STIPULATION AGAINST LIENS
WHEREAS, THOMAS S. WEBER and KAREN R. WEBER, of Mechanicsburg,
Pennsylvania ("Owners"), are about to execute contemporaneously
herewith, a contract, with WESTBROOK EXCAVATING COMPANY, a
Pennsylvania partnership, of 140 C1earview Place, Carlisle, PA
17013 ("Contractor"), for excavating work in connection with the
construction of a dwelling house and other improvements
("Improvements") upon a lot of land situate on Lisburn Road, Monroe
Township, Cumberland County, Pennsylvania, as more fully set forth
in the legal description attached and marked Exhibit A (the
"Property") .
NOW, this

of and immediately before the execution of the principal contract,
and before any authority has been given by the said Owners to the
said Contractor to commence work on the Property or Improvements,
or to purchase materials for the same, in consideration of the
making of the said contract with Owners and in further
consideration of One Dollar, to Contractor paid by Owners, it is
agreed that no lien shall be filed against the Property or

ALL THAT CERTAIN tract or piece of land situate in Monroe Township,
Cumberland County, Pennsylvania, more particularly bounded and
described in accordance with Final Subdivision Plan for Lisburn
Meadows Initial Phase, dated October 28, 1996, and recorded January
31, 1997, in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan Book 73, Page 148, as
follows:
BEGINNING at a concrete monument in the southern right-of-way line
of Lisburn Road (SR 2004) in line of land now or formerly of Fred
J. Weber, thence by said Weber land, South 40" 36' 44" West 250.83
feet to a steel rebari thence by land now or formerly of Ronald J.
Wolf, South 09 u 03 '31" East 389.32 feet to a steel rebari thence by
land now or formerly of Raymond E. and Genevieve A. Diehl, North
48. 12' 49: West 392.24 feet to a pointi thence by Lot B on the
hereinabove mentioned Subdivision Plan, North 17' 01' 32" East
406.76 feet to a point in the southern right-of-way line of said
Lisburn Roadi thence by the southern right-of-way line of said
Lisburn Road, South 72" 58' 28" East 281.66 feet to a concrete
monument, the point and place of BEGINNING.
BEING Lot C on the hereinabove mentioned subdivision Plani and
CONTAINING 117.012 square feet (2.69 acres).
UNDER AND SUBJECT, NEVERTHELESS, to the conditions, restrictions
and notes as set forth on the hereinabove mentioned Subdivision
Plan, as well as the building and use restrictions which apply to
Monroe Estates, a subdivision duly recorded in the Office of the
Recorder of Deeds, aforesaid.
BEING a part of the same tract of land or farm which George L.
Ebener and Gladys I. Ebener, husband and wife, by deeds dated
December 15, 1995, and January 3, 1996, respectively, and recorded
in the Office of the Recorder of Deeds, afo:esaid, in Deed Book
132, page 859, and Deed Book 133, Page 645, respectively, granted
and conveyed to Sharon L. Simons and Beth M. Sanders, the Grantors
herein.
BEING the same premises which Sharon L. Simons and Beth M. Sanders,
by their deed dated fer;~ )..1 , 1997, and intended to be
recorded in the Office of the Recorder of Deeds of Cumberland
County, granted and conveyed to Thomas S. Weber and Karen R. Weber,
husband and wife.
