MARITAL SETTLEMENT AGREEMENT
THIS AGREEMENT is made this ~ day of Jl\o..rch
2000, by and between LEE W. PEEBLES, hereinafter called "Husband",
and FRANCES A. PEEBLES, hereinafter called "Wife",
WIT N E SSE T H :
WHEREAS, Husband and wife were married on November 12, 1983;
and
WHEREAS, no children were born of this marriage; and
WHEREAS, differences have arisen between Husband and Wife as
a consequence of which they have been living separate and apart
from each other since on or about April 29, 1997; and
WHEREAS, Wife has commenced an action in divorce in the Court
of Common Pleas of Cumberland County, Pennsylvania docketed to
No. 97-2223 ("Divorce Action"); and
WHEREAS, Husband and Wife have reached an understanding to
settle and resolve all economic and other claims and issues which
have been or could have been raised in the Divorce Action and their
respective rights and obligations;
NOW, THEREFORE, in consideration of the premises and covenants
contained herein, it is hereby agreed by and between the parties
hereto as follows, intending to be legally bound thereby:
1. Distribution of Real Prooertv. The real property and any
and all improvements erected thereon and located at 33 East Factory
Street, Mechanicsburg, Cumberland County, Pennsylvania, which had
been the parties' marital home shall hereafter be and remain the
sole and separate property of Wife, free and clear of any and all
claims of Husband with respect thereto. Upon Wife's reasonable
request, Husband will execute a quitclaim deed or other document to.
acknowledge his release of any and all right, title, interest or
claim in 3nd to such real property.
2. Distribution of Personal Prooertv. All furniture,
fixtures, clothing, jewelry, guns, vehicles and other personal
property items in which the parties or either of them have an
interest and which were, have been or could have been claimed to
have been marital property have heretofore been distributed between
the parties to their mutual satisfaction. All such property
currently in the possession of either party shall be and remain the
sole and separate property of that party, free and clear of any
right, title, interest or claim of the other party hereto.
3. Accounts, Emolovment Benefits. Etc. Contemporaneously
wich the ~ntry of a decree in divorce, the parties shall execute
any and all documents, stipulations and the like which may be
reasonably required in order to obtain a qualified domestic
relations order to transfer, set over and assign to Wife the total
sum of Five Thousand Dollars ($5,000.00) from and out of Husband's
401(k) or deferred compensation plan through Husband's employment
at penske Truck Leasing. Except for such sum being set aside to
Wife, all other sums held in such plan in the name of or for the
benefit of Husband shall be and remain the sole and separate

property of Husband. All other accounts, insurance policies or
other such accounts of any type held in the name of either party
shall be the separate property of such party, free of all claims or
interest of the other party.
4. Divorce. The parties shall, simultaneously herewith,
execute and cause to be filed affidavits of consent and such other
documents as may reasonably be required so that, upon the
presentation of a praecipe to transmit the record in this matter in
the Divorce Action, a divorce decree can be obtained from the Court
of Common Pleas of Cumberland County. Husband and Wife agree that.
such affidavits of consent and other documents shall be filed
within ten (10) days of the date of execution of this Agreement.
Husband agrees, however, that he shall forebear in the filing of a
praecipe to transmit the record or to take any other steps to
obtain a final decree in divorce until December 20, 2000, or until
Wife defaults under the terms and conditions of this Agreement,
whichever shall first occur. Upon the entry of a decree in
divorce, the terms of this Marital Settlement Agreement shall or
may be incorporated into such decree.
5. A1imonv/Suooort. Husband and Wife agree that Husband
shall continue to pay to wife the sum of Two Hundred Dollars
($200.00) per week as provided in the existing Order regarding such
APL payments entered to Docket No. 97 CV 2223, Court of C<:,mmon
pleas of Cumberland County, through June 30, 2000. Effective
July 1, 2000, Husband's obligation to pay alimony pendente lite or

