". ~ . 12. To the date of the filing of this Complaint, Murlatt has made no payments on 8. Doll gave Murlatt a personal check in the amount of $500 on October 21. 1995. 9. Murlatt cashed this check and received the benefit of the $500. 10. A true and correct copy of the front and back of check number 2403 on Plaintiff's account at PNC Bank is attached hereto as Exhibit "B" and made a part of this Complaint. II. Doll agreed to loan Murlatt this money at no interest, but they agreed that it was to be repaid as soon as Murlatt was financially able to do so. either loan. 13. Murlatt has refused to repay any of the money loaned to him by Doll. 14. The amount in dispute requires compulsory arbitration under the local rules of court. WHEREFORE, Plaintiff requests this Honorable Court to enter judgment in favor of Plaintiff and against Defendant in the amount of $1,550.00, plus post-judgment interest at the statutory rate from March 14, 1997, the date on which the District Justice entered judgment in favor of Doll and against Murlatt, together with all costs of suit. A third person who lived with Doll had a videotape collection consisting of 586 videotapes. 17. Said third person had a detailed inventory of the aforonaid 586 item videotape collection. 18. Said third person gave his videotape collection to Mr. f !' Murlatt. 19. Prior to said third person giving hiB videotape collection to Mr. Murlatt the third person removed approximately 50 videotapeD from hiB collection. 20. The entire videotape collection conBiBted in part of movieD which were purchased from video Btores (Btore bouqht videotape") or movies that were taped off of the televiBion. 21. Of the approximately 50 tapeB that were removed from the collection by the third person, Murlatt iB unBure how many of thoBe videos were atore bought and how many of thoBe 50 were moviell recorded off of the television. 22. The total number of tapeB that were given to Murlatt by the third person was approximately 536 (586 . 50). 23. Doll gave away the videotape collection consiBtinq of the 536 videotapes (approximately) to other individualll bOBidos the aforeBaid third person. 24. Of the approximately 536 aforosaid videotapeB, Murlatt was able to recover posseBBion of 232 videotapeB leaving approximately 304 videotapes which are missing. 25. At the time the third person gave the videotape collection to Murlatt he also gave Murlatt the detailed inventory of the tapes in the collection. 26. In considering that Murlatt has 232 video tapes in his possession, using the detailed inventory provided by the third person, Murlatt is able to ascertain that out of the initial inventory of approximately 586 videotapes, missing are 197 store bought videotapes and 157 videotapes of movies recorded from television. 27. Murlatt does not know how many of the approximately 50 tapes that the third person removed from the collection were store bought tapes and how many were videotapes of movies taken off television. 28. Murlatt can ascertain that the smallest number of store bought videotapes that are missing are at least 147 (197-50) and at most 197. 29. Likewise, Murlatt is able to ascertain that the highest number of videotapes missing which are movies recorded off the television is 157 and the least number of videotapes which are missing is 107 (157- 50) 30. Murlatt has valued the 197 store bought videotapes at $4,083.69 for an average price of $20.73 per video tape ($4,083.69 divided by 197) 31. Accordingly, Murlatt estimates that the value of the missing store bought videotapes not returned to him by Doll is $3,047.31 (147 x $20.73). To the contrary, Murial! never took possession of the tapes by removing them, as requested, from Doll's home. New Matter 32. Plaintiff DENIES that a blank videotape costs $2.30. To the contrary. tapes can be purchased at far less cost. In any event, the cost of a blank videotape is irrelevant. The value of the entire collection in January, 1995 is known to be $500.00, based upon the appraisal. 33. Plaintiff is without knowledge or information sufficient to form a belief as to the number of "missing" tapes recorded off the television. Therefore, the allegations of this paragraph are DENIED and strict proof is required. 34. It is DENIED that the value of 157 blank, previously-used video tapes is $361. To the contrary, the value of the entire collection was no more than $500 in January. 1995. 35. Plaintiff and Richard Corriveau shared a home at 270 Reeser Road, Camp Hill, Pennsylvania for 40 years. 36. Upon separation, an appraisal of their jointly-acquired assets was conducted by Auctioneer Chuck E. Bricker on January 6, 1995, including a "large tape collection." A true and correct copy of the appraisal is attached hereto as Exhibit "C" and incorporated herein. 37. The value of the tapes given to Murial! by Corriveau was less than $500. because Corriveau took a number of the tapes with him. 38. After repeated requests from Doll, Murial! failed to remove from Doll's home at 270 Reeser Road the videotapes which had been given to Murial! by Corriveau. 39. After more than six months of storing the tapes at his home, Plaintiff Doll assumed that Murial! no longer wanted the tapes. 40. Rather than throw out the tapes, Plaintiff Doll allowed other mutual friends of Richard Corriveau and himself to take whatever tapes they wished. 41. JR. 35. Admitted. 36. Admitted in part and denied in part. It is admitted that the auctioneer appraised what he called a "large tape collection". It is denied that the "large tape collection" was anything other than a small part of the total collection which is the subject matter of the Counterclaim filed by Donald E. Murlatt, Sr. 37. Denied. The value of the tapes given by Corriveau to Murlatt is the amount set forth in the Counterclaim filed by Murlatt, plus the value of the videotapes returned by Randy Dohl to Murlatt as set forth in paragraph 40 herein. 38. Denied. Doll never requested that Murlatt remove the video tapes. 39. After reasonable investigation, Murlatt is without knowledge or information sufficient to form a belief as to what Doll assumed. The same is therefore denied. By way of further response, the videotapes were stored at Doll's residence from January 17, 1997 until July 5, 1995. 40. Denied. Doll was angry with Murlatt because Murlatt and his family would not have a special picnic for Doll on July 4, 1995 at Murlatt's residence. Because of his anger, Doll then gave the entire video collection to an individual named Randy Dohl (no relation to Elmer H. Doll, Jr.) and told Randy Dohl that the tapes belonged to Elmer H. Doll, Jr. Because of these misrepresentations Randy Dohl believed that Elmer H. Doll, Jr. had the authority to give to Randy Dohl the videotape collection. Randy Dohl then gave to his nephew (Brian) a portion of the videotapes. 41. Denied. The videotape collection was in Doll's residence with Doll's consent. Doll never asked Murlatt to remove the collection. By way of fur.ther response, Murlatt saw Doll on several occasions between January 17, 1995 and July 5, 1995 and he never asked Murlatt to remove the videotapes. Often during that time period, Murlatt would even take certain tapes from the collection, remove them, watch them, and return them to the shelves where they were being stored in Doll's residence. 42. Denied. On July 5, 1995 and numerous times thereafter, Murlatt made demands upon Doll and others to return to Mur1att the relevant videotapes. 43. Denied. Doll did have a legal duty to store the videotape collection. Furthermore, Murlatt gave Doll consideration for this duty in that Murlatt was constantly doing hDusehold chores and outdoor work for Doll at Doll's residence. 44. Denied.
