8, WILMA LORRAINE PETERS Is seventy (70) years of age,
9. WILMA LORRAINE PETERS was a graduate of Lemoyne (Pa.) High School.
Alter graduation she obtained employment with the Pennsylvania Railroad Company, She
later obtained employment at Davenport's Restaurant In Harrisburg. For some years she
was a housewife and lator returned to employment as a wallress at Alex Stewart's
snackbar. She later became employed as a domestlo, doing cleaning laundering and the
like. She subsequently obtained employment at Harrisburg Area Community College as a
oustodlan from 1973 until 1989 at which time she retired.
10. WILMA LORRAINE PETERS has been reSiding at 100 Ashford Drive, In the
Township 01 East Pennsboro, (Enola), Cumberland County, Commonwealth of
PennsylvRnla, 17026.2331 wllh her daughter, KIM, one of tho petitioners herein,
since 1985.
11. WILMA LORRAINE PETERS Is ourrently In the Leader Nursing Home, 1700
Market Street, Borough of Camp HIli, Cumberland County, Pennsylvania, 17011.
12. WILMA LORRAINE PETERS Is out 01 touch wllh rea Illy and unable to
communloate or to perceive her surroundings. She suffers Irom permanent and
extensive brain damage as a resull of a massive CVA (cerebrovasoular accident) more
commonly known as a "stroke", (See letter and alfldavll of her attending physlolan, DR.
WENDY SCHAENEN, att~ched hereto and Incorporated herein).
13. DR, WENDY SCHAENEN Is associated with COW LEV ASSOCIATES, 01 Plaza 21,
Camp Hili, Pennsylvania.
14. According to the prognosis offered by DR. SCHAENEN, WILMA LORRAINE
PETERS Is not expected to recover nor Is It likely she will ever be able to leave the
Leader Nursing Home for any place but a similar Institution. Therefore, the obJeot 01
this petition Is the least restrictive allernatlve available to proteot her person and her
estate,
15, WILMA LORRAINE PETERS Is totally unable to manage her own property, Is
unable to pay her own bills or take oare of other routine necessities and oertalnly lacks
any oapaolly to make or communicate responsible deolslons concerning her person or her
estate.
16. Until the onset 01 WILMA LORRAINE PETERS's current predloament, she
managed all 01 her own affairs,
17. The names and addresses of the sole next.ol.kln of the alleged Inoapaoltated
person who would be entitled to share In her estate should she now die Intestate are the
petitioners herein, to wit:

18. All 01 the said next-ol.kln, being the plltltloners herein, are aware 01 this
petition and In favor 01 It.
19. The names and addresses of the proposed permanent guardians are the same
as set lorth In paragraph 17 A.) and B.) above.
20. It Is proposed that tho said prospective guardians of the person and estate of
WILMA LORRAINE PETERS be permitted, authorized, and empowered to act In such
oapaclty eliher Jointly or Individually,
21. Petitioners, through their attorney, Charles E. Shields, III, and upon his
advice, have determined to petition your Honorablo Court for their appointment as
permanent plenary guardians of the person and estate of their mother based upon the now
nearly universal practloe of local banks to decline guardlanshlps Involving very small
estates when oapable relatives are available to act In such capacity.
22. Thereforo the proposed permanent plenary guardians of the person and eetate
of WILMA LORRAINE PETERS are her two children, to wit:
A.) Ronald W. Peters

B.) Kim L. Peters
100 Ashlord Drive
Enola, PA 17026.2331
23. The proposed guardians have no Interest adverse to that 01 WILMA LORRAINE
PETERS. Neither one 01 them Is an officer or employetl of a corporate flduolary of an
estate In which he or she has an Interest nor Is either one 01 them a surety or ollloer or
employee of a corporate surety 01 suoh fiduciary. Their acceptances to serve as such
guardians are atlaohed hereto.
24. The gross value of the estate of WILMA LORRAINE PETERS, so lar as It
consists 01 single name property, Is believed to be approximately thirteen thousand
($13,000.00) dollars. The single name, estate consists roughly of the lollowlng:
A.) PNC Bank, Cheoklng account number 61-4010-9976 ourrently
holding approximately $4,166.00,
B.) PNC Bank, Savings account number 51-3011-7111 ourrently
hOlding approximately $6,423.00.
C.) Meridian Bank, Certlflosttl 01 Deposit number 03033668217,