support to Wife shall immediately and without further action of any
party be automatically modified to require that Husband pay to Wife
the reduced sum of One Hundred Dollars ($100.00) per week from
July 1, 2000 through December 31, 2001 unless sooner terminated.
Husband's payments to Wife shall terminate upon the death of either
party, Wife's remarriage or cohabitation with a male not related to
her within the degree of consanguinity as provided in the Divorce
Code. Except for such t.ermination, the amount of such APL/a1imony
payments and the term for such payments as herein provided shall
not be modified or changed for any reason whatsoever. Any action
by Wife to modify or increase Husband's obligation with regard to
APL/a1imony shall constitute a default under the terms and
conditions of this Agreement. The payments to Wife are intended to
qualify as alimony under the Internal Revenue Code so as to be tax
deductible from Husband's income and to be treated as taxable
income to Wife.
6. Health Benefits. Husband shall continue to provide
health/medical insurance for Wife through his employment as he has
heretofore been providing for her benefit until December 31, 2000,
or until the entry of a decree in divorce as herein provided,
whichever shall first occur. Thereafter, such obligation shall
terminate absolutely.
7. Husband's Debts. Husband represents and warrants to Wife
that he has not and in the future he will not contract or incur any
debt or liability for which Wife or her estate might be responsible

and shall indemnify and save Wife harmless from any and all claims
or demands made against her by reason of debts or obligations
incurred by him.
8. Wife's Debts. Wife represents and warrants to Husband
that she has not and in the future she will not contract or incur

any debt or liability for which Husband or his estate might be
responsible and shall indemnify and save Husband harmless from any
and all claims or demands made against him by reason of debts or
obligations incurred by her.
9. Disclosure and Waiver of Riqhts and Claims. Each party
understands that he or she has the right to obtain from the other
party a complete inventory or list of all of the property that
either or both parties own at this time or owned as of the date of
separation and that each party has the right to have all of such
~roperty valued by means of appraisals or otherwise. Each party
understands that he or she has the right to have a court hold
hearings and to make decisions on the matters which are addressed
by this Agreement. Each party understands that a court decision
concerning the parties' respective rights and obligations might be
different from the provisions of this Agreement.
Each party hereby acknowledges and understands that this
Agreement is fair and equitable, that it adequately provides for
his or her needs, that it is in his or her best interest, and that
the Agreement is not the result of any fraud, duress or undue

influence exercised by either party upon the other or by any other
person or persons upon either party.
Given these understandings and acknowledgments, both parties
hereby waive the following rights and/or procedures:
(a) The: right to require the other party to provide
an inventory and appraisement of all marital and separate
property as defined by the Pennsylvania Divorce Code;
(b) The right to require the other party to produce
an income and expense statement as provided by the
Pennsylvania Divorce Code except in instances where such
income and expense statements may hereafter be required
to be filed in any child support action or in any other
proceedings pursuant to an Ord~r of Court;
(c) The right to have any discovery as may be
permitted by the Pennsylvania Rules of Civil Procedure,
except such discovery arising out of or concerning a
breach of this Agreement or related to any child support
action or arising out of or related to any other
proceedings in which discovery is specifically ordered by
the Court or otherwise provided by law;
(d) The right to have the Court determine which
property is marital and which is non-marital and to have
the Court determine the equitable distribution between
the parties of that property which the Court determines
to be marital; and

Ie) The right to have the Court decide any other
rights, remedies, privileges or obligations covered by
thiB Agreement, including but not limited to possible
claims for divorce, spousal support, alimony,
alimony pendente lite (temporary alimony) and counsel
fees, costs and expenses.
Except as herein otherwise provided to the contrary, each
party may otherwise dispose of his or her property in any way, and
each party hereby waives and relinquishes any and all rights he or
she may now have or hereafter acquire under the present or future
laws of any jurisdiction to share in the property of the estate of
the other as a result of the marital relationship, including,
without limitation, dower, curtesy, statutory allowance, widow's.
allowance, right to take in intestacy, right to take against the
will of the other, right to claim or seek equitable distribution of
property, alimony, alimony pendente lite, spousal support, counsel
fees or expenses, and right to act as administrator or executor of
the other's estate, and each will, at the request of the other,
execute, acknowledge and deliver any and all instruments which may
be necessary or advisable to carry into effect this mutual waiver
and relinquishment of all such interests, rights and claims.
10. Tax on Prooertv Division. The parties hereby agree and
express their intent that any transfers of property pursuant to
this Agreement shall be within the scope and applicability of the
Deficit Reduction Act of 1984 or other similar tax acts

subject to the carry-over basis provisions of said Act.

