STIPULATION AGAINST LIENS
THIS AGREEMENT made this 26th day of March, 1997, by and
between Herb Weaver, hereinafter referred to as Contractor, and
Gary G. Schafer and virginia L. schafer, husband and wife,
hereinafter referred to as Owner, whereby the former undertook and
agreed to erected and construct a residential building on that
certain lot of ground situate in Southampton Township, Franklin
County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
contractor, for and in consideration of the sum of One ($1.00)
Dollar, in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained bv them
or any of them against the said buildings and the lot of ground
appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise,
for, towards, in, or about the erection and construction of the
said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and
maintain any mechanic's lien or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be independent covenant.

SCHEDULE "A"
ALL that certain lot of ground situate in Southampton
Township, Franklin County, Pennsylvania, being Lot No.5, Section
"J", of the Development known as Kaphoe Development Corporation,
more particularly bounded and described as follows:
BEGINNING at a point, at an iron pin on the eastern edge of
Pattison Drive, at common corner of Lot 4, Section "JII, South 61
degrees 44 minutes 64 seconds East, 124.00 feet to a concrete
monument; thence along Lot 6, Section ''In, South 28 degrees 15
minutes 06 seconds West, 105.08 feet to an iron pin on the northern
edge of Celeste Drive; thence along the northern edge of Celeste
Drive, by a curve to the right having a radius of 734.64, a chord
bearing of North 65 degrees 03 minutes 40 seconds East, an arc
distance of 85.19 feet to a point; thence continuing along the
northern edge of Celeste Drive, South 61 degrees 44 minutes 54
seconds East, 32.00 feet to a point; thence continuing along the
northern edge of Celeste Drive and turning onto the eastern edge of
Pattison Drive by a curve to the right having a radius of 8.00
feet, a chord bearing of North 16 degrees 44 minutes 54 seconds
West, an arc distance of 12.57 feet to a point on the eastern edge
of Pattison Drive; thence along the eastern edge of Pattison Drive,
North 28 degrees 15 minutes 06 seconds East, 102.00 feet to an iron
pin, the point and place of BEGINllING.
CONTAINING 13,597 square feet, more or less. BEING all of Lot
5, Section "J" in Kaphoe Development Corporation SUbdivision as
shown on SUbdivision plan recorded in Franklin County Deed Book
Volume 288 "F", Page 911.
BEING that same real estate that the Kaphoe Development
Corporation, by their deed intended to be recorded prior to the
recording of this mortgage in the Office of the Recorder of Deeds
in and for Franklin County, Pennsylvania, conveyed to Gary G.
Schafer and Virginia L. Schafer, husband and wife, Mortgagors
herein.
