COMPLAINT
1. Plaintiff is Stephen B. Lipson, an adult individual who
currently has his business office at 169 West High Street, Suite
4, Carlisle, Cumberland County, Pennsylvania.
2. Defendant is Roy B. Salisbury, Jr., an adult individual
who currently resides at 7802 Wertzville Road, Carlisle,
Cumberland County, Pennsylvania.
3. In late December of 1993 Plaintiff and Defendant
entered into a contract under which Plaintiff was to provide
legal services to Defendant, More specifically, Plaintiff was to
prepare a partnership agreement and lease agreement for
Defendant.
4. The agreed upon compensation to be paid by Defendant to
Plaintiff for this work was $250.00, which was Plaintiff's
customary rate for preparing these documents.
5. Plaintiff completed his work for Defendant as agreed
upon, earning the total amount of $250.00 in legal fees. This
work was completed by January 10, 1994, at which time the $250.00
in legal fees was due from Defendant to Plaintiff.
6. Defendant agreed to pay Plaintiff within a reasonable
time after January 10, 1994. However, Defendant has not made any
payments on this debt.
7. Earlier in 1993 Defendant had consulted Plaintiff
concerning bankruptcy law. This consultation lasted over 90
minutes, and thus at Plaintiff's customary hourly rate of $80.00
an hour Defendant would have been indebted to Plaintiff for
$120.00. However, Plaintiff's initial consultations on
bankruptcy are at no charge if (a) the prospective client in good
faith is considering the filing of bankruptcy; and (b) the
prospective client utilizes Plaintiff's services if he or she
files a bankruptcy petition.
8. Sometime after June 1, 1994 (the last time that
Plaintiff billed Defendant for the afore-referenced contracts)
Plaintiff discovered that Defendant had filed bankruptcy but he
had utilized the services of a different lawyer. At that point
in time Defendant became indebted to Plaintiff for the bankruptcy
consultation, i.e, for the additional $120.00.
9. Defendant is indebted to Plaintiff in an amount of
$370.00; however, despite several demands that he compensate
Plaintiff, as agreed upon, Defendant has refused to do so.

WHEREFORE, plaintiff requests that this Honorable Court
enter judgment in his favor and against Defendant in an amount of
$370.00, together with costs of suit and interest from date of
judgment. This amount does not exceed the jurisdictional amount
requiring submission to arbitration pursuant to local rules of
court.