(hereinafter the "Act"), specifically, the provisions of the said
Act pertaining to transfers of property between spouses or former
spouses.
The parties agree to sign and cause to be filed any
elections or other documents required by the Internal Revenue
Service to render the Act applicable to the transfers set forth in
this Agreement, without recognition of gain on such transfers and
transfers to which the Act may not or does not apply, Husband shall
be solely responsible for any and all taxes that may be assessed or
become due from Husband, and Wife shall be solely responsible for
any and all taxes that may be assessed or become due from Wife as
a result of or arising from this Agreement.
11.
Full Disclosure.
Husband and Wife each represent and
warrant to the other that he and she has made a fut1 and complete
disclosure to the other of all assets of any nature whatsoever in
which such party has an interest, of all liabilities, of the source
and amount of the income of such party of every type whatsoever,
and of all other facts relating to the subject matter of this
Agreement.

Additional Instruments.
Each of the parties shall on
demand execute and deliver to the other any deeds, bills of sale,
car titles, assignments, consents, tax returns and any other
documents and shall do or cause to be done any other act or thing
that may be necessary or desirable to the provisions and purposes
of this Agreement.

13. Leqal Reoresentation/Voluntarv Execution. Husband and
wife acknowledge that each has had the opportunity to review this
document with an attorney of his or her choosing or has waived such
right to do so and acknowledge that they fully understand the legal
impact of this Agreement, and further intend to be legally bound by
the terms of this Agreement. The provisions of this Agreement are
fully understood by both parties, and each party acknowledges that
this Agreement is fair and equitable, that it is being entered into
voluntarily and that it is not the result of any duress or undue
influence.
14.
Entire Aqreement.
This Agreement contains the entire
understanding of the parties, and there are no representations,
warranties, covenants or undertakings other than those expressly
set forth herein.

legally bound hereby, have hereunto set their hands and seals the
day and year first above written.

AND NOlf, comes the PLAINTIFF, by Attorney JAMES M. BACH, and
avers as follows:
1. Plaintiff Is FRANCES A. PEEBLES who

currently resides at 33 East Factory street, Mechanicsburg, PA 17055.
2. Defendant is LEE W. PEEBLES who

currently resides at 33 East Factory street, Mechanicsburg, PA 17055.
3. Plaintiff and nofellllant have been bona fide residonts in
the Commonwealt.h for at least six months immediately previous
to the filing of this Complaint.
4. The Plaintiff and Defendant wore married on 11-12-83
5. 'fherl'! have beol1 no prior actions of divorce or annulment
between the parties.
6. The marriage is irretrievably broken.
(a) The Defendant has offered such indignities to the person
of the Plaintiff, the innocent and injured spouse,
as to render the Plaintiff's condition intolerable and
life burdensome.
1. Plaintiff has been advised of the availability of counseling
and also the Plaintiff may have the right to reqlJest that
the Court require tho parties to participate in counseling,
and after being so advised, Plaintiff does not desire
counseling.

9. The parties have acquired property during this marria~e
but have not been ablo to agree on its equitable
dish ibution.
10. Plaintiff requests this Court to preserve Plaintiff's
right to have all marital property of the parties equitably
distributed.

