Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor

2002 of Spring Hill Home Owners Association, Inc. to Ronald M. Leitzel and Barbara D. Leitzel,
husband and wife, more fully described as follows:
BEGINNING at a point on the south side of Spring Hill Lane at the western end or
terminus of said lane (a private right-of-way) as appearing on the unrecorded Plan
hereinafter referenced; thence continuing South 85 degrees, 05 minutes 49 seconds
West for a distance of 1,119.61 feet along the dividing line of the tract to be conveyed
and lands now or formerly owned by Spring Hill Home Owners Association, Inc. to
a steep pin set in stones; thence continuing North 15 degrees 10 minutes 24 seconds
West for a distance of 1,751.45 feet along the dividing line between the tract to be
conve.ye.d herein and lands now or formerly owned by Spring Hill Home Owners
Association, Inc., and lands now or formerly of John I. Kimmel to a steel pin; thence
continuing North 84 degrees 33 minutes 33 seconds East for a distance of 1,051.19
feet along the dividing line of the tract to be conveyed and State Game Lands to a
stone pile; thence continuing North 73 degrees 58 minutes 02 seconds East for a
distance of 763.64 feet to a point along the dividing line of the tract to be conveyed
and State Game Lands, which point is approximately 15.6 feet from a stone marker
along same course; thence continuing from said point South 7 degrees 51 minutes 02
seconds West for a distance of 1,151.05 feet along the dividing line between the tract
to be conveyed and lands now or formerly of William W. Caldwell and Janet G.
Caldwell to a point; thence continuing along same dividing line between the tract
being conveyed and lands now or formerly owned · ·

395.22 feet to a steel pin on the north side of Spring Hill Lane to a point, the Place
of BEGINNING.
Now, November,,I, 2002, at the time of and immediately before the execution of the construction
contract aforesaid, and before any authority has been given by the said Ronald M. Leitzel and Barbara
D. Leitzel to the said Glenn D. Livelsberger, Inc., t/a Heritage Builders to commence work on the
said building, or purchase materials for the same, in consideration of the Owners making of the said
contract w/th Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be
filed against the building by Contractor, or any sub-contractor, nor by any of the materialmen or
workmen or any other person for any labor, or mater/als purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
