THIS AGREEMENT made the 9/" day of April, 1997, by and between,
JAMES A. P/7TMAN. of903 Big Spring Road, Shippensburg, Pennsylvania. hereinafier referred to
as Contrac/or,
AND
DARYL L. WATSON, of 249 Neil Road, Shippensburg, Pennsylvania. hereinafier referred to as
Owner,
WHEREAS, the said Contractor undcrtook and agrecd to make ccrtain improvemcnts to
Owncr's propcrty situate in thc Township of Southampton, Cumbcrland County, Pennsylvania,
known as Lot No.8, Crestwood Acres, Walnut Dale Road, Shippcnsburg, Pennsylvania, more fully
dcscribcd in Exhibit "A" attachcd hcrcto and madc a part hereof.
NOW THEREFORE, TI.IIS AGREEMENT WITNESSETH: That thc said Contractor, for
and in consideration of the sum ofOnc Dollar ($1.00) to said Contmctor in hand paid by Owncr, the
receipt whcreof is hcrcby acknowlcdgcd, and the further considcration mentioncd in thc agreement
aforesaid, for himsclf, and his subcontractors, and all partics acting through or undcr thcm, covenant
and agrce that no mechanic's licns or claims shall be tiled or maintaincd by them or any of them
against the said buildings and improvemcnts and the lot of ground appurtcnant thercto for or on
account of any work donc or matcrials furnished by them or any of them under said contract or
othcrwisc, for, towards, in, or about the ercction and construction of the said improvemcnts on the
lot above dcscribcd, and thc said Contractor, for himsclf, his subcontractors and othcrs under him
hcrcby cxprcssly waive and rclinquish the right to havc, filc, and maintain any mcchanie's Iicns or
claims against thc said buildings or any ofthcm, and agrce that this instrumcnt, waiving the right of
Iicn, shall be an indepcndcnt covenant.

LEGAL DESCRIPTION
ALL that certain piece or parcel of land, situate in the Township of Southampton, County of
Cumberland, Pennsylvania, referred to as Lot No.8, more particularly bounded and described in
accordance with Subdivision Plan entitled "Final Land Subdivision of Crestwood Acres East",
prepnred by Cnrl D. Bert; Professional Land Surveyor, which Subdivision Plan has been approved
by the appropriate municipal authorities and is recorded in Cumberland County Plan Book 66, at Page
83, as follows:
BEGINNING at a railroad spike set at the Northwesterly comer of the within described lot, which
comer is common comer of Lot No.9 and which comer is in line ofland now or fonnerly of Bennie
F. Shatzer; thence along Walnut Dale Road and along line of land now or formerly of Bennie F.
Shatzer, North eighty-six (86) degrees two (02) minutes twenty-five (25) seconds East, one hundred
fifty-five and zero hundredths (155.00) feet to a railroad spike at common comer of Lot Nos. 8 and
7; thence along common boundary line of Lot No.7, South four (04) degrees four (04) minutes thirty
(30) seconds East, five hundred seventy-three and sixty-one hundredths (573.61) feet to an iron pin
at common corner of Lots 4, 7, and 10; thence along line of Lot No. 10, South seventy-four (74)
degrees twenty-five (25) minutes thirty (30) seconds West, one hundred fifty-eight and eighteen
(158.18) feet to an iron pin at common comer of Lots No.9 and 10; thence along line of Lot No.9,
North four (04) degrees four (04) minutes thirty (30) seconds West, six hundred five and forty-six
hundredths (605.46) feet to a railroad spike, the point and place of beginning. CONTAINING a
total area of 2.098 acres, more or less.
UNDER AND SUBJECT to dedicated right-of-way line, building setback lines, and other notations
and conditions contained on the above-referred to Subdivision Plan.
ALSO UNDER AND SUBJECT to the following restrictions, whieh shall be covenants running with
the land and binding upon the grantees and their heirs, successors and assigns:
I. Only single family detached residential structures and appurtenant accessory buildings (gnrage,
horse barn, etc.) shall be constructed on eaeh lot.
2. The primary use of each lot shall be residential, but lots may also be utilized as seeondary or
accessory uses (as those terms are understood under the Munieipalities Planning Code and Zoning
Ordinances) for home occupations or professional offices and such non-residential uses shall not be
noxious or offensive to neighbors or neighboring properties.
3. No mobile homes are permitted on any lot in this subdivision.
