AFFIDAVIT 011 FACIS
Steven Sparks, dba Sparks Press Repair, affiwlt herein, being first duly cautioned WId
sworn, docs depose and states the following to be true to the best of his information WId belief:
1. AffiWlt states that at all times rclevWlt herein, he has been engaged ill the business of
repairing printing presses, WId has been doing business as Sparks Press Repair with a principal
place of business located at 6541 Liberty Fairfield Rd.. Hamilton, Buller County, Ohio.
2. AffiWlt further states that on October 15, 1994, DcfendWlt contacted Plaintiff at
Plaintifrs principle place of business in Butler County, Ohio, requesting his services to provide
and install for four (4) Dahlgren units in DefendWlt's press in MechWlicsburg, PennsylvWlia.
Plaintiff further states that on October 15, 1994, Plaintiff WId DefendWlt entered into an oral
contract in Butler County, Ohio, pursuant to which Plaintiff became obligated to provide
aforstated services WId DefendWlt became obligated to compensate Plaintiff as agreed between
them for those services,
J. AffiWlt further states that he completed the work on the conlract timely on October
22, 1994.
4. AffiWlt further states that on October 22, 1994, he presented an invoice to DefendWlt
requesting payment for his services under the contract in the total amount of $7,646.17, AffiWlt
further states that a copy of the invoice is auached herelo as Exh. 1. Affiant further states that
Defendant has paid $5,325.29 on this invoice, and has failed and refused to pay Plaintiff the
remaining balance. Affiant further states that a copy of the check from DefendWlt is attached
hereto as Exh. 2.
5. AffiWlt further states thaI he filed a Complaint with this Court on June 25, 1996, for
money due under that contract WId for breach of contract, WId that DefendWlt was served by
certified mllil on June 28, 1996.
6. AffiWlt further states that DefendWlt did not file WI Wlswer or a responsive pleading
within the time set by law.
Further, AffiWlt sayeth naught.