D.) 1984 Chevette, prellmlnarlty estimated to havEl a value 01
$500.00.
E.) A few miscellaneous Items 01 personal property.
F.) Rights to Social Seourlty Payments 01 approximately $482,00 per

G.) Retirement Benefits from her employment at Harrisburg Area
Community College, through Teachers Insurance and Annuity Association
01 approximately $480.00 per month.
H.) Relatlvoly minor Income earned Irorn Interest on aforesaid saving
account and certificate 01 deposit,
I.) II Is ourrently believed that WILMA LORRAINE PETERS's Blue
Cross, Blue Shield and Medicare will be sufficient to cover the bulk of the
cost of her stay at the Leader Nursing Home.
J.) WILMA LORRAINE PETERS Is currently listed as a Joint owner
with rights 01 survivorship on the deed to the property at 100 Ashford
Drive. Her name appears thereon as a result 01 a request by the original
Ilnanolng Inslltutlon to have her serve as a co-signer on the bond and
mortgage and not because she paid to purchase the property. WILMA
LORRAINE PETERS and her daughter KIM L. PETERS were not rapresented
by an attorney at the time and were Ignorant 01 other sorts of guarantees
lor payment available to WILMA LORRAINE PETERS. The said real estate
will eventually be the subject of a petition to remove WILMA LORRAINE
PETERS's name from the deed, she being possessed of no real Interest In
the property by means 01 purchase now by payments on the mortgage as
such payments have been and are being made solely by her daughter, the
said KIM L. PETERS.
25. No other court has ever assumed jurisdiction In any proceeding to determine the
capacity 01 WILMA LORRAINE PETERS, the alleged Incapacitated person.
26. WILMA LORRAINE PETERS has no guardian heretofore appointed and has no
known power of attorney,
27. The person and estate of the said WILMA LORRAINE PETERS are In need 01
Immediate and continuing attention and protection and lallure to quickly appoint
guardians will likely result In Irreparable harm to her porson and estate.
28. It Is proposed that the said prospective guardians of the person and estate 01
WILMA LORRAINE PETERS be permitted, authorized, and empowered to aot In such
oapaolty either jolnlly or Individually as permanent plenary guardians.
RI:GARDING WAIVER OF BOND RI:QUIREMENT
29, As above-mentioned In Paragraph 21, It Is virtually certain that no local
banks will agree to serve as guardians of the estate of WILMA LORRAINE PETERS.
30. Petitioner RONALD W. PETERS Is forty-seven (47) years old and Is
experienced In business, having served as operations manager 01 Kinney Shoe
Corporation In Maumelle, Arkansas where his duties Included oversight of $750 million
worth 01 merchandise and a payroll over $1,5 million. Previous to such employment he
was In the United States Air Force and was honorably discharged In March of 1970. He Is
a person 01 good repute and standing In the community wllh strong lamlllal ties to the
area and Is quite capable of acting In the proposed capacity.
31. Petitioner KIM L, PETERS Is thlrty.four (34) years old and Is currently
employed as a bookkeeper for Kinney Shoe Corporation where she works in the Sales Tax
Department, She Is a person of good repute snd standing In the community with strong
lamlllal ties to the area and Is quite capable of acting In the proposed capsclty,
32. The relative size of WILMA LORRAINE PETERS's estate Is minimal and will
likely be dissipated In the payment of bills and the like.
33. Petitioners believe and aver that paragraphs 29 through 32 contain
sufficient lacts that enable the court to decree that no bond need be entered,
REGARDING NOTICE REQUIRE~
34. It Is Inherent In the powers of your Honorable Orphans' Court to permit
abbreviated notices In cases where olrcumstances dictate that such Is reasonable and
sensible.
35, WILMA LORRAINE PETERS Is reallstloally Incapable of comprehending any
notice which might be served upon her.
36. Circumstances dictate that It would be reasonable and sensible to merely
have the notice and petition read to WILMA LORRAINE PETERS by an employee 01 the said
Leader Nursing Home after having It hand.dellvered by either one of ths petitioners.
RI:GARDING APPOINTMENT OF COUNSEL
37. WILMA LORRAINE PETERS Is In no condition to understand or respond to any
potential conversations with any personal or appointed counsel. She oan be 01 no help or
assistance In preparing any representation of herself,
38. By the terms of the Instant petition, It should be p.rJma 1aQ!i obvious that
WILMA LORRAINE PETERS Is In need of help and Is not the vlotlm 01 designing persons
who desire to have her declared Inoapacltated for their own personal gain.
39. In view 01 the above. stated facts petltlonsrs aver that appointment of
counsel would serve no useful purpose and would merely work to deplete WILMA

