WHEREAS, Foxcroft Townhouse Associates"~ PA Limited partnership, of cumberland
County, pennsylvania, entered into a contract with Boyd E. Diller, Inc., 6820
wertzvi11e Road, Enola, PA, to provide materials and perform labor necessary for
completion of a residential dwelling eituate upon lot of ground located:

cumberland County, pennsylvania, ae more particularly set forth in Exhibit "AN
attached hereto.

NOW, THEREFORE, it is horeby stipulated and agreed by and between the said
psrtiee, ae part of the said contract and for the consideration therein set
forth, that neither the undersigned contractor, any sub-contractor or material
man, nor any other person furnishing labor or materials to the said contractor
under this contract shall file a lien, commonly called a mechanic'S lien, for
work done or materials furnished to the said building or any part thereof.

This stipulation is made and intended to be filed with the County Prothonotary
within ten (10) days after date, in accordance with the requirements of the Act
of Assembly of pennsylvania, in such case providsd.

ALL THAT CERTAIN tract or parcel of ground situate in HAMPDEN TOWNSHIP, Cumberland
county, Pennsylvania, and bounded and described as fo110we, to witl
BEGINNING at a point at the terminus of Lenker street (a sixty [60] foot wide public
street with a thirty-four [34] foot wide cartway); thence extending from said
beginning point, South eight (8) degrees forty (40) minutee zero (00) seconds West,
six hun~red twenty-four and thirty-three one-hundredths (624.33) feet to an iron pin
on northern right-of-way line of 1-581; thence extending along the northern
right-of-way of 1-581 on a line curving to the left having a radius of one thousand
four hundred fifteen (1,415) feet, the arc length of five hundred one and fifty-two
one-hundredths (501.52) feet to a PennDOT monument; thence continuing along PennDOT
