AND NOW, this 30th of November, 1994, upon
consideration of the Petition for Adjudioation of Incapacitated
Person and for Appointment of Plenary Guardian Pursuant to 20
Pa. e.s. 5511, and following a hearing at whioh the allegedly
inoapaoitated person WaS present, Jaok Alspaugh is adjudioated
an inoapaoitated person and Robert Goril, Administrator of the
Mental Health/Mental Retardation Agenoy for Cumberland and Perry
Counties, is appointed plenary guardian of the person of Jaok
Alspaugh. The guardian is directed to file reports in
accordanoe with the provisions of 20 Pa. e.s. Section 5521(c).
No bond shall be required of the guardian. This Order shall
supersede any prior orders of guardianship in this case.
Notice is hereby provided in person to Jack
Alspaugh of his right to appeal and to petition to modify or
terminate the guardianship.

At issue in the present case is whether Jack Alspaugh
should be adjudicated an incapacitated person, and if so whether
Petitioner should be appointed plenary guardian of his person.
A hearing was held on the matter on Wednesday, November 30, 1994
before the undersigned judge. The allegedly incapacitated
person was present at the hearing. Based upon the evidence
presented at the hearing, the following Findings of Fact,
Discussion, and Order of Court are made and entered:
FINDINGS OF FAC~
1. The allegedly incapacitated person is Jack
Alspaugh, a domiciliary of Cumberland County, Pennsylvania,
residing at the Cumberland County Nursing Home, 375 Claremont
Road, Carlisle, Pennsylvania.
2. Petitioner is Robert Goril, Administr~tor of the
Mental Health/Mental Retardation Agency for Cumberland and Perry
Counties.
3. Mr. Alspaugh suffers from an adjustment disorder
as well as mental retardation, which has existed since his birth
on March 15, 1933.
4. The condition of retardation and the adjustment

disorder are such that they impair the oapaoity of Mr. Alspaugh
to make and communioate decisions; his capaoity to receive and
evaluate information and oommunicate deoisions has been impaired
by those conditions tc such a significant extent that he is
totally unable to meet the essential requirements for his
physioal health and safety.
5. GUardianship services are necessary for
Mr. Alspaugh.
6. Based upon the aforesaid condition of Mr. Alspaugh
and his lack of capacity to make and communicate decisions, a
plenary guardianship with respeot to his person is required.
7. In view of the absence of a favorable prognosis
for change at this time, the duration of the guardianship
required is indefinite, pending further Order of ecurt and
apparently permanent.
8. Pursuant to 20 Pa. C.S. Section 5512.l(c) it is
expressly found that Mr. Alspaugh is completely incapacitated
and in need of plenary guardianship services with respect to his
person.
9. Petitioner is a person qualified under Pa. C.S.
Section 5511(f) to serve as plenary guardian of his person.
10. The foregoing findings of fact are made on the
basis of clear and convincing evidence.
DISCUSSION
The provisions respecting an adjUdication of
incompetency have recently been amended and are contained in 20
Pa. C.S. Section 5501, et sea. Petitioner has fully complied
with these provisions, and based on the foregoing Findings of
Fact, the following Order of Court will be entered:

1) Your Petitioner is Robert L. O'Brien, Esquire, Solicitor for
the Cumberland/Perry Mental Health/Mental Retardation Office.
2) Respondent is James Alspaugh, an incapacitated person,
residing at Lancaster osteopathic Hospital Psychiatric Unit. Respondent
is an adult individual being presently 61 years of age with a birth date
of March 15, 1933.
Attached hereto, marked as Exhibit "A", i\l1d
incorporated herein by reference is a socJ.al summary and hosp.ital
records in reference to his current situation.
3) Petitioner requests that the Court appoint June Alspaugh,
residing at 68 Lebo Road, Carlisle, Pennsylvania, as emergency guardian
for the limited purpose of executing certain forms and waivers that are
required to insure the continuation and availability of care and
treatment for Respondent and admittance intc the Cumberland County
Nursing Home. An J.nitial determination has been made that, due to
Respondent's low intellectual functioning, he is unable to make a
determination in reference to his placement/waiver, and that, in order
to comply with applicable state and federal laws, a guardian be
appointed by the Court for the purpose of making Raid election and
signing the necessary forms.
4) Ms. Alspaugh is ill and it is anticipated that Robert Goryl
will succeed as a permanent guar.dian, to the extent necessary for Mr.