Date: Friday, March 3, 2000
Present for the Plaintiff, Frances A. Peebles is
Attorney Jacqueline M. Verney, and present for the
Defendant, Lee W. Peebles is attorney Bruce F. Bratton.
A divorce complaint was filed on April 29, 1997,
raising grounds for divorce of irretrievable breakdown of
the marriage and indignities Counsel have indicated that
the parties will sign and file affidavits of consent and
waivers of notice of intention to request entry of divorce
decree prior to the hearing to be scheduled. The
affidavits and waivers should be provided to the Master's
Office if not previously filed on the date of the hearing to
be scheduled to take the testimony of the realtors.
The complaint also raised economic claims of
equitable distribution, alimony, alimony pendente lite, and
counsel fees and expenses.
Counsel have indicated that they will not present
any marital misconduct testimony on that factor as it
relates to the alimony claim.
The parties were married on November 12, 1983 and
separated on April 29, 1997. This is the second marriage
for wife and the first marriage for.
Wife is 54 years of age and resides at 33 East
Factory Street, Mechanicsburg, Pennsylvania where she lives
alone. She has completed the ninth grade in school, and is
currently not employed. Her last employment was with
Stephenson's Flowers where she worked as a clerk part time
in 1994/1995. Previously she worked for approximately 10
years as a cook and made around $7.00 an hour in that job.
She claims that she is not able to work because she has
spinal stenosis, which causes numbness and pain in her back
and extremities. Wife has not provided specific medical
information regarding her condition, except to simply
identify it, and therefore in order for Mr. Bratton to
.
evaluate her claim that she is not able to work, he needs to
have a medical report. Wife should provide through her
counsel and after contacting her physician, a medical
evaluation for Mr. Bratton's review. Mr. Bratton then will
have to decide whether he wants to have wife independently
evaluated by his own physician. Wife had previously filed
a claim for social security disability which was rejected.
Attorney Verney indicated that she is going to encourage
wife to refile that claim. Wife currently receives from
husband alimony pendente lite in the amount of $200.00 per
week, which is being paid pursuant to an order entered on
June 15, 1997.
Husband is 45 years of age and resides at 843
Hummel Avenue, apartment 1, Lemoyne, Pennsylvania where he
lives alone. He is a high school graduate and works as a
clerk for Penske Trucking. His net monthly income is
around $2,200.00. This number is based on a finding in an
order entered in the support/alimony pendente lite
proceedings on July 23, 1997. Husband has not raised any
health issues.
Wife owns in her name the property where she is
residing at 33 East Factory Street, Mechanicsburg,
Pennsylvania. This property was deeded to wife by her
husband of her prior marriage. The property has never been
titled jointly in wife's name and current husband's name,
therefore we are looking at a premarital asset and need to
have a value as of the date of marriage (November 12, 1983)
and a value as of the date of separation (April 29, 1997).
The purpose of having the two values is to show any increase
in value of the property from the date of marriage to the
date of separation. Also, we need to consider the payment
of the encumbrance against the property at the time of
marriage to the date of separation. According to Mr.
Bratton, through husband's contributions, the mortgage that
existed at the time of marriage was finally paid off around
the time the parties separated. To further complicate this
situation we have tHO appraisals (neither appraisal gives us
a value as of the dates previously noted) . The appraisal
by Affiliated Appraisals, dated June 22, 1999, shows a
market value of $72,000.00. The appraisal by A. Larry
Cavallucci on June 7, 1999, shows a value of $39,000.00.
Because of the unusual variation in values by two experts,
we are going to schedule a separate hearing to hear their
testimony to try to reconcile, if possible, the values. If
no reconciliation can be made between the experts of their
appraisal reports, then the Master will have to determine
the value based on the testimony.
Husband has a 40l(k) plan through his employment
with Penske Trucking and the first quarter value in 1997
shows an amount of $71,836.77. The marital portion of that
value will have to be increased by an interest factor to
bring it up to current value. This interest factor will be
applied without taking into account any post-separation
contributions to the plan by husband.
Wife does not drive a vehicle; husband has a 1989
Ford Bronco on which he placed a value of $2,000.00.
There is also a 1984 Coleman camper on which husband has
placed a value of $1,000.00.
On husband's pretrial statement he lists three
Monumental Life Insurance policies owned by husband with an
approximate cash value of $1,500.00 and a Monumental Life
Insurance policy owned by wife with ~unknown cash value.
Wife should provide information as to any cash value in her
policy, and whether the policy is currently being
maintained.
Wife alleges that husband has an interest in a
hunting camp in Lycoming County. Wife claims that husband
owns an interest in this camp with three other persons.
Counsel are going to have to try to evaluate whether there
is any value in husband's interest in this camp. Husband
should provide any documents that he has relating to his
alleged ownership or interest.
Also, wife has noted and claims that husband
acquired two guns, a pistol and a rifle, during the
marriage. She values these items at $1,000.00. Husband
also had some premarital guns and there may be a claim for
an increase in value for these guns. If counsel feel that
they need to appraise the pistol and the rifle purchased
curing the marriage, they may just as well have the other
guns valued.
Apparently wife retained all of the household
tangible personal property when husband left. In addition
to the household personalty, there is an above-ground pool
on the premises which was not included apparently in the
appraisals of the real estate.
Husband claims that the personalty which includes
the furnishings and the pool in wife's possession have a
value of $6,000.00. Husband should arrange to have an
appraisal of the items to substantiate his allegations as to
the value of the pool and household tangible personal
property.
Husband claims that subsequent to the separation
he paid off at least $7,500.00 worth of marital debt, and
claims that he should be given some credit for the payment
of this debt. Apparently according to
Mr. Bratton, the parties were utilizing their credit cards
to maintain their living expenses.

