Plaintiff, NOVCO SUPPLY, INC., is a corporation authorized to do business in the Commonwealth of Pennsylvania with onices and/or a place of business situate al 629 West Main Slreel, P,O. Box 420, Mechanicsburg, Cumberland Counly, Pennsylvania, 2. Defcndanl DOUG MOORE is an adult individual with a last known address of 980 Green Lane, Mechanicsburg, Cumberland Counly, Pennsylvania. 3, Plaintiff is, and at all relevant times was, a wholesalc dislributor of building supplies. 4. Defcndant is, and at all relevanllimcs was, a contractor, 5. Between Augusl 13, 1996 and December 12, 1996, various producls, goods. supplies, and materials (hercinaller collectively referred 10 as "products") wcre ordered by Defendanl from Plaintiff, Plaintiff sold and provided the products ordered by Defendant, Ihe same being represenled by filly-scven (57) invoices, a list of which is allached hcrcto and made a part hereof and referred 10 as Exhibil "A". 6. The prices charged for the products sold 10 Dcfendant as set forth in Exhibil "A" were Ihe fair, reasonable, and markel priccs of the producls, and Ihe prices Ihat Defendant agreed to pay. 7, The lisl of invoices allached 10 Plainlifl's Complainl as Exhibil "A" represenl producls sold by PlaintilT and purchascd by Defcndant pursuant 10 Dcfcndanl'S account wilh PlainlilT. 8. Defendanl has nol objected 10 any oflhese invoiccs and has acceplcd Ihe products provided Ihereby, bUI has failcd 10 pay PlainlilT despite demand pursuant 10 its open accounl, all to Ihe damage of Plaintiff. 9. PlaintilT has maintained a slatement of account keeping an accurate and running amounl of debils and crcdils for the salc of producls sold 10 Defendanl by PlainlilT. 10, PlainlilThas submilled 10 Defendanl a stalemenl ofaccounl accurately showing all debils and credils for lransaclions with Defendanl, said stalemenl of accounl shows an amount owing 10 PlainlilTof$12.387,96 through March I, 1997, A copy oflhc Slalemenl of account consisling of Iwo (2) pages is allachcd hereto and made a part hereof and referred 10 as Exhibit nBIl. 11. Pursuanllo Ihe Icrms and condilions of sale slated on Ihc invoices, PlainlilTis enlitled to receive a finance charge of 1.5% per monlh on pasl due amounts. 12. Plaintill'has rctaincd Ihc services oflhe law firm of KUNDRAT & SEDOR allhe rale 01'$150.00 per hour in Ihe colleclion oflhe amounts due from Defendant. 13. PlainlilThas incurred reasonable attorney's fees fromlhe law ofiices of KUNDRAT & SEDOR al the rale 01'$150,00 per hour in Ihe colleclion oflhe amounls due from Defendanl incident to Ihe commencemenl oflhe within aclion; Plainliffshall continue 10 incur such attorney's fees Ihroughoullhe conclusion oflhe proceedings, 14.
