attorney and filing in writing with the court your defense or
objections to the claims set forth against you. You are warned

judgment may be entered against you by the court without further
notice for any money claimed in the Complaint or for any other
claim or relief requested by the Plaintiff. You may lose money

3. Dcfcndant is a namcd mortgagor on a mortgagc cntcrcd into on Fcbruary 20,
I. Plaintiff. GEORGE M. COBB. is an adult individual currently residing at 14
East 7th Street, Wayncsboro, Pennsylvania.
2. Defendant, SOURCEONE MORTGAGE SERVICES CORPORATION. is a
Dclaware corporation, rcgistered to conduct business in the Commonwealth of
Pennsylvania wilh a Pennsylvania scrvice address of c/o c:r. Corporation System, 1635
Market Street, Philadelphia. Pennsylvania 19103,
1992 wilh Avslare Mortgage Corporation in the principal amount of SEVENTY-FIVE
THOUSAND ($75,000,00) DOLLARS. which mortgage is recorded in the Cumberland
County Recordcr of Dceds ollice in Mortgage Book 1050 Page 922, a copy of said
mortgage bcing attachcd hereto and incorporated herein by refercnce as Exhibit "A",
4. The aforesaid mortgage is an encumbrance on real estale owned by Plaintitrin
Cumbcrland County. Pcnnsylvania.
5, The aforcsaid mortgagc was assigncd to the within named Defendant by an
assignmcnt from Avstar Mortgage Corporation to the Defendant recorded March 3. 1992
in the Ofiice of the Recorder of Deeds in and for Cumberland County in Miscellaneous
Book 413 Page 160. which Assignment is attached hereto and incorporated herein by
reference as Exhibit "B",
6. Plaintil1' has paid in full outstanding principal. interest, costs and fees of any
nature relative to the aforesaid mortgage, which payment was made December 16, 1996,
confirmation of which was made by the Defendant to the PlaintilT by correspondence
dated December 20, 1996 which is attached hereto and incorporated herein by reference
as Exhibit "C",
7. Despite PlaintilT having made payment in full to Defendant on the aforesaid
mortgage, and despite repeated requests by Plaintitl' lor the Defendant to satisfy the
aforesaid mortgage, the Defendant has failed and refused to satisfy the mortgage even
though payment in full on the mortgage was made more than ninety (90) days ago,
8. PlaintilTherein was required to satisfy the aloresaid mortgage pursuant to terms
of a Separation and Property Settlement Agreement entered into between PlaintiO' and his
former wife, Debra K, Cobb,
9. Due to the failure and refusal of the Defendant to satisfy the aforesaid mortgage
in a timely f.1shion and as required by Pennsylvania law, the PlaintilT herein was found in
contempt for f.1iling to satisfy the aforesaid mortgage.
10. As a result of the contempt proceedings against the PlaintilTthat were initiated
by Plaintill's former wife, Debra K, Cobb, PlaintilT was ordered and directed to pay the
sum of NINE HUNDRED THIRTY-FOUR and 20/100 ($934.20) DOLLARS in
attorney's fees to his former wife's attorney for legal fees associated with the contempt
proceedings,
II. Due to Defendant's lailure and refusal to satisly the aforesaid mortgage in a
timely fashion, Plaintill' has incurred legal expenses relative to the contempt proceedings
initiated by his former wife and relative to the instant proceedings.
12. Pursuant to Pennsylvania law (21 Pa.C.S. Sections 681-682), Defendant has
failed to appropriately note the satisfaction of the aforesaid mortgage in the Cumberland
County Recorder of Deeds Office as required,
13, Plaintin'has incurred additional losses, attorney's fees and expenses associated
with the Delendant's failure and relusal to satisfy the mortgage as required by
Pennsylvania law and as repeatedly requested by Plaintin',
14, Plaintin: through counsel, corresponded with Defendant on February 6, 1997
and by certified mail on March 4, 1997 demanding that the aforementioned mortgage be
satisfied.
15. At the time of filing of the instant Complaint the aforesaid mortgage is still not
satisfied.
WHEREFORE, Plaintin' requests your Honorable Court to enter judgment against
Defendant in an amount sufficient to compensate Plaintifl'lor the damages alleged, and in
an amount requiring arbitration,
