9. ASSIGNMENT: The TenRnt(~) covenant and agree '
not to assign or sublet or transfer their interest in the

10. TAXES AND INSURANCE: The Landlord agrees to pay
all taxes and assessments levied against the premises
during the term of this lease. In ad~ition, Landlord
agrees to be responsible for fire insuranc~ coverage for
the exterior of the premises including the structure of the
building. Tenant(s) agree to be responsible for fire and
hazard insurance coverage on their contents within the leased
area and to carry appropriate liability insurance.
11. UTILITIES: Tenant(s) shall be responsible for

disturb, inconveni~nce, or ~ndanger other Tenant(s) or
persons or to encourage, ~upport, or allow ncts or circum-
stances which would disturb, inconvpnience, or endanger
other Tenant(s) or persons. Tenant(s) agr~e that waterbeds
shall not be allowed in premises without thp express
written consent of the Landlord.
18. EXPIRATION: Both parties hereby agree that either
party hereto may terminate this lease at the end of the said
term by giving the other party lY.ritten notice thereof at
least thirty days prior thereto, but in default of such
notice this lease shall continue upon the same terms and
conditions as herein contained on a uonth-to-month basis.
Notice of any increase in monthly rental shall be given by
the Landlord to the TenRnt(s) in writ.ing at least thirty
days prior to the effective date. Upon receipt of notice
by Tenant(s) to vacate. Landlord shall have the right to
show premises to prospective rpnter(s) at any reasonable
tille.
19. DEFAULT: Upon occurrence of any default such
as failure to pay installment of rent when due, failure to
perforll any terms or conditions of this lease, abandon-
ment by Tenant(s) of the leased premises, or insolvency
of the Tenant(s), the lease ~hall be deemed to have been
breached and thereupon by that fact itself and without
entry or other action by the Landlord:
a) At the option of the Landlord the rent for
the rellainder of the term of this lease shall inmediately
become due and payable.
b) At the option of the Landlord this lease
and the .tern created hereby as well as all the right, title
and interest of the Tenant(s) hereunder shall cease and
, terminate and become absolutely void without any right on
the part of the Tenant(s) to save the forfeiture by payment
of any sua or by perforaance of any term, covenant or con-
dition broken or defaulted, and the Landlord shall be en-
titled to recover damages for such event of default in an
anount equal to the allount of the rent and other charges
reserved for the balance of tern thereof.
c) At the option of the Landlord, he nay lease
the de.ised prenises or any part or parts thereof to such
person or persons as aay. in Landlord's niscretion see.
best without affeoting Tenant liability for any loss of
rent for the balance of the terll.
d) Tenant shall pay to Landlord. as additional
rent on demand, all of Landlord's costs, charges and ex-
penses including without limitation the reasonable fees
of counsel, agents or others retained by Landlord for the
enforcement of Tenant(s) covenants unner this lease.
e) Landlord reserves the right to delay en-
forcenent against any breach of teras contained herein. and

W. Locust St.. Mechanicsburg PA 17055 from me to you:
1). Allhough I don't need to make an immediate lransfer of the properly lo you, I
would at least like us 10 gel together to discuss all ideas and concerns, and if you are in
fact interested, I would lhen like to enter inlo a firm and hinding sales conlract wilh you.
I would like 10 accomplish this by March 1. t 997, I would, however. accepl a selllement
dale beyond Ihe normal 60 day limit which seems to be typical for residenlial transaclions
in this area. Ilecause of time necessary lo procure financing or to meel any condilions
which a lender would impose on the house, I would accept a selllement dale somelime in
June or July of this year.
2). When I rented lhe house to you in OClober. 1992, I also had il for sale at
$62,900. which I feel was a reasonable price at lhe lime, (AI aboulthe same time I sold
anolher home I owned. al 7 S. High St., Mechanicsburg, for $55.500. It, like 50 W.
Locust, is semi-delached, but il is much smaller. 1l has only one balhroom, no offslreet
parking, and praclically no yard. Also, it needed a new rooL) While you have asked me
whether you would be given credit toward your purchabe price for renl you have paid. I
honestly musl tell you lhat I have nol lhoughl much ahout this, since we had no specific
agreemenl in lhis regard. We will have lo arrive al a price which we each feel is fair to
ourselves wilh some consideralion being given lo this issue. Cerlainly. we can and should
lry 10 reach an overall win-win agreement. If you purchase lhe home, you will nol have
to incur moving expenses, and I will nol have 10 recruit a new buyer, I would lhink lhat
a price in the middle $60's with me perhaps absorbing some of your closing costs should
be fair 10 bolh of us. This also assumes lhat the property will nol need any significant
repairs 10 satisfy a lender. In advance of a selllemenl or a conlracl, I would recommcnd
a full home inspection if you have any concerns, I would consider any reasonablc
requests for repairs and/or updates. For examplc. I would replacc lhc watcr hcater and
have the furnace Ihoroughly inspected. Also, I may consider a furnace replaccment.

