Count I
NEGLIGENCE
10. Defendant incorporate by reference its responses to
Paragraphs 1 through 9 of Plaintiff's Complaint as set forth
above herein.
11. Denied. The allegations of this paragraph constitute
conclusions of law to which no responsive pleading is required

and accordingly, the same are denied and strict proof thereof is
demanded at trial. It is also specifically denied that Defendant
breached its standard of care by failing to adequately perform
the services and repair outlined in the work order.
12. Denied. The allegations of negligence set forth in
this paragraph, together with its sub-parts (a)-(e) are
specifically denied. (Sub-Paragraph 12(f) was removed with
prejudice by stipulation executed by counsel and filed with the
Court on April 22, 1997.) To the contrary, at all times relevant
to the material allegations set forth in Plaintiff's Complaint,
Defendant acted with reasonable care under the circumstances. By
way of further answer:
(a) Defendant specifically denies failing to replace
the oil plug securely after service;
(b) Defendant specifically denies failing to tighten
the oil plug properly;
(c) Defendant specifically denies failing to use
proper equipment to replace the oil plug;
(d) Defendant specifically denies failing to install
the oil plug in a manner which would prevent
leakage;
(e) Defendant specifically denies failing to
adequately inspect the vehicle at the completion
of the repair job.
13. Denied. The allegations of this paragraph constitute
conclusions of law to which no responsive pleading is required
and accordingly, the same are denied and strict proof thereof is

demanded at trial. Defendant specifically denies all of

same are denied and strict proof thereof is demanded at trial.

NEW MATTER DIRECTED TO PLAINTIFF
20. Defendant hereby incorporates by reference, as if set
forth at length herein, its responses to Paragraphs 1 through 19
above.
21, Plaintiff or its authorized agent's comparative
negligence was a substantial factor in bringing about any
injuries and/or damages alleged in his Complaint.
22. In the event that Plaintiff was injured and/or damaged
as alleged, which allegations are specifically denied, said
injuries and/or damages were caused by the actions and/or
inactions of Plaintiff and/or others over whom Defendant had no
control nor right of control.
23. Plaintiff has failed to state a cause of action upon
which relief can be granted.
24, Plaintiff's claims are barred by the applicable
provisions at the Pennsylvania Worker's Compensation Statute.
25. Defendant owed Plaintiff no duty of care under the
circumstances alleged in Plaintiff's Complaint.

26. Plaintiffs' claims are barred by the applicable statute
of limitations.
27, Defendant hereby asserts and invokes each and every
defense and/or exclusion and/or limitation available to it under
the contract of the parties at issue herein.
28. Defendant breached no contract obligations and/or
duties complained of by plaintiff in this action.
29. plaintiff did not incur the losses claimed in its

30. plaintiff's claims and causes of action of barred by
the applicable doctrines of waiver and/or estoppel.
31. plaintiff's Complaint fails to state claims or causes

34. The conduct of persons and/or entities other than
Defendant constitutes an intervening, superseding cause obviating
any liability on the part of Defendant, the existence of any such

35, Some or all of the damages claimed in P~aintiff's
Complaint are not recoverable under applicable law.
36. If plaintiff suffered damages as described in its
Complaint, which is specifically denied, such damages were caused

and/or contributed to by conditions over which Defendant had no
control, and for which Defendant is not responsible.
37. Plaintiff's damages were proximately caused by
substantial alteration, modification, abnormal use and/or
substantial change of the oil pain/plug/tractor trailer in
question between the time that it left Defendant's control and
that time at which Plaintiff was allegedly damaged.
38. The alleged incident and damages were not caused by a
condition of the oil pan/oil plug/tractor trailer which existed
at the time that it was within the possession and control of
Defendant.
39, If it is determined that a contract existed between the
Plaintiff and Defendant, Defendant specifically denies that it
breached said contract.
40. In the event it is determined that Defendant breached
any contract, Defendant specifically denies that said breach was
material or was the proximate cause of any damages.
41. Plaintiff has waived and/or is estopped from recovering
the damages it alleges in its Complaint, due to Plaintiff and/or
its authorized agents Waiver/Release and Indemnification of
Liability, as set forth in the work order attached to Plaintiff's
Complaint as Exhibit "A".
WHEREFORE, Defendants demand judgment in their favor and
against Plaintiffs, together with interest, cost, attorney's fees
