Tyler and Carol E. Tyler, of 1550 Holly Pike, Carlisle, Pennsylvania entered into a contract with Fisher Construction, Contractor, of 73 Kralltown Road, Wellsville, Pennsylvania, to provide materials and perform labor necessary for the construction of a 4 bedroom split level house with two car garage, upon the fOllowing tract of land located in South Middleton Township, Cumberland County, Pennsylvania, more specifically described as follows, to wit: ALL THAT CERTAIN tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, bounded and described in accordance with a Plan prepared by Jarmolenko Professional Land Surveyors, dated October 27, 1992 and recorded in the Office of the Recorder of Deeds for Cumberland County in Plan Book 67, Page 128. BEGINNING at a point in South Middlesex Road T-684 at corner of Lot No.7 on the said Plan; thence along Lot Nos 7, 6, 5 and 4, North 58 degrees 10 minutes 08 seconds West 686.65 feet to an iron pin; thence along Lot No. 11 on Plan, North 05 degrees 25 minutes 38 seconds East 183.30 feet to an iron pin; thence along Lot No.9 on said Plan, South 60 degrees 27 minutes 35 seconds East 650.50 feet to a point in South Middlesex Road T-684; thence along South Middlesex Road, South 08 degrees 06 minutes 07 seconds East 248.03 feet to a point, the place of BEGINNING. CONTAINING 2.8377 acres and designated as Lot No.8 of Plan of Liberty Estates. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor under this contract shall file a lien, commonly called a mechanics' lien for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten days after date, in accordance with the requirements of Act of Aasernbly of Pennsylvania, in such case provided.
