AND NOW comes the above-named Plaintiff, by its attorney, Samuel L. Andes, and makes the

The Plaintiff is Alex R. Szetes, Inc., a Pennsylvania Business Corporation with its principal
offices at 5 I 10 Lancaster Street in Harrisburg, Dauphin County, Pennsylvania.

The Defendant herein is Thomas L. Harford, an adult individual who resides at I 260 York

11 Road, Mechanicsburg. Cumberland County, Pennsylvania.

Plaintiff is engaged in the business of construe lion and the repair and restoration offire and
other casualty losses to structures, and has been involved in that busincss at all time relevant to this action.
4.
The Defendant is the owner of real estate at 18 E. McClure Street in New Bloomfield,
Pennsylvania. Some time prior to February of 1996, Defendant's property was extensively damaged by fire.

In February of 1996, Plaintiff and Defendant entered into an oral agreement whereby Plaintiff

II agrecd to undertake and complete rcpair work on Defendant's property to repair the damage caused to it by

the fire loss, for which Defendant agreed to pay Plaintiff the sum of$49,267.73.

I I. After applying all payments and credits to which Defendant is due, Defendant still owes
Plaintiff, for the work done by Plaintiff on Defendant's property, the sum of$17,483.35. Defendant has
owed Plaintiff that sum since the end of July 1996, when Plaintiff had substantially completed its work on
the project.
12. Despite repeated demands by Plaintiff, Defendant has failed and refused to pay the sums due
under the agreements between the parties.
WHEREFORE, Plaintiff demands judgment against Defendant in the amount of$17,483.35, plus
interest from and after 31 July 1996, plus cost of suit.

following Complaint in this mallcr:
1. Thc Plaintiff is Alcx R. Szelcs, Inc., a Pcnnsylvania llusiness Corporation with its principal
offices at 5110 Lancaslcr Strcct in Harrisburg, Dauphin County, Pcnnsylvania.

othcr casualty losscs to structurcs, and has bccn involvcd in that busincss at alltimc relevant to this action.
4. Thc Dcfcndant is thc owncr of rcal estate at 18 E. McClure Strcet in Ncw 1lI00mficld,
Pcnnsylvania. Somc time prior to Fcbruary of 1996, Dcfcndant's propcrty was extensively damagcd by fire.
5. In Fcbruary of 1996, Plaintil1' and Dcfcndant cntcrcd into an oral agrccmcnt whercby Plaintiff
I agrccd to undcrtakc and complctc repair work on Delcndunt's property 10 repair thc damagc causcd to it by
thc fire loss, for which Dcfcndant agrccd to pay Plaintifl'the sum of$49,267. 73.

During lhe course or Plaintil1's work upon Dcrcndant's property, Plaintilrand Dcrcndant
would undertake and complete that additional rcpair work and that Delendant would pay Plaintil1'thc
additional sum of $11,934.11 for that additional rcpair work.
7. In April or 1996 Derendant requcstcd Plainliff to rcplace 8 windows al his propcrty and the

'I parties agrecd that Plainliff would rcmovc 8 windows and rcplace thcm with 8 new windows and that
I Defendant would pay Plaintiff the additional sum or$I,532.66 ror that work. Attached hcrcto and marked
as Exhibil A is a copy of a Change Ordcr lor that additional work signed by thc parties.

Thereafter, Plaintiff and Dercndanl discovered additional damage to Defendant's propcrty.

Plaintiff and Derendanl. Plaintill' complctcd all of its work in a good and workmanlike rashioll and on a
timely basis.
10. To date, Dercndant has paid Plaintilfthe total sum or $45,000.00 for the work done by