I. BACKGROUND
The parties were married on November II, 1983 in Cumberland County,
Pennsylvania. The parties separated JUIle IS, 1997 and have been living separate and
apart since that time, On April 29, 1997, Wife filed a Divorce complaint with service
effected on Mr.y 8, 1997 by certified mai~ return receipt requested, restricted delivery. In
addition to irretrievable breakdown and indignities, Wife l1lised the economic claims of
equitable distribution, alimony, alimony pendente lite and counsel fees and expenses.
Wife filed for alimony pendente lite on JUIle IS, 1997. An Order wu entered on
July 23, 1997 granting Wife $200.00 per week.
The Divorce Mutcr wu appointed by the Honorable George E. Hoffer on August
5,1999.
11. PRESENT INFORMATION
I. ASSETS:
A. Real Property: 33 East Factory Street, Mechanicsburg, Pennsylvania with an
appraisal value of$39,ooO,OO from A. Larry Cavallucci. Defendant has indicated
in his Answers to Interrogatories that he believes the property value is
$8S,OOO.00. Plaintiff acquired the property in 1977. The parties were married in
1983. Plaintiff does not believe the property increased in value since the time of
the marriage.
Defendant is a Joint owner of a hunting camp in Lycoming County which he
acquired during the marriage.
B. Personal property: All personal property has been divided to the satisfaction of the
parties, except that Mr. Peebles took possession of at least two gw1S that he
acquired during the marrillge that are valued over $1,000,00.

APPRAISAL ADDENDUM REPORT:
Tho subject is in below average conditi.on, with abovo average
wear and tear. Handyman projects were IItarted but not completed.
As nn example, the bncl< bedroom io unf inished, with unf inished
wool! flooring, uncompleted drywall, exposed walls covered with
plastic and inoulation, no huat, otc. Thio area was included in
thp. uquare footage of the houoe via exl.erior meaSU1'llments. Until
completed, it aloo makeo tho finished area into a ono-bedroom
homn, and functIonally not comparable Clverall with the
comparable saleEl.
Theoe conditiono wern conuidered in the final estimate of value,
and one of the reasono why that value is on the lowl!r end of the
adjusted range.
Appraiser has performed other appraisals in this general area in
the last 7 yearo, including other contiguoui areas.
Comparable Sales' ddjustments reflect typic~l buyer reaction to
significant vdllations in featureo.
NOTE REGARDING COLOR DIGITAL PHOTOS:
Appraiser inspected the exterior of all Comps used in this
Report. Also took all photos uoing a Canon RC-360 Still Video
Camera, digitizing software & transfer board, ColorEyes
'1'ranoport Gottware, & A La Mode rOTOPftEE 2000 Appraisal digital
imaging software. Appraiser did not download photos from MLS.
Any enhancement to digital photos only involved brightness,
contrast, hue, etc.
NOTE regarding real estrite taxes:
Based on the tax asseesment, and the County's correElpondillg
common level ratio, the advalorem County value is $39,400
rounded, similar to the Appraiser's final estimate of value.
Lower value is a100 reflected in the low real estate taxes.
The Appraiser considered but did not utilize the Cost Approach
due to the age of the home.
The Income Approach was not considered, and therefore, the
Departure Provision of USPAP is invoked, thus making this a
Limited Appraisal.
The lot is a corner lot and has a larger area than the comps,
some of which is due to most of the comps being either attached,
row or semi-detached dwellings. Most buyers in this price range
are not concerned over this issue, and therefore, did not cause
an adjuotment.
By looking at the tax mpa, there are other propertiE:s in the
immediate area with larger loto.
Interior photos are provided to show the damage, deferred
maintenance, and unfinished areas.
All Sales except for Sale 6 are 2 bedroom dwelling floor plans.
Sale 5 had a 502 sq ft gross living area on the STEB report,
which the Appraifler considers incorrect, and not including the
2nd floor area which contains two bedrooms, per MLS and agent.
Based on the layout of the exterior, the Appraiser used 1004 sq
ft in the Market Grid.
All Saleo had minimal "djustmonts, with three of the comps
having adjusted ranges of only $500 between them.

