is without sufficient information or knowledge to form a belief as
to the truth of the averment of this paragraph.

6, Cumberland Express incorporates herein by reference
the foregoing paragraphs as though set forth at length,

only that plaintiffs placed cargo in the possession of Cumberland
Express, After reasonable investigation, Cumberland Express is
without knowledge or information sufficient to form a belief as to
the truth of the remaining averments in paragraph 7, They are
therefore denied. To the extent the remaining allegations in
paragraph 7 are conclusions of law, no response is required.
8. It is specifically denied that any cargo was damaged
while in the possession of cumberland Express. After reasonable
investigation, Cumberland Express is without knowledge or
information sufficient to form a belief as to the truth of the
remaining averments in paragraph 8. Therefore, they are denied,
By way of further answer, to the extent the allegations in
paragraph B constitute conclusions of law, no response is required,
9. Cumberland Express specifically denies that it acted
negligently. On the contrary, at all relevant times, Cumberland
Express acted carefully, prudently and with due care required under
the circumstances. Cumberland Express specifically denies that it

failed to take adequate precautions to keep plaintiffs' goods safe
and secure, Further, Cumberland Express specifically denies that
it failed to protect and keep secure plaintiffs' goods or that it
failed to adequately supervise the handling of plaintiffs' goods,
To the extent the averments in paragraph 9 constitute conclusions
of law, no response is required.
10. Cumberland Express incorporates herein by reference
the foregoing paragraphs as though set forth at length. 1 1 _
13. The averments in these paragraphs are directed to another
defendant, To the extent the averments in paragraphs 11 through 13
are directed at Cumberland Express, after reasonable investigation,

WHEREFORE, defendant Cumberland Express demands jUdgment in
its favor and against plaintiffs, together with costs and expenses
of this action, along with such other additional relief as the
Court shall deem just and appropriate.
NEW MATTER
1. Plaintiffs' Complaint fails to state a claim upon
which relief can be granted against Cumberland Express.
2. Plaintiffs' claims are barred and/or extinguished by
the doctrine of laches, or for failure to prosecute.
3. Plaintiffs' claims are barred or limited by the
spoliation of evidence.

4. To the extent plaintiffs suffered the damages
alleged. which allegations are specifically denied, then such
damages were caused by individuals other than Cumberland Express
and over whom Cumberland Express had no control and/or by
circumstances outside of Cumberland Express's control.
S. To the extent plaintiffs sustained the damages
alleged, whi::h allegations are specifically denied, then said
damages were caused by the actions or omissions of plaintiffs and
plaintiffs' claims are barred and/or substantially reduced by
plaintiffs' contributory negligence and/or comparative negligence.
6, Plaintiffs' claims are barred because plaintiff
voluntarily assumed the risk for any losses it may have suffered,
7. Plaintiffs' claims are barred by the doctrines of
estoppel, waiver and accord and satisfaction.
8. Cumberland Express incorporates all
available, if any, under the Interstate Commerce Act
Carmack Amendment thereto.

alleged in the Complaint were caused in whole or in part by their
own negligence, carelessness and/or fault of other parties, and,
therefore, Cumberland Express is not liable,

and/or other parties over whom Cumberland Express had no control.
WHEREFORE, defendant Cumberland Express demands judgment in
its favor and against plaintiffs, together with costs and expenses

COMPLAINT
1. Plaintiff ITT Hartford Insurance Company is an insurance carrier
licensed and authorized to perform business within the Commonwealth of
Pennsylvania and other states and maintains a place of business at the sbove
address.
2. Plaintiff Distribution by Air, Inc. is a transporter of goods and
is incorporated under the laws of the state of New Jersey and maintains
a principal place of business at the above captioned address.
3. Defendant Cumberland Express is a business entity engaged in
transporting cargo and maintains a place of business at the above captioned
address.
4. Defendant Cosmos Transport Express is a business entity engaged
in transporting cargo and maintains a place of business at the above captioned
address.
5. On April 12, 1996 The Plaintiff ITT Hartford Insurance Company
insured the Plaintiff Distribution by Air, Inc. under policy no. 998MLOI095.

The Plaintiff placed goods, which included a mixing board, specifically

8. While the Defendant was acting as a bailee on or about 4-15-96
the goods mentioned above were damaged snd Plaintiff was forced to incur
a loss totalling $33,649.75.
9. Defendants negligence consisted of inter alia:

a) failure to take adequate precautions to keep Plaintiffs goods
safe and secure despite accepting Plaintiff's goods in a bailmp.nt
situstion;
b) failing to protect and keep secure Plaintiff's goods while accepting'
care, custody and control of Plaintiff's goods;
c) failing to adequately supervise Plaintiff's goods while in
Defendant's care, custody and control,
WHEREFORE. Flaintiff's demand judgment against the Defendants jointly
and severally in the amount of $33,649.75 plus costs, interest and whatever
other relief the court determines to be equitabIe and just.

