1. Plaintiff, HOMES IDE LENDING, INr.., F/K/A BANCBOSTON MORTGAGE
CORPORATION, is a corporation with an office at Post Office Box
44090, Jacksonville, Florida 32231.
2. Defendants, KEITH A. HEDRICK AND KIMBERLY A. HEDRICK, are both
adult individuals whose last known residence is 760 East Louther
Street, Carlisle, Pennsylvania 17013.
3. On or about March 12, 1990, Defendants executed and delivered a
Mortgage Note in the sum of $61,650.00 payable to GMAC Mortgage
Corporation of PA, (original mortgagee), a copy of said Note is
attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and County in the Office of the Recorder of Deeds in
Mortgage Book 969, page 99, conveying to the original Mortgagee the
real estate described therein. The Mortgage was further assigned to
BancBoston Mortgage Corporation and was recorded in the within
Commonwealth and County in Mortgage Book 377, Page 738 on March 12,
1990. (BANCBOSTON MORTGAGE CORPORATION is N/K/A HOMESIDE LENDING
INC.,) Said Mortgage and Assignment are incorporated herein by reference.
5. The land subject to the Mortgage is: 102 Spruce Street,

Carlisle, Pennsylvania 17013, and is more particularly described in
Exhibit "B" attached hereto.
6. Defendants are the real owners of the land subject to the

Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on January 1, 1996 and all
subsequent installments thereon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balance
(b) Interest at $15.34 per day
from 12/1/95 to 4/1/97
(based on contract rate of 9.5%)

The attorney's fees set forth above are in conformity with the
Mortgage documents and Pennsylvania law, and will be collected in the
event of a third party purchaAer at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance pursuant to Section 403 of Pennsylvania Act No. 6 of 1974 is

not required in that the original loan balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United
States of America, nor engaged in any way which would bring them
within the Soldiers and Sailors Relief Act of 1940, as amended.
11. The subject Mortgage is insured by the Federal Housing
Administration under Title II of the National Housing Act (12
U.S.C.A. Section 707 - 1715z11) and therefore does not fall within
the provisions of Pa. Act 91 of 1983 (Homeowners' Emergency
Assistance Act of 1983).
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure
in rem for the aforementioned total amount due together with interest
at the rate of 9.5% ($15.34 per diem), together with other charges
and costs, including escrow advances incidental thereto, to the date
of Sheriff's Sale, and for foreclosure and sale of the property
within described.

1. Plaintiff, HOMES I DE LENDING, INC., F/K/A BANCBOSTON MORTGAGE
CORPORATION, is a corporation with an office at Post Office Box
44090, Jacksonville, Florida 32231.
2, Defendants, KEITH A. HEDRICK AND KIMBERLY A. HEDRICK, are both
adult individuals whose last known residence is 760 East Louther
Street, Carlisle, Pennsylvania 17013.
3. On or about March 12, 1990, Defendants executed and delivered a
Mortgage Note in the sum of $61,650.00 payable to GMAC Mortgage
Corporation of PA, (original mortgagee), a copy of said Note is
attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and County in the Office of the Recorder of Deeds in
Mortgage Book 969, page 99, conveying to the original Mortgagee the
real estate described therein. The Mortgage was further assigned to
BancBoston Mortgage Corporation and was recorded in the within
Commonwealth and County in Mortgage Dook 377, Page 738 on March 12,
1990. 03ANCBOSTON MORTGAGE CORPORATION is N/K/A HOMESIDE LENDING
INC.,) Said Mortgage and Assignment are incorporated herein by reference.
5. The land subject to the Mortgage is: 102 Spruce Street,
Carlisle, Pennsylvania 17013, and is more particularly described in
Exhibit "B" attached hereto.
6. Defendants are the real owners of the land subject to the
Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on January 1, 1996 and all
subsequent installments thereon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balance
(b) Interest at $15.34 per day
from 12/1/95 to 4/1/97
(based on contract rate of 9.5%)

