1. 'l'hls action was commenced by Complaint on Apd 1 24, 1997.
2. At all times relevant hereto, Defendant, ,Jennifer L.
Phelabaum, is an adult individual and a Pennsylvania resident.
J. On or about May 9, 1997, the Shet'lff of Cumberland County
filed a Return of Service Indicating that the Defendant was not
found at the address givell for service by the Plaintiffs,
4. On ,June 17, 1990, lJefelldant, ,Jenllifer L. Phelabaum, filed
Preliminary Objections to the Plaintiffs' Complaint raising lack of
service and lack of personal jurisdiction.
5. On or about August 4, 199B, the Plaintiffs' counsel
caused the Complaint to be reinstated and forwarded to the sheriff
of Cumberland county for service,
6. Subsequent to that date, the Shedff of Cumberland county
properly served Defendant, Jennifer L, Phelabaum.
7. By order of september 21, 199B, the Defendant's
Preliminary Objections to the plaintiff's Complaint were dismissed
as being moot because the Complaint had been properly served.
B. p.tw.en April 21, 1991 and Auqust., 199B, the PlaintiUs
made no effort whatloBver to serve the Defendant bV sheriff.
9. Defendant, Jennifer Phe1abaum, wae also named a Defendant
in a lawsuit filed by the Plaintiffs' son ar1sinq from the eame
accident referred to in the Plaintiffe' Complaint in the Cumbsrland
County Court of Common Pleas to No. 96-4640, The Plaintiffs' son,
arian Gembusia, was also represented by Plaintiffs' attorney in
this lawsuit.
10. In a companion case, No. 96-4640, the Plaintiff served
Defendant, Jennifer Phelabaum on August 23, 1996 at 1336 South 19th
street, Harrisburg, Pennsylvania 11104 by Sheriff,
11. In the companion lawsuit, No. 96-4640, the Defendant
served Answers to the Plaintiffs' Interrogatories on the
Plaintiffs' attorney on Hay 21, 1997 indicatinq that ehe was a full
time student at East pennsboro lIigh School.
12. On August 14, 1991, Defendant, Jennifer Phelabaum,
appeared personally in the offices of Costopoulos, foster' FieldS,
Plaintiffs' attorney, for a deposttion.
13. At her deposition on Augult 14, 1997, Jellnifer Phelabaum
testified that she was currently a student a lIard.burg Area
Community College and wal aleo working at nurqer King,
14, On April 23, 1990, Defendant, .Jennifer I'helabaum,
appeared for an Arbitration in the companion caee, No, 96-4640 in

the old Cumberland County Courthouee,
15. On September 10, 1990, Oetendant, Jenniter L. Phelabaum
filed an Anewer With New Matter, raising inter alia, the detense of
the applicable etatute of limitations.
16. On October 1, 1990, Defendant served upon the Plaintiffs
Defendant's Interrogatories, Bet III. ^ true and oorreot copy of
Defendant's Interrogatories, Bet III are attached hereto as EKhibit
"A" and incorporated herein by reference,
17. On December 30, 1998, Plaintiffs filed a Response to
Defendant's Interrogatories, Bet 111. ^ true and correct copy of
the Plaintiffs' Response to Defendant's Interrogatories, Set Ill,
is attached hereto as Exhibit "0" and incorporated herein by
reference,
18. The Plaintiffs filed this action to recover damages for
personal injurie. allegedly sustained by Joseph T, Gembusia as a
result of the negligence of Defendant, ,Jennifer Phelabaum in
causing an accident that occurred on May 29, 1996,
19, This action i. SUbject to a two-year statute of

20, Because the Plaintiffs failed to make reasonable efforts
at nerving the Defendant, their claims are barred by the statute of
