5. On August 13, 1995, Defendant Brian Harman. was the owner and operator of a 1985
Honda CRX, Pennsylvania plate AX57673.
6. On August 13, 1995, Defendant, David RocheUe, was the driver of a 1993 Chevrolet Astro,
Louisiana plate PP125006.
7. On the said date, the Plaintiffs, Betty Ortiz and Letitia Ortiz were passengers In the 1993
Astro, being driven by Defendant David RocheUe, 88 previously described.
8. On August 13, 1995 Defendant David RocheUe, while driving the Astro, with Plaintiffs
Betty Ortiz 8I1d Letitia Ortiz 88 passengers, were travelling South on State Route 94 at approximately
2:00p.m, in South Middleton Township, Cwnberland County, Pennaylvania,
9. On the same date at approximately the 88/De time Defendant Brian Hannan waa also
travel1lng South on State Route 94 (SR 94) In his Honda in South Middleton TOWIl8hip, Cumberland
County, Pennsylvania.
10. Defendant Harman WlI8 driving behind Defendant Rochelle on Routllll4, at approximately
Baltimore Uld Oxford Roeda.
11, The Defendant Rochelle engaged hIa len hand turn sillRA1 then applled the brakes brinllina
the Astra to a slower speed.
12. After observing Defendant Rochelle's len turn aignal, Defendant Harman braked Uld
steered into the northboWld lane of SR 94.
13, At thls time, the front end of Defendant Harman's CRX impacted the driver's side of the
Defendant Rochelle's Astro.
14. After impact, both vehlcles slid in a south easterly direction,
16. Defendant Harman's CRX came to rest facing a lOutherly direction, straddling the
sol\~hboWld lane of SR 94 and the east berm.
16, Defendant Rochelle's Astro came to rest facing in.'lI1 e8llterly direction straddling the lOuth
boWld lane Uld the east berm.
17. Both vehlcles were towed away from ecene.
18, As a result of the above collision, Plaintiff's Betty Ortis and Letitia Ortis sulTered b\lurles
more fully described below,
COUNT I . NEGLIGENCE
BE'ITY ORTIZ V. BRIAN K. HARMAN
19. Paragraphs 1 through 18 are hereby incorporated.
20. Defendant Harman was negligent and reckleaa in the operation of hIa vehicle as follows:
a. Failure to drive vehlcle at a lIIICe speed;
b. Failure to properly assure a clear distance ahead while operating hIa vehlcle;
c, Failure to keep alert and to maintain a proper look-out for other traffic;
d Failure to maintain proper control and operation of hIa vehicle; and
e, Was negligent and reckleaa Wider the existing clrcW1Ultances.
21. ,.. a direct and proximate re8ult of one or more of the aforesaid careleaa and negllll"nt acts
or omlulona of any and all of the Defendants the automobile driven by Defendant Harman violently
collided with the automobile being driven by Defendant Rochelle.
22, ,.. a direct and proximate reoult of the aforesaid, the Plaintiff Betty Ortiz, suffered lqjurles
of a perlOnaI and pecuniary nature, Including but not limited to medical expenae, pain suffering and
physical and emotional trsuma, IOme of which may be permanent.
23. ,.. a direct and proximate result of the aforesaid, the PIainUff Letitia Ortiz, sulTered
lqjurles of a personal and pecuniary nature, including but not limited to lost wages, medical expenaea, pain
and suffering and phyoicaJ and emotional trauma, some of which may be permanent,
24, ,.. a result of the accident PlaintilT Betty OrUz waa physicaJly impaired and remains
impaired aa of the date of this Complaint which prevents her from performing all of or eubstantlally all of
the material acts or duties which constitute her usual and cuatomary dalJy activities.
25, ,.. a result of the accident, Plaintiff Betty OrUz has Incurred reaaonable and necessary
medical expenses to correct the perlOnaI lqjuries referred to above.
WHEREFORE, the Plaintiff Betty OrUz respectfully requests that the Court enter Judgment
against Defendant Brian Harman for an amount not exceeding the threshold amount for compulsory
arbitration.