LORRAINE PETERS's alresdy small tlnanolal resouroes. Sufflolenllaots therefore exist
to Justlly the court to deoree that no counsel need be appointed.
REGARDING THE HOLDING OF ONE HEARING ONL V
40, In view 01 all of the above, petllloners respeotlully request that only one
hearing be held on the instant petition, they seeing no necesnlty to have both s separate
emergenoy hearing and an additional final hearing. Such separate hearings would only
needlessly burden the court's time snd would work to doplete the estate's already
minimal resources.
REGARDING REUANCE ON AFFIDAVIT OF PHVSICIAN
40a. An affidavit of Dr. Sohaenen Is attached hereto. In view 01 the nature 01 the
Inoapaolty 01 Wilma Lorrallle Peters, It 10 respeotlully suggested that the affidavit Is .
sufficient to meet the requirements and purposes of 20 Pa, C.S,A. sect. 651 B regarding
proof ollncspaclty. To require payment of costs for a deposlllon would merely work to
deplete Wilma Lorraine Peters's limited resources and would provide no real additional
proteotlon In that the alfldavlt Is under oath and It has been suggested to the court lhat
the appointment 01 counsel would be a waste of assets. Therefore, there Is no need lor a
deposition or cross-examination.
REGARDING AUTHORIZATION TO DO ASSORTED ACTS IN CONNECTION
WITH THE ESTATE OF THE ALLEGED INCAPACITATED PERSON
41,' Petllloners are private Individuals and not prolesslonal Ilduolarles.
42, Petitioners may be required by certain banks or agencies to show prool 01
, their appointment and authorlzutlon to do certain aots requisite to the proper handling of
WILMA LORRAINE PETERS'S estate.
43. Petitioners may need to do the following, whloh are listed by way of example
only and not as a speolflo set of limitations:
A.) Close out and open bank accounts and revoke beneficiary
designations on sny IRA accounts or other similar accounts If any are
found to exist.
B,) Sell any property to convert It to oash to make suoh lunds
available to credllors or other servloe providers.
C.) Immediate and unlimited ability and power to use and Invade

'io Whom It May Concern I
Mrs. wilma Peters is a 69-year-old woman who was r~csntly admitted to
Holy spirit Hospital on 5-4-94 with a very large stroke. she has a
history of hypsrtension and hypercholssterolemia. She was brought in by
ambulanoe on 5-4-94 after belng found by her daughter in the bathtub,
breathing but unresponsive. She waa intubated in ths Emergenoy Room and
was noted to have a seizure. She was admitted to the Intensive oare Unit
where she remained for several days.
~n initial CAT scan did not show a stroke, but a follOW-UP CAT soan two
days later showed a large stroke in ths territory of ths left middle
osrebral artery. An echocardiogram did not show any evidenoe of thrombus
or embolio sou roe and her carotid doppler did not show any signifioant
stanosia. Shs was treated with Dilantin, Mannitol and Dsoadron, as well
as antihypertsnsive medications. A PEG tube was placsd for feeding.
She was discharged to I.sadsr West on 5-16-94. At that time her Elxam
showed uomplete aphasia, and a dense right hemiparssis. This neurologic
defioit had been etable over approximately one week and the nsurologist
felt that this would be psrmanent. She did open her eyes and appeared to
follow, at least initially, to volce, but to my exam, she did not follow
command~. This represents a devastating stroke and at this point, I do
not believs we can expect any furthsr recovery. She is clearly unable to
care for herself ln any way or make any medlcal deoisions, and it is quits
appropriats for her two children to take over guardianship.

