When that. cOllrt is unavailable, the defendant shall of abuse: a. On or about April 7, 1997, the defendant threatened the plaintiff saying that he was going to kill the plaintiff and anybody who had anything to do with her, and that he knew a "hit man" who could knock her orf so that no one would find a trace. The defendant then went into the bedroom where the guns are kept, sat on the bed, and stared at the guns causing the plaintiff to fear for her safety. b. Tn or about February 1997, while the plaintiff was talking on the telephone, the defendant forcefully grabbed the plaintiff by the arm and twisted it causing her to drop the telephone. When the defendant hung up the telephone, the telephone rang and he hung it up again disconnecting the call. The defendant continued to disconnect the call each time It rang causing the plaintiff to fear for her safety. The defendant then went into the bedroom, got his shotgun, brought it out into the kitchen, looked repeatedly back and forth at the gun and at the plaintiff, and remarked that he was a "sharp-shooter" causing the plaintiff to fear that he was going to kill her. c. Tn or about January 1997, when the defendant started screaming at the plaintiff causing her to be aFraid, she leFt the residence and walked to her 2 daught.er"H home for' fear of her Hafety. The defendant. got his Hhotgun and went. about the neighborhood looking for the plaintiff. The defendant then pursued the plaintiff to her daughter's house hy tracking her foot pr'int.H in t.he Hnow, Unable to find the plaintiff, the defendant, retur'ned to hiH houHe and to.!d their daugh t.e r', Se rena, t.hll t if he r 010 the r H tepped foo t on to the porch, t.hat he waH going to shoot her. The dpfendant t.hen Hat. on t.he couch in front of his daughter', placed the gun barTe.! in his mouth saying, "Watch thlH, T'm going to kill myself," The defendant,'s brother arrived at t.he residence and was able to ret.rieve the gun from the defendant. d. Tn or about October 1996, when the defendant shot a cat be.!onging to the fami.!y, the plaintiff felt t.hreat.ened because he had previously t.hreat.ened t.o shoot. her, t.he dog, and t.he cat.. e. On several different. occasions since 1993, the defendant has shoved t.he plaintiff, restrained, choked, and slapped her. The defendant hilS t.hreat.ened to shoot the plaint.iff with guns which are sometimes loaded causing thp plainti ff t.o fear for her safet.y. 5. The plaint.iff be.! ievpH and t.herefore avers that. she is in immediat.e and present. danger of abuse from t.he defendant should Hhe r'emain in t.he home wit.hout the defendant's exclusion :1 and that she is in need of protection from such abuse. 6. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications, except for the limited purpose of facilitating custody arrangements. 7. The plaintiff desires that the defendant be enjoined from harassing and stalking the plaintiff, and from harassing the plaintiff's relatives, or the minor children. 8. The plaintiff desires that the defendant be restrained from entering her place of employment while she is working or the school of the mi~or child. 9. The plaintiff desires that the defendant be enjoined From removing, damaging, destroying or selling any property owned Jointly by the parties or owned solely by the plaintiff. 10. The plaintiff desires that any weapons the deFendant owns, possesses, and has used or threatened to use against the plaintiff be conFiscated by the Sheriff's Department, and that he be enjoined from acquiring or possessing any other weapons for the duration of the Order. n. EXCT,US IVE POSSESSION 11. The mobile home from which the plaintiff is asking the Court to exclude the defendant is owned in the names of the plaintifF and the defendant. 12. The plaintiFF currently has no place to stay with her .j children except the marital home, and the defendant has a sister in the area with whom he can stay. 13. The plaintiff desires possession of the mobile home so as to give the greatest degree of continuity to the lives of the children and to allow them to continue their education at their schools and to continue their school and social activities. C. SUPPORT 14. The defendant has a duty to support the plaintiff and the minor children. 15. The plaintiff is in need of financial support from the defendant including, but not limited to: health insurance coverage, and payment of unreimbursed medical expenses for the plaintiff and the children. 16. The defendant Is employed at Wopler Long Acre, and has a gross monthly salary of approximately $ 1345.00. 17. The plaintiff's income is insufficient to provide for her minimal needs and those of the children until such time as a support order can be obtained by filing at the Domestic Relations Office. lB. The plaintiff intends to petition for support within t.wo weeks of the issuance of a prot.ect.ive order. D. REIMBURSEMENT FOil COST OF CASE 19. The plaintiff has no knowledge of any custody proceedings concerning these child pending before a court in this or any other jurisdict.ion. 23. The plaintiff does not know of any person not a party to this action who hils physical custody of the child or claims to hnve custody or visit.ation rights with respect. to the child. 24. The best interests and permanent welfare of the minor child will be met if custody is t.emporarily granted to the plaintiff pending a hearing in this matter for reasons including: n.
