COMPLAINT
The Plaintiff, McCLURE MECHANICAL SERVICES, A Division of McCLURE COMPANY, by Its attorneys, KNUPP
& KODAK, P,C., brings this action of Assumpsit against the Defendant to recover the sum of FIVE THOUSAND, ONE
HUNDRED NINETY-SIX DOLLARS AND EIGHTY-FOUR CENTS {45,196,84, along with Interest thereon at the rate of One
and One-Half (111,'10) percent per month from January 24, 1995, upon a cause of action of which the following Is a
statement:
1, The Plaintiff, McCLURE MECHANICAL SERVICES, a Division of McCLURE COMPANY, Is a corporation
organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office and place of
business at 4101 North Sixth Street, Post Office Box 2630, Harrisburg, Dauphin County, Pennsylvania 17105,
2, The Defendant, MUMMA REALTY ASSOCIATES,INC" Is a corporation organized and existing under the
laws of the Commonweallh of Pennsylvania, having Its principal office and place of business at 1043 Mumma Road,
Pennsboro Center, Camp Hill, Cumberland County, Pennsylvania 17011,
3, On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiffs books
of original entry hereto attached, made a part hereof and marked Exhibit "A", Plaintiff, at the special Instance and oral
request of the Defendant, performed labor and provided services, materials and supplies of the kind and description set

5, Upon information and belief, Plaintiff arranged for service of the reinstated
Complaint on Rothman, Schubert and Reed Realtors on or about February 9, 1998,
6, Since service of the reinstated Complaint was attempted beyond the thirty
(30) day requirement of Rule 401, service is improper, and the Complaint should be stricken.
7, In addition, Pa,R,C,P. 424 requires of service of original process upon a
corporation must be made by handing a copy to any of the following persons provided the
person served is not a Plaintiff in the action:
(1) an executive officer, partner or trustee of the corporation
or similar entity, or
(2) the manager, clerk or other person for the time being in
charge of any regular place of business or activity of the
corporation or similar entity, or
(3) an agent authorized by the corporation or similar
entity in writing to receive service of process for it,
8, Plaintiff attempted to serve the reinstated Complaint upon Rothman,
Schubert and Reed Realtor, a real estate agency that does work for Mumma Realty
Associates, Inc" but which is not a designated person under Rule 424 for service of process.
9, Defendant therefore objects to the improper service of the reinstated
Complaint, and moves that the Complaint be stricken,
10. In Plaintiffs claim for relief, Plaintiff demands pre-judgment interest on
its specified damages.

II, Plaintiff's claim for pre-judgment interest is not cognizable under
Pennsylvania law, and Defendant therefore demurs to the claim for relief.
WHEREFORE, Defendant, Mumma Realty Associates, Inc" respectfully
requests this Court to sustain its Preliminary Objections informed of the attached Order.

4, The prices charged for said labor performed and services, materials and supplies provided were just and
reasonable, were the legal and market prices therefor and were the prices which the Defendant orally promised and agreed
to pay Plaintiff therefor.
5, The balance due and owing by Defendant to Plaintiff Is the sum of FIVE THOUSAND, ONE HUNDRED
NINETY-SIX DOLLARS AND EIGHTY-FOUR CENTS ($5,196,84).
6, Plaintiff has frequently demanded payment from Defendant of said amount due and owing as aforesaid,
but Defendant has refused and neglected and still refuses and neglects to pay said amount of any part thereof,