rights of survivorship on the deed to the property at 100 Ashford Drive. Her

REAL ESTATE TRANSAOTION
7. In January of 1985, Pelllloner, KIM L. PETERS, determined to purohase for herself
a resldenoe house at 100 Ashford Drive, Enola (East Pennsboro Township) Cumberland
County, Pennsylvania. (See a true and correct copy of the deed, recorded In Deed Book 31-
B-369, allached as Exhibit B)
8, The purchase price was $53,900.00, Of this purohase price, $15,000.00 was
contributed by WILMA LORRAINE PETERS as a gilt to her daughter, KIM L. PETERS,
9. It was Inlended that WILMA LORRAINE PETERS would live In the residence house with
her said daughter buill was not then or over Intendod that WILMA LORRAINE PETERS should
have ownership Interest In the said residence house.
10. In order to make Ihe purchase, KIM L. PETERS had to apply for a purchase money
mortgage loan whloh she did through First United Federal, A Division of First Federal
Savings & Loan Association of Pittsburgh, which granted her a loan In the amount of
$38,900.00,
11. At that particular time, It was agreod KIM L, PETERS AND WILMA LORRAINE
PETERS, that KIM L. PETERS would make all mortgage payments and that the loan would be

guaranteed by WILMA LORRAINE PETERS.
12. Since, at the time, WILMA LORRAINE PETERS's net Income was higher than thai 01
KIM L. PETERS, the loan was IIsled and carried under the social security number 01 WILMA
LORRAINE PETERS.
1 3. Petitioner and her mother were not represented by counsol when they made said loan
application and were told by tllO bank loan officer to "do tho papers this way". The bank
loan officer gavo no explanation as to the meaning or operation of the words "Joint tenants
with rlghl 01 survivorship" nor as to how to sign surety llnd guaranly papers without
requiring the guarantor to take title 10 tho collateral property,
14, Petitioner and hor molher were represented by an attorney from a title company
based on a roforral by a roaltor, The attorney for the title company never met with
Petitioner and her mother before or alter the settlement and asked no questions about their
Inlentlons as to taking title nor did he explain anything as to the operation of law concerning
Joint lenancles with rights of survivorship,
15, Petitioner subsequently obtained an additional loan of $20,000,00 lor remodeling
and redoing the basement at the said premises through Ambassador Home Improvements, Inc.
and Pittsburgh National Bank In Oclober of '1991. Her mother again was to sern as a
guarantor or payment bul the question of title was never discussed,
16. 01 the remodelling loan. WILMA LORRAINE PETERS paid approximately $5,400.00
01 principal and Interest.
17. Subsequently, In June of 1993, Petitioner rellnanced both of the aforesaid loans
through CCNB Bank, N. A, In the amount of $57,300.00. Again Pelltloner and her mother
Intended that WILMA LORRAINE PETERS would act as a guarantor only, KIM L. PETERS
making all morlgage paymonts as they came duo and paying all property taxes as part of the
1ll0rlgage paymonts Into Iho tax escrow account. (See copy of NOTE attached herelo as
Exhibit "C")
1 8. Again, at the seltlement oflhe reflnancod loan, no one explained anything about the
title or Its legal ramifications to either Petitioner or her mother,
1 9. KIM L. PETERS has paid taxes and upkoep on the property throughout.
20. It was not until Petitioner, KIM L. PETERS, and her brolher, RONALD W. PETERS,
petitioner, obtained tho services of present counsel 10 help them handle the affairs 01 their
mother that the question of title and Ihe law relative to Joint tenancies with rights 01
survivorship was ever discussed or explained,

