THIS AGREEMENT made the ,).t,.kl.,day of March, 1997, by and between H. EDWIN I
BERKHEIMER, hereinafter referred to as Contractor, and STEPHEN P. RILEY and CAROLYN C. · J
RILEY, husband and wife, hereinafter referred to as Owner, whereby the former undertakes and
agrees to erect and construct a single family dwelling on:
ALL THAT CERTAIN piece or parcel of land situated in the Township of South
Middleton, County of Cumberland and Commonwealth of Pennsylvania, more particularly
bounded and described as follows:
BEGINNING at a point on the Northern right-of-way line of North Pin Oak Drive at
the dividing line between Lots Nos. 30 and 31 as shown on the hereinafter mentioned Plan of
Lots; thence along said dividing line between Lots Nos. 30 and 31, North 3 degrees 13 minutes
35 seconds East, a distance of 150 feet to a point at lands of others ("Lindsay Acres"); thence
along said latter lands, South 86 degrees 46 minutes 25 seconds East, a distance of 136.56
feet to a point at ths dividing line between Lots Nos. 31 and 32 as shown on the hereinafter
mentioned Plan of Lots; thence along said dividing line between Lots Nos. 31 and 32, South 15
degrees 39 minutes 7 seconds West, a distance of 162.59 feet to a point on the Northern right-
of-way line of North Pin Oak Drive; thence along said Northern right-of-way line of North Pin
Oak Drive, ths following two (2) courses and distances: (a) on a curve to the left having a
radius of 375 feet, an arc distance of 81.33 feet to a point; and (b) North 86 degrees 46
minutes 25 seconds West, a distance of 20.89 feet to a point on the same at the dividing line
between Lots Nos. 30 and 31 as shown on the hereinafter mentioned Plan of Lots, the Place
of BEGINNING.
BEING Lot No. 31 as shown on a certain Subdivision Plan of Lots entitled "Final
Plan of Phase Four for THE OAKS" as recorded in the Office of the Recorder of Deeds in and
for Cumberland County, in Plan Book 66, Page 65, and consisting of 18,249.39 square feet.
BEING the same property which Max E. Stoner and Lawrence C. Zimmerman, Co-
partners, trading and doing business as STONER & ZIMMERMAN ENTERPRISES, a Pennsylvania
General Partnership, by its Deed dated November 26, 1996 and recorded November 27, 1996
in the Office of the Recorder of Deeds in and for Cumberland County, in Deed Book 149, Page
887, granted and conveyed unto Stephen P. Riley and Carolyn C. Riley, husband and wife.
UNDER AND SUBJECT, nevertheless, to the building and use restrictions which
shall be binding on the within described tract of land only and shall not be deemed tract
restrictions, as set forth in Deed Book 149, Page 887.
