COMPLAINT
1.) Plaintiff is Irene C. Cekovichr Executrix of the Last
will and Testament of Jean A. Cekovich, who died september 4,
1996, a resident of Silver Spring Township, Cumberland county,
Pennsylvania. Letters Testamentary were granted to her by the
Register of wills of Cumberland county on September 16, 1996.
2.) Defendants are husband and wife; husband's last known
address is R. R. #1, Box 838, Shermansdale, Perry County,
Pennsylvania and the wife's last known address is six Links
Mobile Home Park, R. D. 5, Salem Church Road, Silver Spring
Township, Cumberland CountYr Pennsylvania.
3.) During her lifetime Jean A. Cekovich and Joseph
Cekovich, her husband, owned a residential dwelling known and
numbered as 5 Millers Gap Road, silver spring Township,
Cumberland County. Joseph C. Cekovich died July 26, 1995.
4.) On September 18, 1990, Jean A. Cekovlch and Joseph
Cekovich leased said real estate to defendants, Joseph J.
Hrubochak and Valerie Hrubochak, by written lease attached hereto
as Exhibit A.
5.) Defendants occupied said premises from September, 1990,

until March 8, 1996, when they vacated and delivered possession
to plaintiff.
6.) Defendants damaged the house while they occupied it and
delivered possession on March 1, 1996, in a damaged condition
which included:
Hallwav - Damaged drywall by making holes therein.
East Bedroom - Destroyed ceiling fan, destroyed
louvered bifold closet door, destroyed bedroom door
frame, the door is missing and made holes in all
four walls.
Northeast Bedroom - Destroyed ceiling fan.
Northwest Bedroom - Destroyed ceiling fan, destroyed
louvered bifold closet door, destroyed the bedroom
door frame, the door is missing, and made holes in all
four walls.
~ _ Destroyed window sash and sill, broke
window, destroyed tile in shower stall, made holes in
walls and ceilingr damaged tub and shower.
Livina Room - Damages walls and corner bead.
Kitchen - Damaged dishwasherr stove, oven,
disconnected plumbing which allowed water to damage
floor under the sink.
Garaae Door Openers - Two are missing.
Sun Room - Destroyed paneling, destroyed storm
door.
Window Screens - Twisted, destroyed or damaged
throughout house.
7.) It will be necessary to repair all said damages and
paint the interior of the house to restore it to the condition
which existed before the damage was done.
8.) The damage done to the residence was intentional.
9.) The residence is uninhabitable in its present'

condition.
10.) Plaintiff has obtained an estimate to repair the
walls, screens, paneling, plumbing and replace ceiling fans,
stove, dishwasher, doors, door frames in the total amount of
$6,297.71, which includes labor and material.
11.) Defendant has prejudiced plaintiff in her ability to
settle the estate, including filing the Pennsylvania inheritance
tax return by delaying the appraisal and sale of the real estate.
mIBRBFORE, plaintiff demands judgment in the amount of
$6r297.71 with interest from March 8, 1997.

not to doubt its accuracy.

5. Denied. Valerle Hrubochak vacated the premises and delivered possession
to Plaintiff on March 8, 1997. Joseph Hrubochak vacated the premises in February
1997.
6. Denied. Possession was delivered on March 8, 1997. While Defendant
acknowledges that some damages were present, the extent and nature of the dAmnges
alleged here is denied and strict proof of the damage alleged is demanded. It is further
alleged that with respect to the window screen damages, these damages occurred by
actB of vandwB or attempted intruderB who appeared at the reBidence at a time that
the DefendnntB were out of town and upon their return, the DefendantB notified the
ownerB of the reBidence regarding the nature and extent of damageB to the BcreenB.
7. Admitted that Bome repair will be needed. Because the DefendantB arc
not liable for ordinary wear and tear and because the premiBeB were occupied for 6 1/2
yearB before being vacated, it iB denied that they Bhould be responBible for painting or
Bimilar repair or work performed which would be expected to be performed with
ordinary wear and tear.
8. Denied, A number of the damages occurred not through the actB of the
DefendantB themBelveB but throu~h their teenage child,

10. DefendantB are neither able to admit nor deny this allegation without
being provided the eBtimate for repair. Denied that the extent of repair involves this
amount of money,
11. While Defendants are unable to comment upon the alleged prejudicial
effect, they deny any responsibility for such prejudice. Until service of the Complaint
med in this action, the Defendants were unaware of the extent or nature of damages
claimed, even though they indicated an acknowledgement that some damages would
need to be paid for, Instead of receiving a notification of the extent of damages, 118