PETITION TO OPEN DEFAULT JUDGMENT
UNDER PENNSYLVANIA RULE OF CIVIL PROCEDURE 237,3
NOW INTO COURT, through undersigned counsel, comes the Defendant, David Rochelle, who,
petitions this Court to open the Default Judgment against him, for the following reasons;
I. David Rochelle is an adult individual residing in Natchitoshes, Louisiana.
2. As alleged in the Complaint herein, Defendant was the operalor of a vehicle which was
involved in an accident on August 13, 1995, in which Plaintiffs were passengers.
3. As alleged in the Complainl, in the accident, Mr. Rochelle's vehicle was rear-ended by
the vehicle driven by Co-Defendant, Brian Harman,
4. Therefore, liabilily for this accident rest solely with Co-Defendant, Harman.
5. The Complaint in this case was tiled on April 28, 1997.
6. Plaintiffs allempted service of the Complaint on Defendant, Rochelle, through the long
arm statute by Certified Mail, Return Receipt Requested.
7. The address which Plaintiff utilized for service was an address where Defendant, Rochelle,
hs., not resided for the last three years.
8. When the Complaint was received at Defendant, Rochelle's former address, he no longer
resided there. Instead, his step-daughter (who is now living there with his ex-wife) signed the return
receipt card.
9. Therefore, service of the Comphtint was effected, allegedly upon Defendant, Rochelle,
with no notice to him.
10. The Notice of Intention to Take Default, as well as the Default Judgment taken on June
10, 1997, were also served upon Defendant, Rochelle, at his old address, thereby making the service
ineffective.
II. On September 23, 1997, Defendant, Rochelle's insurance carrier, Great American
Insurance Companies, first received notice of the filing of the Complaint and subsequent Default
Judgment. Allached as Exhibit "A" to lhis Pelition is a copy of the correspondence received from
counsel for the Plaintiffs,
12, At that time, Great American Insurance Companies instituted an investigation concerning
the sp.rvice issues noted above. and secured lhe aforementioned facts regarding the ineffective service
of both the Complaint and the Default Judgment documents.
13. In Exhibit "A," Great American Insurance Companies also received notice of the
Arbitration Hearing in this case, scheduled for October 13, 1997. Defendant, Rochelle, also has never
received notice of that hearing, until his insurance company was notified.
14, Defendant, Rochelle, hereby requesls this Honorable Court to allow him sufficient time
to support this Petition with appropriate Affidavits. depositions, and the like, but, in the meanwhile, stay
the arbitration proceeding of OClober 13, 1997, pending the complelion of this discovery, and the
scheduling of this Petition for Argument Court,
15. A verified proposed Answer and New Matter to the Complaint is attached as Exhibit "B."
WHEREFORE, Defendant/Petitioner, David Rochelle, hereby prays that this Honorable Court
grant his Petition to Open the Default Judgment against him, after allowing sufficient time to complete
discovery in support of the Petition, and Slaying the arbitralion proceeding scheduled for October 13,
1997.

DAVID ROCHELLE TO PLAINTIFFS' COMPLAINT
NOW INTO COURT, through undersigned counsel, comes the Defendant, David Rochelle, who,
in ans'.ver to the Complaint of the Plaintiffs, respectfully represents that:
I. Defendant, David Rochelle, in accordance with Pa,R.C.P. 1029(e), generally denies the
allegations in Plaintiffs' Complaint, except, Defendant, David Rochelle, admits that he is an adult
individual.
NEW MATTER
2. The Plaintiffs may have failed to state a cause of action upon which relief can be granted.
3. The applicable Statute of Limitations may have expired prior to the institution of this action,
4. Answering Defendant was not negligent for the reasons stated in paragraph 13 below,

S. Any acts or omission of Answering Defendant alleged to constitute negligence were not
substantial causes or factors of the subject incident and/or did not result in the injuries and/or I08Ses
alleged by the Plaintiffs.
6. The incident and/or damages described in Plaintiffs' Complaint may have been caused or
contributed to by the PlainlifTs,
7. The negligent acts or omissions of other individuals and/or entities may have constituted
intervening, superseding causes of the damages and/or injuries alleged to have been sustained by the
Plaintiffs.
8. The Plaintiffs may havc assumed the risk.
9. The Plaintiffs may have been contributorily negligent.
10. The incident, injuries and/or damages alleged to have been sustained by the Plaintiffs were
not proximately caused by Answering Defendant.
II. Plaintiffs may not have properly mitigated her damages.
12. Answering Defendant, David Rochelle, pursuant to Pa.R.C.P. 2252(d), hereby joins as
Additional Defendant, Brian K. Harman, for purposes of contribution and/or indemnification and hereby
avers that said Additional Defendant is alone liable to Plaintiffs, are liable over to Defendant, David
Rochelle, or are jointly or severally liable to Plaintiffs with Defendant, David Rochelle.
13. The accident described in Plaintiffs' Complaint was a simple rear-end collision, caused
by Co-Defendant, Brian K. Harman, suddenly and without any waming to Defendant, David Rochelle.
The negligence of Brian K. Harman is fully described in paragraphs 20 and 27 of Plaintiffs' Complaint,
and those paragraphs are incorporatcd herein by rcference.
WHEREFORE, Answering Defendant, David Rochelle, prays that the Complaint be dismissed,
at the cost of the Plaintiffs, or, in the alternative, for the relief alleged in paragraph 12, above.