The attorney's fees set forth above are in conformity with the
Mortgage documents and Pennsylvania law, and will be collected in the
event of a third party purchaser at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance pursuant to Section 403 of Pennsylvania Act No. 6 of 1974 is
not required in that the original loan balance exceeds $50,000.00,
10. Defendants are not members of the Armed Forces of the United
States of America, nor engaged in any way which would bring them
within the Soldiers and Sailors Relief Act of 1940, as amended.
11. The subject Mortgage is insured by the Federal Housing
Administration under Title II of the National Housing Act (12
U.S.C.A. Section 707 - 1715z11) and therefore does not fall within
the provisions of Pa. Act 91 of 1983 (Homeowners' Emergency
Assistance Act of 1983).
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure
in rem for the aforementioned total amount due together with interest
at the rate of 9.5% ($15.34 per diem), together with other charges
and costs, including escrow advances incidental thereto, to the date
of Sheriff's Sale, and for foreclosure and sale of the property
within described.

PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT
AND NOW, comes the Plaintiff, Homeoide Lending, Inc. f/k/a
BancBoston Mortgage Corporation, by ita ilttorrwyn, PUl'coll, Krug &
Haller, and files the within Motion for Summary ,Judgment, and avers
in support thereof the following:
1. This action in mortgage foreclonufn wan originally
instituted in the Court of Common Pleas of CUlllberlilnd County by
Complaint filed to No. 1997-01606 on March 31, 1997,
2. Defendant, Kimberly A. Hedrick (hereinilftor "Defendant"),
filed a pro se Answer titled "Preliminary Objoctiono" to Plain-
tiff's Complaint on April 24, 1997.
3. In her "Answer", Defendant admitted her current address,
but failed to respond to any of the other factual averments in
Paragraphs 1, 3, 4, 5, 6, 7. 8 or 10 of Plaintiff's Complaint.
4. Rule 1029 of the Pennsylvania Rules of Civil Procedure
governs the proper procedure for a party to respond to a factual
pleading. Rule 1029 reads in pertinent part:
a) A responsive pleading ohall admit or deny each
averment of fact in the preceding pleading or any
part thereof to which it is responsive. A party
denying only a part of an averment shall specify so
much of it as is ildmitted and shall deny the re-
mainder. Admissiono and denials in a responsive
pleading shall refer opecifically to the paragraph
in which the averm~nt admitted or denied is set
forth.
b) Averments in a pleading to which a responsive
pleading is required are admitted when not denied
specifically or by necessary implication. A gener-
al denial or a demand for proof, except as provided
by subdivision (c) and (e) of this rule, shall have
the effect of an admission.
c) A statement by a party that after reasonable inves-
tigation the party is without knowledge or informa-
tion sufficient to form a belief as to the truth of
an averment shall have the effect of a denial.
5. The Defendant should be deemed to have admitted the
averments in Paragraphs 1, 3, 4, 5. 6. 7, 8 and 10, owing to her
failure to properly deny the averments.
6. In Paragraph 9 of the Complaint, the Plaintiff pled it
was not required to comply with the notice procedure of Act 6 of
1974.
7. Because the Defendants' original Note was for an amount
in excess of $50,000.00, the Plaintiff had no statutory obligation
to send the Defendants a pre-foreclosure notice in compliance with
Pennsylvania Act 6 of 1974.
8. In Paragraph 11, the Plaintiff also averred that it was
not required to send notice under Act 91 of 1983, since the
Defendants' Mortgage was HUD insured.
9. It is clear from the face of the Note and Mortgage that
the documents are insured by the Federal Housing Administration
under Title II of the National Housing Act.
10. Since the Mortgage is a FHA insured obligation, it is
exempt from the provisions of Pennsylvania Act 91 of 1983.

