HEALTH INSURANCE COVERAGE FOR ASIILEE E. COXEN WILL BE TilE

THE TERMS SPECIFIED FOR CHILD SUPPORT CANNOT BE REDUCED FOR
ANY REASON, BUT MAY BE INCREASED, ONLY IF THERE IS AN INCREASE

FOR THE ECLIPSE WITH THE UNDERSTANDING THAT IF THE LOAN BECOMES
IN DEFAULT AT ANY TIME, THE VEHICLE WILL BECOME MICHAEL'S
POSSESSION TO SELL IN ORDER TO SATISFY THE LOAN. CATHY SHALL
MAKE EVERY EFFORT TO RE-FINANCE THE ECLIPSE IN ORDER TO
REMOVE MICHAEL FROM RESPONSIBILITY FOR THE EXISTING LOAN. IF
THIS ATTEMPT PROVES UNSUCCESSFUL, THE ABOVE AGREEMENT SHALL

CATHY J. COXEN SHALL REMAIN THE PROPERTY OF JASIE L. GARLIN,

IN THIS EVENT, MICHAEL SHALL BE PERMITTED TO SELL THE AUTOMOBILE
IN ORDER TO SATISFY THE LOAN FOR WHICH HE HAS CO-SIGNED.
LIFE INSURANCE
LIFE INSURANCE CURRENTLY BEING HELD THROUGH THE "INDEPENDENT
ORDER OF FORESTERS" WILL CONTINUE TO BE PAID BY CATHY, WITH
NO CHANGE IN THE AMOUNT OF COVERAGE. THIS SHALL CONTINUE
UNTIL SUCH TIME THAT A DIVORCE MIGHT TAKE PLACE. AT THAT TIME,
CATHY WILL HAVE ALL RIGHTS TO RECOVERY OF ANY CASH VALUE
ON THIS POLICY. THIS, IN LIEU OF SPOUSAL SUPPORT OR ALIMONY
IS AGREED TO. MICHAEL, HOWEVER HAS THE RIGHT TO CHANGE THE
BENEFICIARY FOR THE SUM OF LIFE INSURANCE BEING PAID FOR HIM.
FEDERAL, STATE AND LOCAL TAXES
ALL FEDERAL, STATE AND LOCAL TAX LIABILITY FOR 1995 SHALL BE
THE SOLE RESPONSIBILITY OF MICHAEL D. COXEN. BOTH AGREE THAT
ALL INCOME TAX FILING WILL BE DONE WITH THE LEAST LIABILITY
TO MICHAEL ~ND THAT MICHAEL MAY CLAIM CATHY, ASHLEE, AND

directed as follows:
1. The Mother, Cathy J. Coxen, and the Father, Michael D. Coxen, shall
have shared legal custody of Ashlee Ellen Coxen, born June I, 1983, and
therefore, shall consult with eachother in making major decisions affecting the
Child, including but not limited to, educational, religious and medical
decisions.
2. The Mother shall have primary physical custody of the Child.
3. The parties shall follow the recommendations of the Child's counselor,
Wendy Minnix, of the Carlisle Area Counseling Service, with regard to
initiating and maintaining contact between the Father and the Child.
4. As the Child's counseling progresses, in the event either party feels
it is necessary to make adjustments to the existing CUstody Order and the
partie~ are unable to reach an agreement between themselves, counsel for either
party may contact the CUstody Conciliator within three (3) months of the uate
of this report to schedule an additional Conference.
5. This Order is entered pursuant to an agreement of the parties at a
CUstody Conciliation Conference. The parties may modify the provisions of this
Order by mutual agreement. In the absence of mutual agreement, the terms of
this Order shall control.

My undcrstanding is that the only claim hefore thc Mastcr is the equitable distribution claim
filed by Plaintiff, You are correct in nOling that the Ihrcshhold issue to this is the wrillen seperation
agreement.
I am never sure how to handle these, In the case of Cassell v, Cassell, the Master heard
testimony regarding the seperation agreement, and 1 guess I assumed that's the way it should be
handled, procedurally, in Cumberland County,
If you feel that thc issue of the seperation agreement needs to be referred to Court, then I
suppose that's what we'll have to do,

rate) to the Plaintiff, the additional sum of$25.00 per week shall be dropper, or adjusted accordingly.
Should the Defendant's medical insurance ever change to be sufficient overage for Ashlee Coxen, the
child of the parties, the Plaintilr s insurance expenses will also no longer be the responsibility of the
Defendant.
This Agreement will be assumed in force as of September I, 1998 and continue until Ashlee
Coxen, goes to college, completes college.
In the event that Ashlee Coxen begins college but withdraws prior to the completion of a