POTENTIAL INHERITANCE TAX
21. Seotlon 2108 of the Inheritance and Estate TaK Act of 1991 (Aot No, 1991-22)
states .In pertinent part:
JOINT TENANCY. (a) When any property Is held In the names ollwo ".
persons ". so thai, upon tho death of one of them, the survivor '" lhas) a right
to the Immediate ownership or possession and enjoyment of the whole
property, the accrual of such right, upon the death 01 one of them, shall be
deemed a trsnsfer subject 10 laK 01 a fractional portion of such property to be
determined by dividing the value of the whole property by the number of Joint
tenants In eKlstence Immedlalely preceding the death of the deceased Joint
tenant.
22. The current county taK assesement figure for the property Is 7,030. The current
county multiplier Is 13.33. Thus the total value of the property appears to be at least
$93.709.90. Under current Inherltsnce taK rules, the following tax calculaUon applies:
$93,709.00 + 2 = $46,854.95 eubject to Inheritance taK at the rate of
slK (6%)per cent = taK due 01 $2,811.29.
23, The prospective taK would not be looming on the horizon had anyone bothered to
listen to Petitioner, KIM L. PETERS, and her mother, WILMA LORRAINE PETERS, as to their
Intentions and their own arrangements and to have eKplalned to them the legal operation 01
joint tenancies with rights of survivorship,
FACTS REGARDING A CERTAIN 1984 CHEVROLET CHEVETTE
24. WILMA LORRAINE PETERS Is currently the record owner of a 1984 Chevrolet
Chevelle, No, 1G1AB68C8EY 260180 willi approKlmately 2B,000 miles on It. An esUmated
wholesale value provided by Forbes Chevrolet Is $150.00, (See copy 01 esUmated value
allsched as Exhibit "0")
25. The said WILMA LORRAINE PETERS, belore her present slate of Incapacity, stated and
deolared that It was her Immediate and Unal decision to make a gift of the aforesaid Chevelle
to her son, RONALD W. PETERS and 10 formally transfer and deliver the tlUe to him.
26. It was understood by and between the said WILMA LORRAINE PETERS and RONALD W.
PETERS, her son, thslthe automobile could and would occasionally be used by her grandson,
DANIEL L. PETERS, and would be titled In the name of her son for beller parental control of
the use of said automobile and because the said grandson was nol and Is sUII not of age,

32. The current gross value of the estate of WILMA LORRAINE PETERS, so far as It
consists of elngle name property, Is comprised of the following Items and their approximate
current values.
A.) Guardianship checking account no. 5140109975 at PNC Bank,
National Association, approximately $2,575.72 (after June 1 add $479.02
and $491.00 to this figure).
B.) Savings account no. 0081091779 3001 at PNC Bank, National
AssoCllatlon, approximately $8,675.39.
C.) C. D. account no. 03033568217 at Meridian Bank, approximately
$5,210.54.
D.) Funeral Reserve Account No. 201.16.2301, approximately
$5,630.00. (See copy of Musselman Funeral Home, Inc. letter, contract and
agreement as Exhibit "E")
E.) 1984 Chevette, prellmlnarlty estimated to have a value of $150.00
F.) A few miscellaneous Items of personal property.
G.) Rights to Social Security Payments of approximately $491.00 per
month.
H.) Retirement Benefits from her employment at Harrisburg Area
Community College, through Teachers Insurance and Annuity Association of
approximately $479.00 per month.
I.) It Is currently believed that WILMA LORRAINE PETERS' Blue Cross,
Blue Shield and Medicare will be sufficient to cover the bulk of the cosl of her
stay at the Leader Nursing Home.
33. WILMA LORRAINE PETERS has sufficient single name assets, retirement, and social
seourlty benefits as well as very good Blue Cross, Blue Shield and Medicare coverage, to
eliminate any conceivable need to maintain her name on the subject real estate.
34. Permitting and decreeing a conveyance of the Interest of WILMA LORRAINE PETERS
In the subject real estate to her daughter, KIM L. PETERS, will be In conformity with the
expressed Intention of WILMA LORRAINE PETERS and will carry out those Intentions as they
originally should have been and would have been had It not been for the lack of appropriate

