3. The Commonwealth of Pennsylvania has jurisdiction
over this matter as Defendant has expressly agreed to be
bound by the laws of this state as reflected by his
acceptance of and signature on the Note and Security
Agreement with The Bank of Landisburg. A true and correct
copy of which is attached to this Complaint, and is
incorporated herein by r.eference as Exhibit "A".
4. On or about November 26, 1993, Defendant executed
said Note and Security Agreement (hereinafter "Agreement")
from The Bank of Landisburg pledging, granting, and/or
conveying a security interest in the goods or property being
purchased, i.e. the mobile home, and all other collateral.
5. The Bank of Landisburg approved Defendants for said
loan and advanced Defendants $8,190.54 on the basis of the
aforementioned Note and Agreement set forth herein.
6. Defendants accepted the terms and conditions set out
in the Note and Agreement signed by him, whereby payments
were to be made for forty-eight (48) months in the amount of
$221.76 per month plus any interest accrued on the account.
7. According to the terms of the Note, Defendants are
deemed to be in default upon failure to make payments when
due, and that upon default, The Bank of Landisburg can demand
all amounts due and owing immediately payable.
8. Detendants tailed and/or refused to make the
payments due on the loan since February 26, 1996 leaving a
balance ot $5,577.89 outstanding.
9. The Bank ot Landisburg attempted to resolve the
outstanding account on numerous occasions but Defendant
failed and/or refused to make any payment on the amount due
and owing.
10. Pursuant to the terms of the Note and Agreement,
duly acknowledged and accepted by Defendants, Defendants,
Kenneth E. Weller and Jennifer L. Weller, defaulted on his
contract with The Bank of Landisburg.
11. The Bank of Landisburg has determined that the total
amount due and owing by Defendants, excluding costs of this
suit which are to be determined, are as follows:
Principal Amount $5,577.89
Collection Costs $1,115.58
Attorney's Fees $ 836.68
Interest $ 334.67
TOTAL $7,864.82
12. Defendants' refusal to payoff said balance
constitutes unjust enrichment to Defendants and injury to
Plaintiff.
WHEREFORE, Plaintiff, The Bank of Landisburg, demands
jUdgment in its favor for the past due amount of Seven
Thousand Eight Hundred sixty-four and 82/100ths ($7,864.82),
including all applicable late charges, interest, and
attorneys fees, and all costs related to this action.
