STIPULATION AGAINST LIENS
THIS AGREEMENT made the 27th day of March, 1997, by and
between SHERIPP BUILDERS, hereinafter referred to as contractor,
and SHAWN L. BRICKNER and HOLLY A. BRICKNER, hereinafter referred
to as Owner, whereby the former undertook and agreed to erect and
construct a custom built home on that certain lot of ground
situate at 236 Clearview Drive, Carlisle, Cumberland county,
Pennsylvania, more fully described in Exhibit nAn attached hereto
and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said contractor, for
and in consideration of the sum of ($1.00) Dollar to Contractor
in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and

others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

ALL that certain tract of land situate in North Middleton
Township, Cumberland County, Pennsylvania, and more particularly
bounded and described in accordance with Final Subdivision Plan
for Paul L. & Marjorie M. Cline, prepared by Fisher Mowrey
Rosendale and Associates, Inc., which siad subdivision plan is
recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan Book 64, Page 91, as
follows:
BEGINNING at an iron pin on the southern line of Clearview
Drive at the northeast corner of land now or formerly of
Jacqueline M. Pond, widow; thence along the southern line of said
Clearview Drive, North 73 degrees 30 minutes 20 seconds East
99.57 feet to an iron pin; thence along the western line of Lot
No. 2 on the hereinabove mentioned subdivision plan, South 09
degrees 06 mintues 34 seconds East 159.93 feet to an iron pin;
thence along Lot No.1 (residual area), South 63 degrees 35
minutes 00 seconds jWest 93.70 feet to an iron pin; thence along
the eastern line of land now or formerly of said Pond, North 12
degrees 08 minutes 40 seconds West 175.26 feet to an iron pin,
the point and place of BEGINNING.
BEING Lot No. 3 on the hereinabove mentioned subdivision
plan, and containing 15,853.76 square feet.
BEING the same premises which Paul L. Cline and Marjorie M.
Cline, his wife, by their Deed dated September 28, 1994 and
recorded in the Office of the Recorder of Deeds of Cumberland
County in Deed Book 113, Page 80, granted and conveyed unto Shawn
L. Brickner and Holly A. Brickner.
