And now comcs Countrywide Homc Loans, f/kla Countrywidc Funding Corp., by its
attorneys, O'Kecfe, Grenen & Birsic, P.C., filcs this Complain1 in Mortgagc Foreclosure as
follows:
1. The Plaintiff is Countrywidc Homc Loans, which has its principal placc of
business at 6400 Legacy Drive, PIano, Tcxas 75024.
2. The Defcndants, Darrcn M. Bcck and Jcnnic L. Lavnder, arc individuals whose
last known address is 4155 Kittatinny Drivc, Mcchanicsburg, Pennsylvania 17055.
3. On or abou1 Septcmbcr 6, 1995, Dcfendants cxecutcd a Notc in favor of
Sovereign Bank in thc original principal amoun1 of $85,020.00. A true and corrcct copy of said
Notc is markcd Exhibit "A", attachcd hcreto and made a part hcrcof.
4. On or about Septcmber 6, 1995, as sccurity for payment of thc aforcsaid Note,
Defendants madc, executcd and dclivcred to Sovercign Bank a Mortgagc in thc original principal
amoun1 of $85,020.00 on thc prcmiscs hcrcinafter dcscribed, with said Mortgagc bcing recordcd
in thc Officc of the Rccordcr of Dccds of Cumbcrland County on October 4, 1995, in Mortgage
Book Volumc 1285, Pagc 556. A truc lInd correct copy of said Mortgagc containing a description
ofthc prcmiscs subject to said Mortgagc is markcd Exhibit "B",lIttachcd hcrcto and madc a part

5. On or about May 6, 1995, Sovercign Bank assigncd thc aforcsaid Mortgagc and
Notc to PlaintilTpursuant to thc tcnns of a ccrtain Assignmcn1 ofMortgagc, recorded in thc
officc ofthc Recordcr ofDced ofCumbcrland County a1 Mortgagc Book Volumc 519, Page 478.
A true and correct copy of said Assignmcnt is markcd Exhibit "C", attachcd hcrcot a madc a part
hereof.
6. Defendanls arc thc rccord and rcal owners of the aforesaid mortgagcd premises.
7. Dcfendants arc in dcfault under 1hc tenns of the aforcsaid Mortgagc and Notc for,
intcr alia, failurc to pay thc monthly installmcnts of principal and intercst when due.
8. Plaintiff was not requircd to scnd Defendants writtcn notice pursuant to 35 P.S.
~1680.403C (Homcowner's Emcrgency Mortgage Assistancc Act of 1983 - Act 91 of 1983) prior
to the commcncement of this ac1ion for thc reason that thc aforesaid Mortgagc is insured by thc
Federal Housing Adminislration under Titlc II ofthc National Housing Act (l2U.S.C.
~~1707-1715z-18) [35 P.S. ~1680.401C(a) (3)].
9. On or about Octobcr 17,1996, Dcfcndants wcrc mailcd Noticcs oflntcntion to
