STIPULA TION AND AGREEMENT
THIS STIPULATION AND AGREEMENT entered into this I ~.g,. day of April, 1997,
by and between WESLEY J. YOUNG and AMANDA I. YOUNG (hereinafter referred to as
"Petitioners") and MARTHA L. FAHNESTOCK (hereinafter referred to as "Mother").
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the Mother is the natural mother of a minor child, namely Alice M.
Fahnestock (age 12, born March 27, 1985); and
WHEREAS, the Mother represents that the parental rights of the natural father of the
child, Donald W. Fahnestock, were voluntarily relinquished at the time of their divorce in 1992;
and
WHEREAS, the parties wish to enter into an agreement relative to the custody of the
child.

NOW, THEREFORE, in consideration of the mutual covenants, promises and
agreements as hereinafter set forth and intending to be legally bound, the parties hereto agree as
follows:
I. The parties hall have joint legal custody of the child.
2, The Petitioners shall have primary physical custody of the child, subject to periods
of partial or temporary custody and visitation of the child by the Mother on advance to Petitioners
by the Mother, and on the mutual agreement of the parties from time to time.
3. The Parties shall have reasonable telephone contact with the child while the child is in the
custody of the other party.
4. The parties will keep each other advised immediately relative to any emergencies
concerning the child while she is in their custody and shall take any necessary steps to ensure that
the health, welfare and well being of the child is protected.
5. The parties shall do nothing that may estrange the child from each other or hinder
the natural development of the child's love or affection for the other party,
6. Any modification or waiver of any of the provisions of this agreement shall be
effective only if made in writing and only if executed with the same formality of this agreement.
7. The parties agree that in making this agreement there has been no fraud,
concealment, overreaching, coercion or other unfair dealing on the part of the other.
8, The parties desire that this agreement be made an order of Court through the
Court of Common Pleas of Cumberland County, and further acknowledge that the Court of
Common Pleas of Cumberland County has jurisdiction over these issues and shall retain such

jurisdiction should circumstances change and either party desire further or require further
modification of said Order.

hereof, set forth their hands and seals the day and year herein set forth.

STIPULATION AND AGREEMENT
THIS STIPULATION AND AGREEMENT entered into this day of June,
1997, by and between WESLEY J. YOUNG and AMANDA I. YOUNG (hereinafter
referred to as "Petitioners") and MARTHA L. FAHNESTOCK (hereinafter referred to as
"Mother").
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the Mother is the natural mother of a minor child, namely Alice M.
Fahnestock (age 12, born March 27,1985); and
WHEREAS, the parties previously entered into a custody stipulation and
agreement, confirmed by Order of this Court dated April_, 1997, a copy of which is
attached hereto as Exhibit "A"; and
WHEREAS, the parties wish to enter into an agreement modifying the terms of
their previous agreement whereby their previous agreement and the prior order of
Court shall be terminated.
NOW, THEREFORE, in consideration of the mutual covenants, promises and
agreements as hereinafter set forth and intending to be legally bound, the parties
hereto agree as follows:
1. The Mother shall have legal custody of the child.
2. The Mother shall have primary physical custody of the child.
3. The parties previous agreement shall be null and void and the provisions
thereof terminated immediately and petitioners shall have no rights of visitation, partial
custody or further contact with the children.
4. Any modification or waiver of any of the provisions of this agreement shall
be effective only if made in writing and only if executed with the same formality of this
agreement.
5. The parties agree that in making this agreement there has been no fraud,
concealment, overreaching, coercion or other unfair dealing on the part of the other.
6. The parties desire that this agreement be made an order of Court through
the Court of Common Pleas of Cumberland County, and further acknowledge that the
Court of Common Pleas of Cumberland County has jurisdiction over these issues and
shall retain such jurisdiction should circumstances change and either party desire
further or require further modification of said Order.
