to wife that since
separation he is not and in the future he will not contract
or incur any debt or liability for which wife or her estate
might be responsible.
Wife represents and warrants to husband that since
separation she is not and in the future she will not
contract or incur any debt or liability for which husband or
his estate might be responsible.
6. Both parties agree to indemnify and hold the other
harmless from any and all claims or demands made against
them by reason of such debts or obliqations.
7. From this day forward any debt held individually
in the parties' names shall be the sole obliqation of the
party under whose name such debt is held.
B. Husband is the owner of a premarital home located
at 233 North Middlesex Road, Carlisle, Pennsylvania. Wife
hereby waives any right, title, or interest that she may
have to said property or its increase in value.
9. Husband is the owner of retirement benefits both
lump sum and monthly benefit payments through the
Pennsylvania State Employees' Retirement System. Wife
hereby waives any right, title, and interest in said
benefits or monthly payments and specifically waives
her right to remain as a survivor annunitant on said plan.
10. The parties acknowledge that they have divided the
marital bank accounts to their satisfaction. The bank
accounts held solely in individual names shall become the
sole and separate property of the party in whose name it is
registered.
11. The parties mutually agree that they have divided
all furniture, household furnishings, and personal property
between them in a manner agreeable to both parties. The
parties mutually agree that each party shall from and after
the date of this agreement be the sole and separate owner of
all tangible personal property in his or her possession.
12. The parties hereby expressly waive, release,
discharge, and give up any and all rights or claims which
either may now or hereafter have for spousal support,
alimony pendente lite, alimony or maintenance.
13. The parties further release any rights that they
may have to seek modification of the terms of this agreement
in a court of law or equity with the understanding that the
agreement constitutes a final determination regarding the
parties obligations to contribute to the support or
maintenance of the other.
14. Counsel agree to jointly sign a letter drafted to
the Domestic Relations Office of Cumberland County
indicating that the termination of the alimony pendente lite
be effective today. Said document shall be signed no later
than Friday October B, 1999.
15. Each party agrees to be solely responsible for his
or her own counsel fees, costs, and expenses. Neither shall
seek any contribution from the other party.
16. Husband agrees to transfer the amount of
$6,900.00 as a direct rollover from his AARP IRA retirement
account held individually. Wife agrees to establish a
separate IRA or other tax deferred account in her name
alone. Upon the establishment of said account, husband

will transfer funds within thirty (30)days of receipt of
proof of said account. In the event that a Qualified
Domestic Relations Order is necessary, counsel will
cooperate in drafting an acceptable order for entry by the
Court. Transfer will occur upon approval by the Court of
Common Pleas of Cumberland County of said Domestic Relations
Order.
17. Except as herein otherwise provided, each party
may dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.
THE MASTER: Mr. Thumma, have you been
present during the statement of the agreement on the record?
MR. THUMMA: Yes.
THE MASTER: Do you understand the agreement
as stated on the record?
HR. THUMMA: Yes, I do.
THE MASTER: Do you have any questions about
it?
MR. THUMMA: The only comment that I would
like to make is that about the truck and getting provided
with the information so we can do the rollover.
THE MASTER: Well that is part of the
agreement, that is going to be accomplished.
MR. THUMMA: Other than that, no problems.
THE MASTER: Have you had an opportunity to
discuss these matters with your counsel before entering into
the agreement?
MR. THUMMA: Yes, I have.
THE MASTER: Are you satisfied that you had
sufficient time to discuss these matters with your counsel?
MR. THUMMA: Yes.
THE MASTER: You understand that when you
leave the table today that you are bound by the terms of
this agreement even though there are no signatures affixed
to the agreement?
MR. THUMMA: Yes.

2. Defendant, Tom Thumma, is an adult individual residing at 233 North
Middlesex Road, Carlisle, CUmberland County, Pennsylvania 17013.
3. Plaintiff and Defendant are busband and wife, having been married on
Febnwy 14, 1994.
4. Plaintiff filed a complaint in divorce seeking equitable distribution. alimony
pcndeDtC lite, and attorney's fees on March 21, 1997.
5. Tbc Plaintiff and Defendant bad a joint c~kl"l and liVing ICCOUIIl at
Membcn 1st Bank, account no. 107567 to which Defendant has 1CCeIS.
6, Defendant has a savings account at Members 1st Bank, account 110. 16S4S5-0
which on Fcbnwy 7, 1997 bad a ba1aDcc of $26,931.40 which is marital property, and WU
coocealcd from Plaintiff.
7. In JIIIIIl)' 1997, Defendant received a lump IIIID IIlIIlity pIJ1IICIll of
$10,463.89. Furthermore, Defendant has an IIlIIlity valued u of JW-hH 28. 1996 1&

$S13,083.99 under which a lump sum was to be paid of $S6,074.4S.
8. By concealing the existence of the savings account no. 16S4SS.o, Defendant
has wrongfully, intentionally and maliciously prevented Plaintiff from cxcrcising her right
and ownership interest in said items of property in order to defeat equitable distribution of
property .
9. The conduct of Defcndant has as heretofore stated been a continuous
misappropriation and we believe Defendant will without injunctive relief, continue to
misappropriate the marital assets.
10. Said concealment of personalitY is to Plantifrs great detriment.
11. Plaintiff has no adequate remedy at law .
12. Immediate and irreparable hann is being caused by Defendant's conduct which
is defeating Plaintifr s claims of equitablc distn'bution.
WHEREFORE, Plaintiff prays for equitable relief as follows:
<a) That an injunction issue preliminarily, and until hearing, and
rmally thereafter enjoining Defendant from disposing, transfcrring.
encumbering, concealing. selling, removing or alienating any realtY and/or
personalitY;
(b) That your Honorable Coon issue an Order requiring an

(c) Plaintiff and Defendant agree to consider filing a joint income tax, State

and debts as well as income information.
6. The parties agree to make a good faith effort to fanalize the property settlement
within 90 days.
7. If the parties are unable to come to a mutual agreement on or before the 90th
day after the signing of this Stipulation, either party may file a Motion for a bearing to issue
a permanent injunction.

telephone number,job classification and such other information as would enable Defendant to locate
the person, interview him or her, or serve a subpoena upon him or her. When used in respect ofa

executed it, and the particular part, paragraph, or other subdivision there of which is particularly
relevant to the question; also state the place where it is kept and identify the person in whose custody
it may be found, with such specificity as will enable Defendant to obtain the document through the