Jim indicated that there il primarily one major
preCipitator leading to Jack's deprftslion and naed for inpatient
psychiatrio treatment at thil time. He explained that Jaok b
mUdly mentally rl!ltardl!ld and hall primarily led a vl,iry sheltered
life. Apparently Jaok remained in hil parent's homl,i until their
death. in 1970. At that time he then went to live with his older
. brother John and hie brother Jim. Jim etxplainad that with hb work
sohedule all well AS with John'll they wen able to primarlly prOVide
24 hout' supervision for Jaok. He indioated that John worked nights
and than wa. home during the day and Jim worked daye and wae home
in the eveninqs and niqhts. This arrangement went quite well,
however, their brother John passed away moet reoently in April of
1994. Jim indicAtea thAt Jack was very close to John and John
primarily "waited on Jeok hand ana foot". Jim indioated that John
wal however, unable to ;et Jaok intere.ted in any outlide
aCltivitiel. After John'l death in April of thil yeu Jim felt that
he wall unable to handle Jaok primarily due to his own work
'eh.dule. It was at that time that he was t.hen plaood in the

pegqy Mackey, has been handling all of. Jaok's finanoel. Prior to

money.
Jack does not have any children.
Jim indioated that leisure aotivities for Jack Ilre very
limited. He explained that Jack enjoYII going for walks and enjoy.
going to the mall in order to just watch people. He explained that
Jaok i. Booiable and enjoys talking to people IlS well. Jaok does
not bolong to any clubB or orgllni~ation8. He i.B not affiliated
with any speoifio church at thh time. At one time he did,
however, attend the Church of the Brethren in llunt.dal& with hill
parenti.

developed for Jack moet reoently. He did note, however, that he
felt that Jack wall not eating all much as he had been in the paet.

only a couple of hourll of Sleep per niqht. He aloo feele that Jack
has been having probleme with 110mB Illeep deprivation over the palt
couple of monthe since their brother'lI death in April.
Jim indicated that he Willi uncertain /Ill to llpecific
medications that Jack had been taking prior to hie admiesion to
thh psychiatric hospital. It Willi noted according to the admiuion
Iheet that Jack wall on the pr8lloription medications Dillb.1.nese,
~antac, Cardura, Capoten, and Doxepin. It wae also noted on Jack'l
admi8sion aheet that he waD taking the non prolloription medioation
Be alpirin approximately once a day. Jim indicated that he i8 not
aware of any pllst or pre lent hilltory of street Ilubatllnce for hil
brother Jack and, he wall unaware of any alcoholic intake that hill
brother may have consum~d. He r8l~ted that Jack doel not amoke
oigarettos.
Jim wae unaware of any suicidal thought II , plans, or
attempt. that Jack may have had. He explained that Jack never
indicated any suicidal thoughts to him.
Medically and surgically Jaok has been hoepitalized
only on one occasion. Jim indicated that approximately ~ yearl ago
JacK wae hOlpitali~ed for open heart surqery, a bYP~81l . Jack aleo
has a history of alight high blood prellllure. Jim indicated that
Jack'8 primary care phyeioian 1e Dr. Houff in Carliule. He 88~.

BACKGROUND INFORMATIONs
Jack Allp~ugh wae born at the f~mily home in Huntsdale,
J?A. He wae raised in Huntedale cmd attended school through to
approximately the 4th qrade. Jim indicated that Jack never really
learned to read cr write and at thil time oan only write hie own
name. As mentioned previouelY due to complication at birth. Jaok
hall mild brain damage blllcauso of lack of OXigen at birth. He wae
railled in a very Ihelt.red environment.by h II parente until their
death in 11170 at which time hie oldsr brother John took over
relponeibilities in caring for Jaok.
Jaok ie'presentlY unemployed, however, he had been
workinq at an MH/MR workshop in Mechcmicl'burg for a puriod of
apprcximatdy 10 yellX'8 at: one time. Jim explained that Jack
stopped workinq approximately 5 to 6 years ago and has been
unemployed since then.
Jack'e parents were Claire and Thomas Allpaugh. They