1. Plaintiff ITT Hartford Insurance Company is an insurance carrier
licensed and authorized to perform business within the Commonwealth of
I Pennsylvania and other states and maintains a place of business at the above
II captioned address,
'I 2. Plaintiff Distribution by Air, Inc. is a transporter of goods and
I is incorporated under the laws of the state of New Jersey and maintains

. 6. On April 12, 1996 the Plaintiff ITT Hartford Insurance Company
insured the Plaintiff Diatribution by Air, Inc. under policy no. 998MLOI095.
COUNT I
Plaintiffs vs. Cuaberland Express
7, The Plaintiff repeats and incorporates by reference paragraphs
1 through 5 as described heretofore,
8. The Plaintiff placed goods, which included a mixing board, specifically
3 road cases, mixing consoles and power supply including a 48 channel SM24
monitor console, 24 input modules and SSG- 1 power supply which were being
shipped to Clair Brotheru of Manheim, PA into the care custody and control
of the Defendant, a carrier of cargo,
9. While the Defendant was acting as a bailee on or about 4-15-96
the goods mentioned above were damaged and Plaintiff was forced to incur
a loss totalling $33,649.75,
10. Defendant's negligence consisted of inter alia:
u) failure to take adequate precautions to keep Plsintiff's goods
safe and secure despite accepting Plaintiff's goods in a bailment
situation;
b) failing to protect and keep secure Plaintiff's goods while
accepting care, custody and control of Plaintiff'a gooda;
c) failing to adequately supervise Plaintiff's goods while in
Defendant's care. custody and control.
WHEREFORE, Plaintiff's demand judgment against the Defendants jointly
and severally in the amount of $33.649.75 plus costs, interest and whatever
other relief the court determines to be equitable and just.

13. While the Defendant was acting as a bailee on or about 4-15-96
the goods mentioned above were damaged and Plaintiff was forced to incur
a loss totalling $33,649.75.
14. Defendant's negligence consisted of inter alia:
a) failure to take adequate precautions to keep Plaintiff's goods
safe and secure despite accepting Plaintiff's goods in a bailment
situation;
b) failing to protect and keep secure Plaintiff's goods while
accepting care, custody and control of Plaintiff's goods;
c) failing to adequately supervise Plaintiff's goods while in
Defendant's care, custody and control.
WHEREFORE, Plaintiffs demand judgment against the Defendants jointly
and severally in the amount of $33,649.75 plus costs, interest and whatever
other relief the court determines to be equitable and just.

15. Plaintiff repeats and incorporates by reference paragraphs 1 though
14 as described heretofore.
16. The Plaintiff placed goods, which included mixing board,

Defendant, US Air, by and through its attorneys, Palmer
Biezup and Henderson, hereby removes this action to the united
States District Court for the Middle District of Pennsylvania,
pursuant to 28 U.S.C. S 1441, and respectfully avers as follows:
1, Plaintiffs ITT Hartford Insurance Company and
Distribution by Air, Inc. have commenced a civil action against
detendants in the Court ot common Pleas - cumberland County,
Pennsylvania, A true and correct copy ot the Amended Complaint
is attached hereto and marked as Exhibit "A", The Amended
complaint was tiled with the prothonotary on or about December
24, 1997,
2, plaintitts, in their Amended Complaint, allege that
detendant US Air is a "carrier ot cargo." (Exhibit A, para, 16)
3. Plaintiffs, in their Amended Complaint, allege damages
"totalling $33,649.15", (Exhibit A, para, 18)
4, The Amended complaint in this matter was served on US
Air on January 5, 1998,
5, This action relates to a Federal question arising under
federal common law and one or more federal statutes, including
but not limited to, the Federal Bill of Lading Act (49 U.S,C. 55
80101 ~, ~.); the civil Aeronautics Board Sunset Act of 1984
(Pub, L, No, 98-443); Airline Deregulation Act of 1978 (Pub.L,No,
95-504); and FAA Act of 1958 as amended,
6, count III of the Amended Complaint alleges a cause of
action against US Air alone; hence the claims against US Air are
separable from the claims against the co-defendants,
7, Counsel for defendant Cumberland Express has agreed to
this removal action, It appears Cosmos Transport Express is no
longer in business and herefore, upon information and belief, any
attempted service was ineffective, Attempts to reach Cosmos
Transport Express by telephone revealed that its telephone number
is out of service, A letter regarding this removal action was
sent by Federal Express to the Cosmos Transportation Express
