KILDARE, CIVIL ACTION - LAW Defendants JURY TRIAL DEMANDED COMPLAINT AND NOW, come the Plaintiffs, Audrey and Richard Jury, by and through their attorneys, HANDLER & WIENER, and makes the within complaint against the Defendant, Harrison C, Ki1dare, and, in support thereof, aver as follows: 1. Plaintiff, Audrey Jury, is an adult individual currently residing at 41 Mountain Street, Mount Holly Springs, Cumberland County, Pennsylvania, 2. Plaintiff, Richard Jury, is an adult individual and the husband of Plaintiff, Audrey Jury, and currently resides at 41 Mountain Street, Mount Holly Springs, Cumberland County, Pennsylvania. 3. Defendant, Harrison G. Ki1dare, is an adult individual currently residing at 325 Wesley Drive, Apartment 227, Mechanicsburg, Cumberland County, Pennsylvania. 4. At all times material hereto, Plaintiff, Audrey Jury, was operating a 1989 Hyundai Excel, Pennsylvania Registration Number 2S8184. 5. At all times material hereto, Defendant, Harrison G. Kildare, was operating a 1993 Mercedes Benz 300, Pennsylvania Registration Number X50807. 6. On May 9, 1995, Plaintiff, Audrey Jury, was traveling southbound on Williams Grove Road, when she was lawfully proceeding through the intersection of Williams Grove Road and Lisburn Road. 7. On or about the same time, Defendant, Harrison G. Kildare, was traveling eastbound on Lisburn Road approaching the intersection of Lisburn Road and Williams Grove Road when he suddenly and without warning, failed to stop at the posted stop sign on Lisburn Road and violently struck the side of Plaintiff's vehicle, which was lawfully proceeding through the intersection. 8. As a direct and proximate result of the negligence of the Defendant, Harrison G, Ki1dare, Plaintiff, Audrey Jury, sustained extensive and serious personal injuries requiring emergency and ongoing medical treatment and psychological counseling. 9. Before the date of the above-mentioned collision, Allstate Insurance Company issued a policy of motor vehicle insurance to Plaintiff, Audrey Jury, who elected the Full Tort Option. Said policy was in effect on May 9, 1995. COUNT I Audrev Jurv v. Harrison G. Kildare 10. Paragraphs 1-9 are incorporated herein as if set forth at length, 11. The occurrence of the aforesaid collision and the resultant injuries to Plaintiff, Audrey Jury, were caused directly and proximately by the negligence of the Defendant, Harrison G, Ki1dare, more specifically as set forth below: (a) In failing to keep a reasonable lookout for vehicles lawfully proceeding through the intersection of Williams Grove Road and Lisburn Road; (b) In failing to be reasonably vigilant to observe Plaintiff's vehicle; (c) In failing to operate the vehicle under proper and adequate control so that he could avoid striking Plaintiff's vehicle; (d) In failing to operate the vehicle in such a manner so that he could apply his brakes to avoid striking Plaintiff's vehicle; (e) In failing to operate the vehicle at a speed, and under such control, so as to be able to stop within the assured clear distance, in violation of 7S Pa,C.S.A, fi 3361; (f) In failing to obey the stop sign at the intersection of Williams Grove Road and Lisburn Road, in violation of 75 Pa.C,S.A. fi 3323(b); (g) In failing to properly and adequately observe the traffic conditions then and there existing; and (h) In failing to exercise the duty of care as required by 75 Pa. C,S,A. s 3321. 12, As a direct and proximate result of the negligence of the Defendant, Harrison G, Kildare, the Plaintiff, Audrey Jury, sustained severe injuries including, but not limited to, head trauma, lacerations of the scalp, and post-traumatic stress disorder, all of which required emergency treatment, ongoing treatment, and psychological counseling. 13, As a result of the negligence of the Defendant, the Plaintiff, Audrey Jury, has been, and will in the future, be hindered from performing the duties required by her usual ~ . , , occupation and from attending to her daily duties and chores, to her great loss, humiliation, and embarrassment. 14. As a result of the Defendant's negligence, the Plaintiff has suffered great physical pain, discomfort, and mental anguish, and will continue to endure the same for an indefinite period of time in the future, to her great physical, emotional, and financial detriment and loss. 15. As a result of the negligence of the Defendant, the Plaintiff has been compelled, in order to effect a cure for aforesaid injuries, to expend large sums of money for medicine and medical attention. Plaintiff continues to receive treatment and incur expenses of said injuries, and will most likely continue to do so in the future, to her great detriment and loss. 16. As a result of the negligence of the Defendant, the Plaintiff has suffered a loss of life's pleasures and she will continue to suffer the same in the future, to her great detriment and loss. 17.