problems. He was receiving dieability from the U.S. Servicel Ili
well as at one time Wll8 employed by the Pennsylvania rillh
Commi8lion. Jim indicated that hiD parentll have been married
approximately 50 years at the time of thair death. He al80
explained that they had a very 010"8 relationllhip with Jaok and he
indioated th~t he felt there wall no hill tory of ohild abule.
Jack has two remaining s1blinga. As noted previoully
hie oldest brothel' John pas lied away on 4/23/94 at the ftge of 71 due
tc heart probleme. Hill dDter, June Alspauqh is preuntly 66 yearll
of age. She ill retired from the Crystal Company in Carl.l.ele and
preaently rea!dea in Carlisle. Jillck' II brcthsr Jim ill 57 rean of
age. He ourrently is employed at the Malland Xndultry n their
maintenance department and also rellides in carlisle. Jim indicated
that he feels that they continuo to be a very olose family and that
he and June have continued to hove regular visitation with Jaok.
When visiteo.tion is unavailable, Jim indioated that they continued
to remain in regular telephone contaot: with Jaok. Jim has
8xprened a very strong concern for Jack's future and hall indioated
that n.ith8~or his slster June ~r. able to p~ovide the n80eslary
oare that Jack requires. Beoause of thie they feel that either
another personal care facility will be appropriate for Jaok or the
p08Dibility of a plaoemsnt at the Cumberland County Nursing Homo
will be more appropriate.
Jim indioated that he had no reoall of a psyohiatrio
hi,tory prevalent in their family of origin nor wall he aware of any
drug or aloohol related dependenoiee.

at this Community Mental' Health Center on 7/26/94. lie ill under the
peyohiatdc lIerviae of Dr. Stookton who has provillionally di&gnoeed

This is Jaok's second psyohiatrio hospitalization with
his first beiny at the Carlisle Hospital approximately 2 months
ago. Sinoo his die charge from the Carlisle Hospital Jaok haD been
residing at a per80nal care home facility in Boiling Springs.
It appears that here is one primtu:y preoipitll,;or
leading to Jack'lI depression and need for lnpatient pllyohiatrio
treatment at this time. Jack's brothsr Jim explainod that Jaok is
basically mentally retarded and therefore has required supervision
throughout his entire life. After the death of their parent's in
lP70 Jaok then went to reside with his brothers John and Jim. ~hil
arrangement had been workinq quite well until the death of John in
April of 19P4. Bince then Jack has beoome deprellsod and it has

1) Your Petitioner is Robert L. O'Brien, Esquire, Solicitor for
the Cumberland/Perry Mental Health/Mental Retardation Office.
2) Respondent is Jack Alspaugh, an incapacitated person, residing
at Cumbarland County Nursing Home, Carlisle, PA. Respondent is an adult
individual being presently 6l years of age with a birth date of March
15, 1933. Attached hereto, marked as Exhibit "A", and incorporated
herein by reference is a social summary and hospital records in
reference to his current situation.
3) Petitioner requests that the Court appoint Robert Goril, C/O
Cumberland/Perry County MH/MR Office, Cumberland County Courthouse, 1
Courthouse Square, carlisle, Pennsylvania, as guardian for the limited
purpose of executing certain forms and waivers that are required to
insure the continuation and availability of care and treatment for
Respondent at the Cumberland County Nursing 1I0me and any other facility
for his complete physical and mental needs. Mr. Goril has no interest
adverse to Mr. Alspaugh.
4) Mr. Alspaugh receives residential services at the nursing home
and is a client for MH/MR related services through the County.
WHEREFORE, Petitioner, Robert L. O'Brien, respectfully requests
that the Court order and direct that the Register of Wills issue a
citation directing that Respondent, Jack Alspaugh, be brought to Court

money.
Jack does not have any ohildren.
Jim indioated that leisure aotivities for Jaok are very
limited. HIl explained that Jack enjoys gain; for walks and enjoys
;oing to the mall in crder tQ jU8t watch people. He explained that
Jack ill sociable and enjoys talking to people as well. Jack does
not belong to any clubB or organizations. He is not affiliated
with any speoific church at thb time. At one time he did,
howelvlr, attend the Churoh Qf the Br~thren in Hunt.dale with hil
parents.
Peer relationehips for Jack are also very limited.
At this time his primary relationships are with hili brother Jim and
his ai.ter June.