PETERS Is not expected to recover nor Is It likely she will ever be able to leave the
Leader Nursing Home for any place but a similar Inslltullon. Thereloro, the object of
this pelltion Is the leasl restrictive alternative available to protect her person and her
estate.

for payment available to WILMA LORRAINE PETERS. The said real eslale
will eventually be the subjecl of a petition to romove WILMA LORRAINE
PETERS's name from the deed, she being possessed 01 no raallnterest In
the property by means 01 purchase now by paymenls on the mortgage as

30. Petitioner RONALD W. PETERS Is forty-soven (47) years old and Is
experienced In business, having servod as operations manauor 01 Kinney Shoe
Corporallon In Maumelle, Arkansas whew his dulles Included oversight of $750 million
worlh of merchandise and a payroll over $1.5 million. Previous to such employment he
was In the United States Air Force and was honorably discharged In March of 1970. He Is
a person of good repute and standing In the community with slrong familial ties to the
orAa and Is quite capable of acting In lho proposed capacity.
31. Petillo nor KIM L. PETEHS Is thlrty.four (34) years old and Is currenlly
employed as a bookkeepor for Klnnoy Shoe Corporallon where she works In the Sales Tax
Departmenl. She Is a person of good repute and standing In the communlly with strong
familial ties to the area and Is quite capable of acting In lhe proposed capacity.
32. The relative size 01 WILMA LORRAINE PETERS's eslate Is minimal and will
likely be dissipated In the payment of bills ond the like,
33, Pelltioners believe end aver that paragraphs 29 lhrough 32 contain
sulflclent faots that enable the court to decree that no bond need be entered.
REGAHDING NOTICE REQUIREMENTS
34. It Is Inherent In the powers of your Honorable Orphans' Court to permit
abbreviated notices In cases whoro circumstances dictate that such Is reasonable and
sensible.
35. WILMA LORRAINE PETERS Is realistically Incapable of comprehending any
nollce which might be served upon her.
38. Circumstances dictate thai It would be reasonable and sensible to merely
hava the notice and petition read to WILMA LORRAINE PETERS by an employee of tha said
Leader Nursing Home altor having It hand.dellvered by either one of the petilloners.
REGARDING APPOINTMENT OF COUNSEL
37. WILMA LORRAINE PETERS Is In no condition to understand or respond 10 any
potential conversallons with any personal or appointed counsel. She can be of no help or
assistance In preparing any representation of herself.
30. By the terms of Iho Installl petlllon, It should be 1llJma.1allla obvious that
WILMA LORRAINE PETERS Is In need 01 help and Is not tho victim 01 designing persons
who desire to have her declared Incapacitated for their own personal gain.
39. In view of the above. stated facts petitioners aver that appointment of
counsel would serve no useful purpose and would merely work to deplete WILMA
LORRAINE PETERS's already small financial resources, Sufflclentlacts therefore exist
to Jusllly the court to decree that no counsel need be appointed.
R"GARDING THE HOLDING OF ONE HEARING ONLY
40. In view of all 01 the above, pelllloners rospuolfully request that only one
hearing be held on the Instanl petition, they seeing no necssslty to havo both a separate
omergency hearing and en addlllonal final hearing. Such separate hearings would only
needlessly burden the court's time and would work to deplete the estate's already
mlnlmol resources.

deplete Wilma Lorraine Peters's IImlled rosourcos and would provide no real additional
proteotion In that the affidavit Is under oath and II has be on suggested to the court that
the appointment 01 counsel would bo a wasto of assets. Therefore, Ihere Is no need for a
depcsltion or cross-examination.