11. The only "defense" offered by the Defendant for her
delinquency is her allegations that her estranged husband, Co-
Defendant, Keith A. Hedrick, was previously in possession of the
subject premises and therefore responsible for payment.
12. Pursuant to Paragraph 9 of the Note and Paragraph 12 of
the Mortgage, since both Defendants signed the documents, they are
joint and severally liable for payment of the mortgage payments.
13. Upon Affidavit filed concurrently with this Motion, the
status of the mortgage payments made to and received by Plaintiff
is verified and reveals that Defendants are in default under the
terms of the Mortgage and that no cure has been effected.
14. The Affidavit further indicates that Plaintiff is the
owner and holder of the Mortgage Note dated March 12, 1990 executed
by Defendants in the amount of $61,650.00 for real estate situated
at 102 Spruce Street, Carlisle, Cumberland County, Pennsylvania, of
which Defendant is one of the record owners.
15. By reason of the Defendant's foregoing admissions and the
documentation of default without an allegation that the default has
been cured or documentation thereof, there is no longer a triable
issue of fact or law.
16. There being no defense to Plaintiff's Complaint, judgment
should be entered in favor of Plaintiff and against Defendant,
Kimberly A. Hedrick.

HOFFER, P.J.:
In this opinion, we address Plaintiffs Motion for Summary Judgment.
Homeslde Lending, Inc. ('Plaintiff') filed a complaint against Keith and Kimberly
Hedrick ('Defendants') on March 31, 1997, alleging that Defendants defaulted
on their mortgage. Plaintiff asked for a judgment In the form of a mortgage
foreclosure along with Interest, charges and costs. Kimberly Hedrick filed a pro
se preliminary objection on April 24, 1997. This preliminary objection was never
listed on the argument court schedule. There Is no record on the docket for any
filings by Keith Hedrick.
On November 21, 1997, Plaintiff filed a motion for summary judgment
against the Hedricks. In this motion, Plaintiff states that the Court should construe

Kimberly Hedrick's Preliminary Objection as an Ai1swer. Plaintiff goes on to
suggest that by treating the Defendant's preliminary objection as an answer,
Defendant has failed to respond to most of the factual averments thereby rendering
these averments as true. Based upon these facts, Plaintiff now asks for summary
judgement against both Keith and Kimberly Hedrick. The Court denies Plaintiff's
Motion for Summary Judgment.
DISCUSSION
The rule for summary judgment Is as follows: "[A]fter the relevant
pleadings are closed but within such time as not to delay trial, any party may
move for summary judgment In whole or In part as a matter of law.' Pa. R. Civ.
P. 1028 (1997). The Court finds that Plaintiff's motion for summary judgment is
premature at this time.
The rule for summary judgment requires that the motion be filed after the
relevant pleadings are closed. In this case, the relevant pleadings have not been
closed since neither of the defendants have filed an answer. Plaintiff asks this
Court to determine that Defendant's Preliminary Objection be deemed an answer;
however, Plaintiff offers no authority to show that a court has the discretion to
redefine and retitle any motions or pleadings submitted by either party.'

preliminary objection is by filing a preliminary objection to the Defendant's

ALL THAT CERTAIN lot of ground situate in the Borough of Carlisle,
Cumberland County, Pennsylvania, being the southern half of Lot No.
32, Block 2 in plan laid out by J. H. and G. M. Bosler, recorded in
Cumberland County Misc. Record book 13, Page 181, bounded and
described as follows:
BOUNDED on the East by Spruce Street (formerly Chestnut Street); on
the South by East Louther Street; on the West by an alley; and on
the North by the line of the partition wall between 102 and 104
Spruce Street; CONTAINING in front on said spruce Street 15 feet
and extending at an even width in depth to the alley aforesaid, a
distance of 150 feet.
HAVING THEREON ERECTED the southern half of a double two and one
half story brick dwelling house known as 102 Spruce Street, Zi
Carlisle, PA.
BEING THE SAME PREMISES WHICH Douglas E. Pfahl et al by deed dated
March 12, 1990 and recorded in Cumberland County Record Book L-34,