BACKGROUND INrORMA~IONl
JaCK Allpaugh was born at the family home in Huntsdale,
PA, He was rdsed in Huntlldale and attended school through to
approximatelY the 4th grado. Jim indicatad that Jack never really
learne~ to read or write and at this time can enly write hie own
name. AI mentioned previously due to complication at birth. Jack
ha. mild brain dama~e because of laoK of oxygen at birth. He wall
railed in a very Iheltered environment.by hill parente until their
death in 11170 at wnioh til11e his older brother John took over
r.lpon8ibilitios in car.ing for Jack.
Jack ill 'presently unemployed, however, he had been
workinq at an MH/MR workshop in Mecllaniosl:lurg for a period of
approximately 10 yeara cSt OM time. Jim explained tllat Jack
stopped workinlil approximately 5 to 6 yeara aqo and haB been
unemployed since then.
Jack'. parents were Claire and Thomal Alspaugh. Thoy

are both deceased at this time. Hie mother passed away in 1970 at
the age ot 69 due to heart problems. She had been employed at one
time au an LPN at the Car11lle Barricks. Jaok' I father Thoma.
paUld away also in 15170 at the age of 75, allto due to heart
problems. He was receiving disability trom the U.S. Service. as
well au at one time was employed by the Pennsylvania rillh
Commi8ll,ion. Jim indicated that hiB parente haveb..n muriGd
approximately 50 yearll at the time of their death. He aleo
explained that they had a very olos. relationship with JaoK and he
indioated that he felt there was no history of child abuse.
Jack has two remaining llibling8. As noted previoully
hb oldest brother John pused away on 4/23/94 at the age of 71 dl1.
to heart problems. Hill si.ter, June Alspaugh is presently 68 years
ot age. She is retired trom the Crystal Company in Carlisle and
pre.ently resides in Carlisle. Jack's brother Jim io 57 year I of
age. He currently is employed at the Ma.lanct Xndultry in their
maintenanoe department and also resides in CarliSle. Jim indicated
that he feels that they oontinue to be a very cloee family and that
he and June have continued to have regular visitation with Jack.
When visitation is unava.l.lable, Jim indioated that they oontinued
to remain in regular telephone oontact with Jack. Jim hll8
expressed a very strong OOnoern for Jack'e future and hae indicated
that n.ithe~or his sister June are able to prOVide the neoe..ery
care that Jaok requirei. BeceuQe of this they feel that either
another personal care facility will be appropriate for Jaok or the
possibility of a placement at thti Cumberland County Nursing Home
will be more appropriate.
Jim indioated that he had no reoall of a psychiatrio
hi.tory prevalent in their tamily of origin nor was he aware of any
drug or alcohol related dependenoies.

61-year-Old Jaok E. Alspaugh wall voluntarily hospitalized
at this Community Mental' Health Center on 7/26/94. He io under the
psychiatric service ot Or. Stockton who haa provisionally diaqnosed
hiIn with:

AXIS II - Mild mental retardation.
This is Jack's seoond psychiatric hOlpitalization with
hil fir.t being at tho Carlisle Hoepital approximately 2 month..
ago. Since his diSCharge from the Carlisle Hospital Jaok hat been
reiidinq at a personal oare home faoility in Boiling Springe.
It appeare that here is one primary precipitator
leading to Jack's depression and need tor inpatient psychiatric
treatment at this time. JaoK's brother Jim expJ,ained that .jaok ill
basically mentally retarded and therefore hat required supervision
throughout his entire life. Aftar the death of their parent's in
lP70 Jack then went tc reside with his brothers John and Jim. Thi.
arrangement had been working quite well until the death of John in
April ct 1994. Sinoe then Jaok hae become depreesed and it haa