AND NOW, comes Plaintiff, F. Michael Witkoski, in
support of the foregoing Complaint avers as follows:
1. Plaintiff, F. Michael Witkoski, is an adult
individual residing in Cumberland County, Pennsylvania, with
a mailing address of P.O. Box 624, Camp Hill, Pennsylvania
17001.

individual occupying premises at 50 West Locust Street,
Mechanicsburg, Pennsylvania 17055.
3. Plaintiff, F. Michael Witkoski, at all times
relevant hereto is and was the fee simple owner of the
premises located at 50 West Locust Street, Mechanicsburg,
Pennsylvania

(hereinafter referred to as the
"Premises") .
4. On or about October 2, 1992, Plaintiff and
Defendant entered into a lease agreement for the Premises.
A copy of the lease agreement is attached hereto and made a
part hereof as Exhibit A.
COUNT I
BREACH OF CONTRACT - PAST DUE RENT

9. As a result of Defendant's breach of the
aforementioned lease agreement, Defendant owes Plaintiff Two
thousand two hundred forty-nine Dollars and 00/100
($2249.00) in past due rent and late fees.
10. A double security deposit totaling Nine hundred
and ninety Dollars and 00/100 ($990.00) and originally
intended to be used as part of a down-payment toward the
Defendant's eventual purchase of the Premises was used to
cover past months' rentals. No specific purchase agreement
was ever executed.
11. Plaintiff made a good faith effort to minimize
Defendant's damages by attempting to make contact with
Defendant via voice mail and telephone messages.
12. Plaintiff has incurred Judgment Costs of Eighty-
six Dollars and 00/100 ($86.00).
WHEREFORE, Plaintiff requests judgment in his favor and
against Defendant in the amount of Two thousand three
hundred thirty-five Dollars and 00/100 ($2335.00), which
amount is within the jurisdiction of compulsory arbitration
in Cumberland County, Pennsylvania.
COUNT II
BREACH OF CONTRACT/DAMAGES

14. In violation of Paragraph Fifteen (15) of the
aforesaid lease agreement, Defendant is keeping a large dog
on premises.
15. In violation of Paragraphs Fourteen (14) and
Seventeen (17) of the aforesaid lease agreement, Defendant
is keeping an inordinate accumulation of items in all rooms
of the Premises. Items in downstairs bathroom and rear
bedroom of second floor occupy entire rooms and block any
access thereto, creating possible fire hazards. Such
accumulation of items is also in violation of Paragraph
Twelve (12) of aforesaid lease agreement in that it hinders
access by repair and service persons.
WHEREFORE, Plaintiff requests judgment in his favor and
against Defendant in the amount of Two thousand three
hundred thirty-five Dollars and 00/100 ($2335.00). which
amount is within the jurisdictional compulsory arbitration
of Cumberland County, Pennsylvania.
COUNT III
FAILURE TO VACATE
16. Paragraphs 1-15 are incorporated herein by
reference as though fully set forth.
17. Defendant continues to occupy premises. despite
notice to vacate, a copy of which is attached hereto and
made a part hereof as Exhibit B, and granting of possession
to Plaintiff by District Justice (09-3-05).
WHEREFORE, Plaintiff requests judgment in his favor
upholding order to vacate and damages against Defendant in
the amount of Two thousand three hundred thirty-five Dollars

This is a follow. up to the conversation we had about, a week ago regarding the
house you have been renting from me since October. 1992 at 50 W, Locust St..
Mechanicsburg PA. As you arc aware, 1 would like to talk further to you about your
desire (if any) to purchase the property. 1 also want you to know that 1 want very much
for us to reach a win-win situation. While 1 realize that you arc busy with work, I would
appreciate being able to meet with you to discuss ideas 1 have outlined in the
accompanying leller, as well as any which you may have, Please telephone me at 717-

