Defendant
CIVIL ACTION - LAW
JURY TRIAL DEMANDED
COMPLAINT
AND NOW, comes TOWNSHIP OF HAMPDEN, Plaintiff, by its
Attorneys, SNELBAKER, BRENNEMAN & SPARE, P.C., and avers the
following cause of action:
1. Plaintiff herein is TOWNSHIP OF HAMPDEN, a municipal
township of the First-Class, situate in Cumberland County,
Pennsylvania, having its principal office at 230 South Sporting
Hill Road, Mechanicsburg, PA 17055.
2. Defendant herein is DANIEL L. SHANK, also known as
DANIEL L. SHENK, an adult individual who resides at 2380 Lambs
Gap Road (Hampden Township), Enola, PA 17025.
3. Plaintiff is the local government for the community
which includes the premises of the Defendant, and, in such
capacity, has enacted various ordinances to regulate the use of
land within said community.
4. Defendant occupies the above mentioned premises (2380
Lambs Gap Road) and particularly a detached garage structure
("Garage").
5. At all times relevant hereto and as more particularly
specified hereinbelow, Defendant has conducted a commercial
enterprise at and around said Garage, to wit: a motor vehicle
repair and storage facility.
6. Defendant constructed said Garage during the year 1991
pursuant to a Building Permit required and issued by Plaintiff on
tha representation that said structure would be used for
residential purposes and as an accessory use to Defendant's
private dwelling on the same lot or premises.
7. On July 9, 1992 Plaintiff through its Codes Compliance
Officer notified Defendant in writing of neighborhood complaints
of alleged business activity at said premises and in and about
the Garage, to wit: the operation of a motor vehicle repair
shop. Further notices of the same nature were issued by
Plaintiff on August 4, 1992 and October 13, 1994. All of said
notices are attached hereto marked as Exhibits A, Band C
respectively.
B. Defendant disregarded the notices mentioned in paragraph
7.
9. On or about May 3, 1996, Plaintiff through its Code
Enforcement Officer and Assistant Zoning Officer, filed a
Complaint against Defendant in the office of the District Justice
having jurisdiction (District 09-3-04) for violation of Section
202.3 of Chapter 10 of the Hampden Township Code of Ordinances
alleging the storage of unlicensed and dilapidated motor
vehicles.
10. Subsequent to the service of the Complaint mentioned in
paragraph 9, Defendant removed the offending vehicles.
11. As the result of the apparent compliance mentioned in

paragraph 10, Plaintiff withdrew the Complaint and excused
Defendant from the violations alleged therein.
12. Beginning thereafter and continuing thereafter,
Defendant used his premises at the address aforesaid in the
following manner:
A. Placed and maintained storage of unlicensed
and dilapidated motor vehicles and vehicle parts and
debris; and
B. operated a motor vehicle inspection and repair
business in and about said Garage.
COUNT I
13. The averments contained in paragraphs 1 through 12
hereinabove are incorporated herein by reference thereto.
14. Defendant's conduct aforesaid constitutes a violation of
section 202.3 of Chapter 10 of the Code of Ordinances of the
Township of Hampden.
15. The penalty for such violation is a civil fine of up to
$300 per day for each day of violation pursuant to Section 208 of
the above cited Ordinance.
WHEREFORE, Plaintiff requests the Court to enter judgment
against Defendant for the sum of $300 per day for each day of
violation averred as aforesaid, together with the costs of this
action.

16. The averments contained in paragraphs 1 through 12
hereinabove are incorporated herein by reference thereto.

17. Defendant's premises is located within the Residentia1-
Country (R-C) zoning district as established by the Hampden
Township zoning Ordinance (Chapter 27 of the Code of ordinances
of the Township of Hampden).
18. Defendant's use of said premises as averred in paragraph
12 hereinabove is not permitted and, therefore, is prohibited and
in violation of the above referenced Zoning ordinance.
19. section 1613 of said Zoning Ordinance prohibits the
storage of the materials as averred in paragraph 12A above.
20. Part 6 (Section 601 et seq.) of said Zoning ordinance
prohibits the non-residential use as averred in paragraph 12B
above.
21. section 2111 of said Zoning Ordinance establishes a
civil fine of up to $500.00 per day for each day of violation of
said Zoning Ordinance.
WHEREFORE, Plaintiff requests the Court to enter judgment
against Defendant for the sum of $500.00 per day for each day of
violation averred as aforesaid, together with Plaintiff's
reasonable attorney's fees incurred by this enforcement acticn
and the costs hereof.

The Township has previously notified you roncerning the prohibitions on rommercial operations in the
home you own on Lamb's Gap Road. Reference is made to our rorrespondence to you dated July 9, 1992 and
August 4,1992. CaUs from roncemed neighbors have rontinued to rome into this office, we therefore wish to
notify you that aU rommercial activity at the residence referenced above must cease immediately or the Township
will take further legal action within thirty (30) days of your receipt of this letter.
Zoning Ordinance Part 6, Sections 602 and 603 list uses permitted in the Residential-Country zoning
district, the district in which this property is located. A ropy of these ordinance sections is enclosed for your
reference. No other use made be made of this property. Township personnel, including police, have observed
frequent nighttime use of your garage in a manner that strongly suggests that you are operating a business at
your property. Selling of automobile parts removed from wrecked vehicles or any other rommercial enterprise
may not occur from your property. Again, such activity must cease immediately. The Township Zoning
Ordinance provides for penalties of up to $500.00 a day for every day a violation has been determined to exist.
You have the right to appeal the determination made in this letter, in writing, to the Hampden Township Zoning
Hearing Board within thirty (30) days of your receipt of this letter.
