2. Defendant filed an Answer, pro se. generally admitting the averments of

Plaintiff's Complaint. that a balance is due to Plaintiff. however, disputing the amount
claimed.
3. As per the Verification of No Answers to the Request for Admissions, filed of
record. Plaintiff, on June 12, 1997. served Defendant with Plaintiff's Request for
Admissions, Interrogatories, and Request for Production of Documents.
4. Pursuant to Pennsylvania Rule of Civil Procedure 4014, answers to the Request
for Admissions were due by July 12. 1997.
5. As of the date of the filing of this Motion, the Defendant has not served
answers to Plaintiff's Request for Admissions. Interrogatories, and Request for
Production of Documents.
6. Pursuant to Pennsylvania Rule of civil Procedure 4014(b), each matter of which
an admission is requested is deemed admitted, unless. within 30 days after service of
the request, or within such shorter or longer time as the Court ,may allow, the party to
whom the request is directed serves upon the party requesting the admission an answer
verified by the party or an objection, signed by the party or his attorney.

7. pursuant to pennsylvania Rule of Civil Procedure 4014(d), any matter admitted
under said Rule is conclusively established unless the Court, on motion, permits
withdrawal or amendment of the admission.
8. The Defendant has not filed a motion with this Honorable Court to permit
withdrawal or amendment of the admissions.
9. Based upon the Defendant's failure to answer Plaintiff's Request for
Admissions, Defendant is deemed to have admitted ordering, receiving, and accepting the
services on the invoices which are the subject of Plaintiff's Complaint, specifically
Invoice No. 7197-01 dated December 30, 1994, in the amount of $2,345.00, Invoice No.
7619-01 dated January 31, 1995 in the amount of $2,345.00, Invoice No. 7872-01 dated
February 28, 1995 in the amount of $51.36. and Invoice No. 8277-01 dated March 31, 1995
in the amount of $2,410.00.
10. Defendant is further deemed to have admitted he received the services on each
invoice, that the price indicated for the services on the invoices is the price the
Defendant agreed to pay, and the Defendant has not paid Plaintiff for any of the
services on said invoices.
11. The Defendant's failure to answer Plaintiff's Request for Admission No.6
establishes the Defendant's admission that Defendant owes Plaintiff the principal sum
of $4,621.25.

12. As a matter of Pennsylvania law, Plaintiff as a contract creditor is entitled
to legal interest at the rate of 6 percent per annum from the time payment was due.
13. Based upon invoices which are the subject of this case, and the statement of
account showing past due amounts as "over 30 days", and the latest invoice being dated
March 31, 1995, Plaintiff is entitled to legal interest from April 30, 1995.
14. Based on the foregoing admissions, there is no genuine issue as to any
material fact, and Plaintiff is entitled to judgment as a matter of law.
WHEREFORE, Plaintiff moves this Honorable Court to enter an order, pursuant to
Pennsylvania Rule of Civil Procedure 1035.1 et seq, entering summary judgment in favor
of Plaintiff and against Defendant in the amount of $4,621.25 plus legal interest
thereon at the rate of 6 percent per annum from April 30, 1995.

PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT PURSUANT TO
PENNSYLVANIA RULE OF CIVIL PROCEDURE 1035.1 ET SEQ
AND NOW comes plaintiff, by counsel, Bernstein Bernstein and Strickland P.C., and
moves this Honorable Court to enter an order, pursuant to pennsylvania Rule of Civil
Procedure 1035.1, entering summary judgment in favor of plaintiff and against Defendant,
in the amount of $4,621.25 plus legal interest thereon at the rate of 1/2\ per month
from April 30, 1995, there being no genuine issue as to any material facts, and
plaintiff being entitled to judgment in said amount as a matter of law, based on the
following:
1. Plaintiff filed the within civil action seeking to recover an unpaid contract
balance of $4,621.25 plus legal interest thereon for production services sold and
delivered to Defendant.

2. Defendant filed an Answer, pro se, generally admitting the averments of
Plaintiff's Complaint, that a balance is due to Plaintiff, however, disputing the amount
claimed.
3. As per the Verification of No Answers to the Request for Admissions, filed of
record, Plaintiff, on June 12, 1997, served Defendant with Plaintiff's Request for
Admissions, Interrogatories, and Request for Production of Documents.
4. Pursuant to pennsylvania Rule of Civil Procedure 4014, answers to the Request
for Admissions were due by July 12, 1997.
5. As of the date of the filing of this Motion, the Defendant has not served
answers to Plaintiff's Request for Admissions, Interrogatories, and Request for
Production of Documents.
6. Pursuant to Pennsylvania Rule of civil Procedure 4014(b), each matter of which
an admission is requested is deemed admitted, unless, within 30 days after service of
the request, or within such shorter or longer time as the Court may allow, the party to
whom the request is directed serves upon the party requesting the admission an answer
verified by the party or an objection, signed by the party or his attorney.

