9. I'laintiffbilled Defendant lItotal lImount offive thousand four hundred thirty-six dollars and
sixty eents ($5,436.60) for the work he performed at Defendant's farm. Copies of billing
statements dated Oetober 3, 1991, January 28, 1992, and January 18, 1993 are attaehed
hereto, ineorporated herein by referenee and marked as Exhibits "B", "C", and "D"
respectivley.
10. On or about April 15, 1992 and August 1992, Dcfcndant made payments of one thousand
{$ I ,000.00) dollars and five hundred ($500.00) dollars respectively toward the outstanding
account balance.
1 1. Despite repeated demands by Plaintiff, Defendant failed and refused to make any further
payments to Plaintiff.
12. Defendant's refusal to pay Plaintiff the total amount due for labor performed and material
fumished is dilatory, obdurate and vexatious as well as arbitrary, vexatious and in bad faith
under 42 Pa. C. S. A. Section 2503(7) and (9) thereby entitling Plaintiff to payment of
reasonable attorney's fees.
13. The total unpaid balanec for all labor performed and material furnished by Plaintiff at
Defendant's farm is three thousand nine hundred thirty-six dollars and sixty eents ($3,936.60).
14. The amount in eontroversy is less than twcnty-five thousand ($25,OOO.00) dollars and is
subject to compulsory arbitration under Cumberland County Rulc of Court 130 I-I.
WHEREFORE, Plaintiff prays your Honorable Court, enter judgment in favor of the Plaintiff
and against the Defendant in the amount ofthrel: thousand nine hundred thirty-six dollars and sixty
ccnts ($3,936.60) together with interest, reasonable attorney's fees, costs and other reliefas the Court
may deem appropriate.
