COMPANY, from any and all actions, causes of action. claims, demands, damages,

Cumberland County Court of Common Pleas, filed by Charlotte M. Bowers and Tonya
L. Bowers, versus Gregory A. Kiner at docket number CV-97-2213,
We hereby acknowledge and assume all risk, chance, or hazard that the said
Injuries or damage may be or become permanent, progressive, greater, or more
extensive than is now known, anticipa(ed, or expected, No promise or inducement

As plaintiff, Tonya L, Bowers, passed the entrance of the Carlisle Plaza Mall, a vehicle
drove by defendant, Gregory A. Kiner, entered into traffic on East High Street and struck the
automobile driven by plaintiff, Tonya L, Bowers,

The defendant struck the plaintiffs automobile in the right front portion of the vehicle
owned by plaintiff, Charlotte M. Bowers.

As a result of the collision, the automobile driven by Tonya L. Bowers and owned by
Charlotte M. Bowers sustained damages of Two Thousand Seven Hundred Sixty-Nine and
04/100 ($2,769,04) Dollars to her automobile, In addition. the plaintiff, Tonya L. Bowers,
incurred an additional sum of Two Hundred and no/IOO ($200.00) Dollars to have her vehicle
temporarily repaired and inspected in 1997. A copy of the repair estimate is attached to this
complaint and marked as Exhibit "A".

The accident was caused by the negligent conduct of the defendant, Gregory A. Kiner. It
consisted of the following:
a. The defendant failed to yield the right-of-way to the oncoming vehicle or the
plaintiff.
b, The defendant failed to properly pay allention to traffic.
c. The defendant failed to properly control his vehicle,
d. The defendant failed to take sufficient action to avoid striking the plaintift's
vehicle.
e, The defendant failed to give any warning that he was entering into the lane of
travel on East High Street.

The damages sustained by the plaintiff were caused by the negligence of the defendant as
set forth above,

The defendant is responsible fur pay the total sum ofTwo Thousand Nine Hundred Sixty-
Nine and 04/100 ($2,764.04) Dollars.
WHEREFORE, the plaintiffs requests that this Honorable Court will enter judgment
against the defendant in the sum ofTwo Thousand Nine Hundred Sixty-Nine and 04/100
($2.969.04) Dollars with costs and interest as pennitted by law.