7. Pursuant to Pennsylvania Rule of Civil Procedure 4014(dl, any matter admitted
under said Rule is conclusively established unless the Court, on motion, permits
withdrawal or amendment of the admission.
8. The Defendant has not filed a motion with this Honorable Court to permit
withdrawal or amendment of the admissions.
9. Based upon the Defendant's failure to answer Plaintiff's Request for
Admissions, Defendant is deemed to have admitted ordering, receiving, and accepting the
services on the invoices which are the subject of Plaintiff's Complaint, specifically
Invoice No. 7197-01 dated December 30, 1994, in the amount of $2,345.00, Invoice No.
7619-01 dated January 31, 1995 in the amount of $2,345.00, Invoice No. 7872-01 dated
February 28, 1995 in the amount of $51.36. and Invoice No. 8277-01 dated March 31, 1995
in the amount of $2,410.00.
10. Defendant is further deemed to have admitted he received the services on each
invoice, that the price indicated for the services on the invoices is the price the
Defendant agreed to pay, and the Defendant has not paid Plaintiff for any of the
services on said invoices.
11. The Defendant's failure to answer Plaintiff's Request for Admission No.6
establishes the Defendant's admission that Defendant owes Plaintiff the principal sum
of $4,621.25.

12. As a matter of pennsylvania law, Plaintiff as a contract creditor is entitled

of Plaintiff and against Defendant in the amount of $4,621.25 plus legal interest
thereon at the rate of 6 percent per annum from April 30, 1995.

OPINION
HOFFER, P.J.:
In this opinion, we address Plaintiff's Motion for Summary Judgment. The
facts are as follows: Plaintiff Is a partnership conducting business In production
services. In late 1994 and early 1995, Plaintiff sold and delivered to Defendant
various production services, Defendant accepted these services, Plaintiff claims
an unpaid balance for services rendered of $4,625,25, Plaintiff filed its complaint
on April 18, 1997, making a demand for payment. Defendant, acting pro se, filed
an answer May 14, 1997. Defendant admitted most of Plaintiff's allegations but
disputed the amount due.
On May 9, 1997, Plaintiff mailed to Defendant requests for admissions,
interrogatories, and requests for the production of documents. Defendant
acknowledged receipt of the requests on June 12, 1997, Pursuant to Pa, R. Civ.

P. 4014(b), Defendant had until July 12.1997 to respond to Plaintiff's requests for
admissions or the requests would be deemed admitted. Defendant has failed to
file a response to Plaintiff's requests for admissions.
Plaintiff's requests for admissions covered the conduct of Plaintiff and
Defendant throughout the course of their business relationship, Plaintiff's requests
included that Defendant admits to ordering, receiving, and accepting the services
rendered by the Plaintiff, that the sums owed are both the fair market price and the
price Defendant agreed to pay, and that Defendant owes Plaintiff the principal sum
of $4,625,25 for the services provided by the Plaintiff,
Plaintiff filed for summary judgment on August 13, 1997. Plaintiff claims that
it is entitied to summary judgment because Defendant is deemed to have admitted
that he ordered, received and accepted the services, the prices were fair and
agreed upon and Defendant owes Plaintiff $4,625,25, all through Defendant's
failure to respond to Plaintiff's request for admissions.
Discussion
The Pennsylvania Aules of Civil Procedure allow a party to send requests
for admissions to any other party to the action asking that party to admit or deny
matters of fact. Pa, A, Civ. p, 4014, A failure to respond to a party's request for
admissions within thirty days of service of such requests will render the matters

contained In the requests admitted. Pa, R. Clv. p, 4014(b). Requests for
admissions must call for matters of fact, rather than legal conclusions, and are
treated as admitted If a response to the requests is untimely. Brindlev v. Woodland
Village Restaurant. Inc" 438 Pa, Super, 385, 397, 652 A,2d 865, 871 (1995),
In the case at bar, Plaintiff properly made requests for admissions dealing
only with matters of fact. Defendant has failed to file a response, Pursuant to Pa.
R. Civ. p, 4014(b), this Court must treat the facts Included In Plaintiff's requests for
admissions as admitted.
A motion for summary judgment may be granted only If the pleadings,
depositions, answers to interrogatories, and admissions on file, together with any
affidavits, show that there is no genuine issue of material fact and that the moving
party is entitled to judgment as a matter of law, Soirer v, Freeland & Kranz, 434
Pa. Super. 341, 343-44, 643 A,2d 673, 674-75 (1994), Parties seeking to avoid
