COMPLAINT
1. The Plaintiff is HARRIS SAVINGS BANK, formerly Harris
Savings Association, a corporation organized and existing under the
laws of the State of Pennsylvania and having its principal place
of business at Second and Pine Streets, Harrisburg, Pennsylvania,
17101.
2. The Defendants are DONALD M. WILEY and PAULA W. IHLEY,
husband and wife, adult individuals, residing at 1709 Charles
Street, New Cumberland, cumberland County, Pennsylvania 17070.
3. This is an attempt to collect a debt and any information
obtained will be used for that purpose.
4. Defendants, on May 10, 1988, entered into a mortgage
loan indenture with Harris Savings Bank, formerly Harris Savings
Association, in the principal amount of Ona Hundred Fifteen

Thousand and NO/100 Dollars ($115,000.00) the terms of which loan
ar;! more specifically evidenced and set forth in the mortgage
dated May 10, 1988, and recorded May 12, 1988, in the Cumberland
County Recorder's Office in Mortgage Book 903, Page 341, a copy of
which is attached hereto, marked Exhibit "A", and made a part
hereof by reference, which mortgage contains and is a lien upon the
property situate at 1709 Charles Street, New Cumberland Borough,
Cumberland County, Pennsylvania, 17070, being improved with a
dwelling.
5. Said loan was further evidenced and secured by a Note
which accompanied said Mortgage dated May 10, 1988, a copy of which
is attached hereto, marked Exhibit "B", and made a part hereof by
reference.
6. Harris Savings Bank, formerly Harris Savings
Association, in consideration of the said mortgage and accompanying
Note, advanced to Donald M. Wiley ~nd Paula W. Wiley the sum of
$115,000.00.
7. The premises subject to
specifically set forth in Exhibit "G",
part hereof by reference.
8. Donald W. Wiley and Paula W. Wiley are the sole owners of
the said premises contained in said mortgage.
9. Said mortgage and Note have not been assigned in whole
or in part by the Plaintiff herein.
10. Donald W. Wiley and Paula W. Wiley are the record owners
said mortgage is more
attached hereto and made a

in fee simple of said premises by virtue of a Deed dated May 10,
1988 and recorded in the Cumberland Count Recorder's Office in Deed
Book 33-I, Page 365.
11. No judgment has previously been entered on said mortgage
or note in any jurisdiction, and said instruments are less than
twenty (20) years old.
12. The said mortgage is in default because Defendants herein
have failed to pay the monthly payments that were due and owing of
$1229.61 for the months of October, November and December, 1996,
and January and February, 1997.
13. The plaintiff has given to the Defendants written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated December 10, 1996, copies of which are marked Exhibits
"D"and "E" and attached hereto and made a part hereof by reference.
14. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983, dated
December 10, 1996, copies of which are marked Exhibit "F" and "0"
and attached hereto and made a part hereof by reference.
15. The entire principal amount of One Hundred Fifteen
Thousand and NO/100 Dollars ($115,000.00) plus interest at the
current rate of 9.5% per annum, late charges and reasonable legal
fees for collection of said sum in accordance with the terms of
said mortgage less such sums as have been paid on account of
principal of the said mortgage and costs.
16. The Plaintiff believes and therefore avers that

reasonable legal fees for collection is $5914.88.
17. The Defendants are liable to the Plaintiff for interest
at the rate of 9.5% per annum until paid and expenses as provided
in and collectible under the mortgage documents that will accrue
until distribution by the Sheriff of Cumberland County,
Pennsylvania, to be computed at the time of judgment in these
proceedings in addition to the current loan balance.
18. The Defendants are liable to the Plaintiff for the
following on said mortgage loan:

19. The plaintiff believes and avers that neither of the
Defendants are members of the armed forces or are in the military
service of the United States of America.
WHEREPORE, the Plaintiff prays the Court to enter Judgment
against the Defendants, Donald M. Wiley and Paula W. Wiley, of
Mortgage Foreclosure and sale of the mortgaged property, with

damages in the amount of $124,372.82 together with additional
interest thereon, costs and all other amounts advanced by
Plaintiff.

