COMPLAINT
AND NOW COMES Plaintiff, Mid Penn Bank. by and through its attorney, Peter
Speaks, Esquire, and files this Complaint and specifically avers the following in support
thereof:
I. Plaintiff, Mid Penn Bank, is a bank organized and existing by virtue of the laws
of the Commonwealth of Pennsylvania with a principle place of business located at 349
Union Street, MilIersburg, Dauphin County. Pennsylvania.
2. Defendant, Gary Mixell, is an adult individual residing at 866 Center ROad,
Newville, Cumberland County, Pennsylvania.
3. This Court has jurisdiction over this matter pursuant to 42 Pa. C.S.A. Section
5301 (a)(2) and 42 Pa. C.S. Section 55 17(b).
4. At all times relevant hereto, Defendant executed Credit Application! Agreement
with Mid Penn Bank for a Visa Credit Card. A true and correct copy of said
Application! Agreement is attached hereto and incorporated herein as reference as Exhibit
"A,"
5. Mid Penn Bank approved Defendant for said Visa and Defendant accepted the
terms and conditions as set out in the Agreement signed by him.
6. Defendant is in default for failure to make payments when due. and that upon
default, Mid Penn Bank can demand all amounts due and owing immediately payable.
7. Defendant failed and or refused to make the payments due on his Visa Credit
Card from approximately April 1996 leaving a principle balance of $2.522.24 owed to
Plaintiff.
8. Mid Penn Bank attempted to resolve the outstanding balance on numerous
occasions but Defendant failed and/or refused to make any payment on the amount due
and owing.

ANSWER
AND NOW, comes the Defendant, Gary Mixell, by and through his
attorney, Richard L. Webber, Jr., and files this Answer, averring
the following:
1. - 6. ADMITTED.
7. ADMITTED in part and DENIED in part.
It is ADMITTED that
Defendant did not make some of the payments that were due
subsequent to April 1996. The allegation that no payments have
been made since April 1996 is DENIED. The folloWing payments have
been made since that time:

$ 650.00
It is denied that the principal balance is $ 2,522.24. A
principal balance of $ 2,241.24 was owing as of November 22, 1996
immediately after the payment of $ 400.00 was credited.
8. ADMITTED in part and DENIED in part. It is admitted that Mid
I verify that the statements made in this Answer are true and
correct. I understand that false statements herein are made subject
to the penalties of 18 Pa.C.S.A. Section 4904 relating to unsworn
falsification to authorities.