While I do want to be fair to you. I must also be firm, and if I do not hear from

Dear Bonnie:
Following are some ideas 1 have regarding the possible sale of the property at 50
W. Locust St.. Mechanicsburg PA 17055 from me to you:
I). Although 1 don't need to make an immediate transfer of the property to you. 1
would at least like us to get together to discuss all ideas and concerns. and if you are in
fact interested, I would then like to enter into a firm and binding sales contract with you.
1 would like to accomplish this by March I, 1997, I would, however, accept a settlement
date beyond the normal 60 day limit which seems to be typical for residential transactions
in this area, Because of time necessary to procure financing or to meet any conditions
which a lender would impose on the house, I would accept a settlement date sometime in
June or July of this year.
2). When 1 rented the house to you in October, 1992, 1 also had it for sale at
$62.900, which I feel was a reasonable price at the time. (At about the same time I sold
another home I owned. at 7 S, High St.. Mechanicsburg, for $55,500. It. like 50 W.
Locust. is semi-detached, but it is much smaller, It has only one bathroom. no orrstreet
parking, and practically no yard, Also, it needed a new roof.) While you have asked me
whether you would be given credit toward your purchase price for rent you have paid, I
honestly must tell you that 1 have not thought much about this, since we had no specific
agreement in this regard, We will have to ar,rive al a price which we each feel is fair to
ourselves with some consideration being given to this issue. Certainly, we can and should
try to reach an overall win-win agreement. If you purchase the home, you will not have
to incur moving expenses, and I will not have to recruit a new buyer. I would think that
a price in the middle $60's with me perhaps absorbing some of your closing costs should
be fair to both of us, This also assumes that the properly will not need any significant
repairs to satisfy a lender, In advance of a settlemenl or a contract. I would recommend
a full home inspection if you have any concerns. I would consider any reasonable
requests for repairs and/or updates, For example, I would replace the waler heater and
have the furnace thoroughly inspected. Also. I may consider a furnace replacement,
depending on circumstances, You mentioned a circuit breaker which trips, This would
be very easy to correct, and I will gladly lake care of il for you,
3), In order to get a feel for what similar homes in the area sell for. you should
research the Multi-list System, There are several comparable properties which have sold
in Ihe past several monlhs, which should give you some insighl. Also, if a competing
properly should be on the market you should make a personal inspection. Some properties

Both are vacant. and 1 strongly recommend lhat you look at them. although you should let

4). If 1 were to place 50 W. Locust St. on the market at the present time
(assuming that you were not interested), I would probably offer it at around $70.000 with

AND NOW, comes the Plaintiff, F. MICHAEL WITKOSKI, by and through his
attorneys, Reager & Adler, PC, to petition this Court to order the release of rent
deposited into Court, and in support thereof, avers the following:
1. On or about April 8. 1997, judgment for possession and rent arrearages
was rendered by the Honorable District Justice Richard E. Lair in favor of Plaintiff
F. Michael Witkoski (hereinafter "Witkoski") and against Defendant Bonnie R, PaIson
(hereinafter "Palson"). A true and correct copy of the Judgment is attached hereto as
Exhibit A.
2. On or about April 6, 1997, Pals on ffied a Notice of Appeal.
3. Palson deposited the sum of $1,500.00 into Court for the purposes of
creating a supersedeas,
4. Pals on has failed to deposit any further rent amounts into Court,
5. On or about May 28, 1997, Witkoski ffied a Praecipe to terminate the
supersedeas based on PaIson's failure to deposit rent as required by Pa. R.C.P. D,J. No.
1008.
6. Following confirmation by the Prothonotary of Palson's failure to deposit
monthly rent for more than thirty (30) days the supersedeas was terminated, A true
and correct copy of the Praecipe indicating the termination of the supersedeas is
attached hereto as Exhibit B.
7. Pursuant to the termination of the supersedeas. Witkoski is entitled to
recover the amounts previously deposited into court.
8. Witkoski has performed all conditions precedent for the recovery of the
deposited amounts.
WHEREFORE, Plaintiff F. MICHAEL WITKOSKI respectfully requests this
Honorable Court to enter an Order directing the Prothonotary to pay to the Plaintiff
all amounts deposited into court by Defendant BONNIE R. PALSON.
