COMPLAINT III MORTGAGE I'ORBCLOSURB
UNITED COMPANIES LENDING CORPORATION, by its attorneys, SCOTT
R. CALKINS, ESQUIRE, and THOMPSON, CALKINS & SUTTER complains and
says as follows:
1. Plaintiff is UNITED COMPANIES LENDING CORPORATION, a
corporation existing under the laws of the State of Louisiana,
with a principal office and place of business located at 4041
Essen Lane, Baton Rouge, Louisiana 70809 ("United Companies").
2. Defendants JEFFREY M. FRERE and KATHY L. FRERE are
adult individuals whose last known address is 662 Walnut Bottom
Road, Shippensburg, Pennsylvania 17257.
3. Defendants executed and delivered to United Companies a
Mortgage dated November 27, 1995, which was recorded in the
Recorder's Office of cumberland County, Pennsylvania, in Mortgage
Book Volume 1294, Page 123 ("Mortgage"). The Mortgage secures a
loan in the amount of $77,400.00 evidenced by the Note from
Defendants to United Companies dated November 27, 1995 ("Note").
True and correct copies of the Mortgage and Note are attached
hereto and incorporated herein as Exhibits
"A"
and
"B",
respectively.
4. The prcperty subject to the Mortgage is located at 662
Walnut Bottom Road, Shippensburg, cumberland ccunty, Pennsylvania
("Property") .
5. Defendants have failed to make payments as provided for
in the Note and Mortgage.
6. Notice required by the Homeowners' Emergency Mortgage
Assistance Act, Act 91 (35 P.S. 111680.401c, et seg.), was mailed
to Defendants at their last known address on August 28, 1996. A
copy of said Notice is attached hereto and incorporated herein as
Exhibit "C".
7. Defendant applied for financial assistance from the
Homeowners' Emergency Mortgage Assistance Fund and was denied
assistance by the Pennsylvania Housing Finance Agency.
8. The property subject to the Mortgage is described as
follows:
ALL THOSE CERTAIN tracts of land with improvements
thereon erected, situate in the Village of Less Cross
Roads, Southhampton Township, cumberland County,
Pennsylvania, more fully bounded and described as
follows:
LOT NO. 14: BOUNDED on the North by Walnut Bottom Roadl
on the South by public alleYI on the East by public
alleYI and on the West by Lot No. 151 said lot having a
frontage of 55 feet on the Walnut Bottom Road and
extending in depth 247-1/2 feet to the alley in the
rear.
LOT NO. 15: BOUNDED on the North by Walnut Bottom Roadl
on the South by public alleYI on the East by Lot No. 14,
above described 1 and on the West by lands now or
formerly of Jacob Stouffer. SAID lot having a frontage
of 55 feet on the Walnut Bottom Road and extending in
depth 247-1/2 feet to alley in the rear.
BEING the same premises which became vested in Jeffrey
M. Frere and Kathy L. Frere by deed from Donald F. &
Catherin A. Nori by deed dated September 24, 1990
Recorded October 16, 1990 in record Book V-34, page 132.

1. On May 28. 1997. judgment in mortgage foreclosure was entered against Defendants and
in favor of Plaintiff in the amounl of $92,499.31.
2, August 29, 1997, Defendants filed for relief under Chapter 7 of the Bankruptcy Code in
the U,S, Bankruptcy Court for the Middle District of Pennsylvania al No, 97.03655. Defendants were
discharged from said bankruptcy filing pursuant 10 an Order issued by the U.S. Bankruptcy Court dated
December 19.1997, a copy of which is intached hereto as Exhibit "A", This tenninated the case and lifled
the stay imposed by ti362 of the Bankruptcy Code,
