PETITION FOR APPROVAL OF MINOR'S COMPROMISE SETTLEMENT AND DISTRIBUTION OF PROCEEDS AND NOW, come Barry B. and Carol G. Moore, as parents and natural guardians of Lauren Moore, their minor child, and peti- tion the Court as follows: 1. Lauren Moore is the minor child of Barry B. and Carol G. Moore, Petitioners herein. 2. Lauren Moore is 16 years old, having been born on August 9, 1970. 3. Lauren Moore resides with Petitioners at 1705 Olmstead Road, camp nill, cumberland County, Pennsylvania 17011. 4. On or about January 1, 1992, Lauren Moore sustained injuries in an automobile accident on Interstate 83 Southbound at the Camp Hill exit ramp in Cumberland County, Pennsylvania ("Accident") . 5. The Accident involved two vehicles. The first vehicle was owned by Lisa Davis and driven by David Kyler. Although Allstate Insurance Company had issued a policy covering said vehicle, Allstate denied coverage on the basis that the premiums were not paid and that the poli':lY was cllnoelled before the Accident. The senond vehicle was owned and driven by Carol G. Moore and was insured by state Farm Insurance company ("State Farm") at the time of the Accident. Lauren Moore was a passenger in the vehicle driven by Carol Moore. 6. The Accident occurred when the vehicle operated by David Kyler struck the vehicle operated by Carol G. Moore from the rear. David Kyler then fled the scene of the Accident. The vehicle he was operating was later identified by its license plate and David Kyler admitted operating the vehicle at the time of the Aocident. 7. At the time of the Accident, Lauren Moore was seated in the baok seat of the vehicle operated by Carol G. Moore. Upon impact, Lauren Moore was thrown forward striking her knees and head on the back of the front seat. 8. Lauren Moore suffered the following injuries in the Aocident: (a) Temporarily increased seizure activity related to the aggravation of a preexisting condition known as Rolandic Epilepsy, together with the need for increased medication and resulting side effects; (b) Bruises to both knees; (c) Muscular spasms in her neck and mid-to-low-baok area; and (d) Pain in her knees, neok and mid-to-low-back area. 9. state Farm provides uninsured motorists ooverage on the vehicle occupied by Lauren Moore at the time of the Accident under Policy No. 6364820C0138F (lIstate Farm Policy"). 10. Lants, Esquire, of the law firm of McNess, Wallaoe , Nuriok. Petitioners have entered into a written fee agreement with the law tirm of McNees, Wallace & Nudok which provides for a twenty- five percent (25') contingent fee for services rendered. A copy is attaohed as Exhibit "A". 12. Petitioners have agreed, subject to Court approval, to compromise minor Lauren Moore's claim for uninsured motorist benefits under the state Farm Policy in exchange for a payment by state Farm of $10,000 which will be distributed as followsl A. $7,500 to Barry B. and Carol G. Moore as the parents and natural guardians of Lauren Moore, a minor; and, B. $2,500 to MoNees, Wallaoe & Nuriok repreBent~ ing a twenty-five peroent (25') fee for legal servioes rendered. 13. Petitioners believe that the settlement is fair and that it is in Lauren Moore's best interest that the proposed settlement bo aocepted and approved. 14. Petitioners and Lauren Moore will be present should the Court ohoose to sohedule a hearing on this Petition. 15. ' QQNTINGENT FEE AGREEMEN~ This Agreement is made on February ____, 1992 by and between Dr. Barry R. Hoore and Carol G. Hoore, as parents and natural guardians of Lauren B. Hoore, and Carol G. Hoore individually, and Heather H. Hoore and Noel E. Hoore, 1705 Olmsted Way/ Camp Hill, PA 17011 (hereinafter "Clients") and HcNEES, WALLACE & NURICK, Harrisburg, Pennsylvania, (hereinafter "Law Firm"). The parties hereto, in consideration of the promises and undertaking set forth below, and intending to be legally bound hereby, agree as follows: 1. Clients hereby retain the I,aw Firm as their attorneys to negotiate for a settlement or to institute for them any legal aotions or proceedings and oonduot such investigations that are reasonable and necessary in conneotion with their claims for damages against any and all parties that may be liable to them for damages as a l'esult of the injuries sustained by Carol G.