The MORTGAGE held by the Harris Savings Bank (hereafter we, us, or ours) on your
property located at 1709 Charles Street, New Cumberland, PA 17070 IS IN SERIOUS
DEFAULT because you have not made payments of $1,229.61 for the months of October,
November, and December, 1996. Late charges (and other charges) have also accrued to this
date in the amount of $96.71. The total amount now required to cure this default, or in other
words, get caught up in your payments, as of the date of this letter is $3,785.54.
You may cure this default within THIRTY (30) DAYS of the date of this letter, by paying
to us the above amount of $3,785.54 plus any additional monthly payments and late charges

The MORTGAGE held by the Harris Savings Bank (hereafter we, us, or ours) on your
property located at 1709 Charles Street, New Cumberland, PA 17070 IS IN SERIOUS
DEFAULT because you have not made payrneots of $1,279.61 for the months of October,
November, and December, 1996. Late charges (and other charges) have also accrued to this
date in the amount of $96.71. The total amount now required to cure this default, or in other
words, get caught up in your payments, as of the date of this letter is $3,785.54.
You may cure this default within THIRTY (30) DAYS of the date of this letter, by paying
to us the above amount of $3,785.54 plus any additional monthly payments and late charges
which may fall due during this period. Such payment must be made either in CASH,
CASHIER'S CHECK, CERTIFIED CHECK OR MONEY ORDER, and made at any of our

If you do not cure the default within THIRTY (30) DAYS, we intend to exercise our

Bank, to reinstate mortgage pursuant to Act 6 of 1974, said Motion
is hereby granted.
IT IS HEREBY ORDERED AND DECREED THAT:
1. The mortgage of Donald M. Wiley and Paula W. Wiley, his
wife in favor of Harris Savings Bank recorded at Mortgage Book 903,
Page 341, is hereby reinstated in full force and effect as if
default had not occurred; and
2. The Prothonotary is directed to strike off the Judgment
in Mortgage Foreclosure in favor of Harris SAvings Bank and against
Donald M. Wiley and Paula W. Wiley with respect to their home at
1709 Charles Street,
New Cumberland,
Cumberland County,

MOTION TO REINSTATE MORTGAGE PURSUANT TO ACT 6 OF 1974
AND NOW comes Plaintiff, Harris Savings Bank, by and through
its counsel, Robert E. Myers, Attorney at Law, and states the
following in support of its Motion:
1. Plaintiff is Harris Savings Bank, a Pennsylvania
corporation, having its principal place of business at Second and
pine Streets, Harrisburg, PA 17101, and the Movant in the above-
captioned matter.
2. The Defendants/Respondents above are Donald M. Wiley and
Paula W. Wiley, his wife, adult individuals and mortgagors of a
single family residence at 1709 Charles Street, New Cumberland,
Cumberland County, Pennsylvania.
3. That on April 28, 1997, Plaintiff filed a Complaint in
Mortgage Foreclosure on the above-captioned matter with respect to
Defendants' family residence situate at 1709 Charles Street, New
Cumberland, cumberland County, Pennsylvania.
4. Plaintiff entered Judgment against the Defendants on June
10, 1997, in the amount of $124,471.49 and the property listed for
judicial sale.
5. Plaintiff had given notice as required by the Provisions
of Act 6 and therefore the proceedings are controlled by Act 6.
6. Subsequent to the entry of said Judgment but prior to
scheduled Sheriff's Sale, the said Defendants paid to the Plaintiff
sufficient funds to make the mortgage current at the time hereof
pursuant to the provisions of Act 6 of 1974 and the sale was
cancelled.
7. By the said Defendants curing the default which resulted
in the commencement of the above-captioned action and the said
Judgment, Plaintiff has agreed to reinstate the said mortgage loan
and not proceed with foreclosure because of the default set forth
in the Complaint filed int he above-captioned matter.
B. That pursuant to Act 6 of 1974, P.S, Section 404, Right
to Cure a Default, Defendants' Mortgage was restored to the same
position as if the default had not occurred.
9. That in order to evidence Harris' compliance with Act 6
of provisions and in order to reinstate the mortgage without
prejudice to Plaintiff or Defendant, the parties desire to evidence
said fact and strike the Judgment in mortgage foreclosure entered
to the above referenced term and number.
10. The Defendant has exercised the right to reinstate the
said mortgage loan under Section 404 of Act No.6 of 554 (41 P.S.
Section 404) by curing the default which resulted in the
commencement of the above-captioned action.
11. This Motion is to effectuate the purpose of the above Act
No.6 of 1974, 41 P.S., Section 404.
WHEREFORE, Harris Savings Bank requests this Honorable Court
to enter an Order providing as follows:
