NOTICE
You have been sued in Court, If you wish to defend against
the claims set forth in the following pages, you must take action
within twenty (20) days after this Complaint and Notice are served
by entering with the Court your defenses to the claims set forth
against you. You are warned that if you fail to do so the case you
proceed without you as a Judgment may be entered against you by the
Court without further notice for any money claimed in the Complaint
or for any other claim or relief requested by the Plaintiff, You
may lose money or property or other rights important to you.

in the Cumberland County Recorder's Office in Mortgage Book 955,
Page 857, a copy of which is attached hereto, marked Exhibit "A",
and made a part hereof by reference, which mortgage contains and
is a lien upon the property situate at 1709 Charles Street, New
Cumberland Borough, Cumberland County, Pennsylvania, 17070, being
improved with a dwelling,
5, Said loan was further evidenced and secured by a Prime
Line Credit Agreement which accompanied said Mortgage dated October
13, 1989, a copy of which is attached hereto, marked Exhibit "B",
and made a part hereof by reference,
6, Harris Savings Bank, in consideration of the said
mortgage and accompanying Prime Line Credit Agreement, advanced
from time to time to Donald M, Wiley and Paula W. Wiley the sum of
$24,920.56 as of January 31, 1997.
7 , The premises subj ect to
specifically set forth in Exhibit "G",
part hereof by reference,
8, Donald W, Wiley and Paula W, Wiley are the sole owners of
the said premises contained in said mortgage.
9, Said mortgage and Prime Line Credit Agreement have not
been assigned in whole or in part by the Plaintiff herein,
10, Donald W, Wiley and Paula W. Wiley are the record owners
in fee simple of said premises by virtue of a Deed dated May 10,
1988 and recorded in the Cumberland Count Recorder's Office in Deed
Book 331, Page 365,

attached hereto and made a

11. No judgment has previously been entered on said mortgage
or note in any jurisdiction, and said instruments are less than
twenty (20) years old,
12. The said mortgage is in default because Defendants herein
have failed to pay the monthly payments that were due and owning
of $206,11 for August, 1996, $202,95 for September, 1996, $223,94
for October, 1996, $216,95 for November, 1996, $195,95 for
December, 1996 and $230,94 for January, 1997.
13, The Plaintiff has given to the Defendants written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated November 18, 1996, copies of which are marked
Exhibits "D"and "E" and attached hereto and made a part hereof by
reference.
14. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983, dated
November 18, 1996, copies of which are marked Exhibit "F" and "G"
and attached hereto and made a part hereof by reference,
15, The entire principal amount of Twenty-Four Thousand Nine
Hundred Twenty and 56/100 Dollars ($24,920.56) plus interest due
of $1,381.81 and late charges due of $63.85 for a total of
$26,366.22 has become due and payable, together with interest at
the current rate of 10.25% per annum, reasonable legal fees for
collection of said sum in accordance with the t.erms of said
mortgage and costs.
16. The Plaintiff believes and therefore avers that

reasonable legal fees for collection is $1315,00
17, The Defendants are liable to the Plaintiff for interest
at the (current) rate of 10,25% per annum until paid and expenoes
as provided in and collectible under the mortgage documents that
will accrue until distribution by the Sheriff of Cumberland County,
Pennsylvania, to be computed at the time of judgment in these
proceedings in addition to the current loan balance,

Mortgage Foreclosure and sale of the mortgaged property, with
damages in the amount of $28,911,46 together with additional
interest thereon, costs and all other amounts advanced