DEFENDANT'S PRETRIAL STATEMENT
I. Assets of Parties:
A. Marital Assets.
1. Residential real estate: 33 East Factory Street,
Mechanicsburg, PA.
Purchased by Plaintiff and her prior husband,
Plaintiff acquired title as result of her prior
divorce. Defendant was residing with Plaintiff at
that time and paid all or substantially all of the
amounts required to be paid to prior husband of
Plaintiff (approximately $7,000.00) and paid all or
substantially all mortgage payments (including two
refinancings for improvements) during current
marriage, leaving the real property lien free.
Appraised 06/22/99: $ 72,000.00.
2. Penske Truck Leasing Company LP Savings Retirement
Plan, 401(k) plan, Husband's employment.
Value as of separation of the parties in early
spring of 1997 approximately $71,836.77.
3. 1989 Ford Bronco (Husband's name).
Value approximately $2,000.00.
S. Ccntents of home, furniture, furnishings, etc., and
above-ground pool remaining in possession of
Plaintiff at time of Defendant's departure from the
marital home.
Value: Approximately $6,000.00.

B. Non-marital Assets.
1. All employee benefits of any type, including
contributions and earnings in Defendant's 401 (K)
plan, earned post-separation.
2. Furniture and furnishings of Defendant's apartment
purchased after separation.
3. .22 ca1. Remington pistol; gift from Defendant's
father before marriage.
4. .22 cal. Remington rifle; inherited from father.
5. 20-guage shotgun; purchased before marriage.
6. 16-guage shotgun; inherited from father.
7. 1988 Chevrolet Celebrity; Husband's name;
Purchased after commencement of divorce. Value
approximately $2,000.00.
II. Expert witnesses.
Defendant expects to offer the appraisal report or testimony
of Philip F. Grow, of Affiliated Appraisers & Consultants,
1002 Bridge Street, New Cumberland, PA 17070 as to the
value of the marital real estate. (Copy of appraisal report
is attached.)
Defendant also reserves the right to call additional expert
witnesses in the event Plaintiff intends to or does take the
position that she is disabled or under any type of medical

condition which disables her from employment. Social
security disability benefits have been denied and Plaintiff
has failed to produce any expert reports to confirm the
existence or extent of any such disability, all of which
Defendant denies.
III. Other witnesses.
No other witnesses are anticipated other than such witnesses
may be required to rebut Defendant's testimony - - to be
determined upon review of Defendant's Pretrial Statement.

IV. Exhibits.
Other than appraisal report and copies of statements
concerning 401(k) plans, credit card bills and the like (not
all of which are available to the Plaintiff at the present
time), no other exhibits are anticipated.
V. Defendaut's gross income.
Copies of most recent pays tub and of 199B's 1040 forms for
Oefendant are attached. Defendant is and has long been
employed full-time at penske Truck Leasing as a clerk
earning gross annual salary of approximately $34,900.00.
Defendant had held additional part-time employment from
separation for about a year and a half in order to pay
marital debts. Such positions ended early in 1999.
VI . Expenses.
Defendant/Husband's expenses are not expected to he a
significant issue in this divorce action. Plaintiff's
expenses are unknown due to failure of plaintiff to provide
truthful enumeration of such matters. Plaintiff resides in
home for which Defendant paid all mortgage payments
including final payment to satisfy mortgage in 1997 at or
shortly after separation. Defendant also paid all marital
debts (a total of approximately $10,000.00 at separation)
and believes, therefore, that Plaintiff's expenses are
minimal.
VII. Pension values.
None requiring actuarial valuation. 401(k) plan valuation
is established by statements which will be offered in
evidence at the time of hearing.
VIII. Counsel fees.

No claims pending by Defendant. Because Plaintiff has done
essentially nothing to move this case forward for more than
two years, Defendant believes she could not have incurred
more than a bear minimum of fees and costs to this point.
For that reason and because the issues presented by this
case are not complex or novel, Oefendant, therefore,
believes Plaintiff's claim for counsle fees and costs should
be denied.
IX. Tangible personal property and disputes.
Defendant has estimated value of furniture, furnishings and
the like above. Pool and decking, not included in real
estate appraisal valuation, and other personal property may
require separate appraisal if value is not agreed upon.
Defendant assumes Plaintiff who retains possession of
marital home would wish to retain such assets with the home.
Defendant believes there was, except for the marital home
and the 401 (K) plan, a negative net value of all other
assets given the extent of marital debts at the time of
separation.
X. Marital debts.

Any and all payments on such debt since separation have
been made by Oefendant. Account was in both names prior
to April of 1997.

AND NOW, this 201h day of June. 2000. based upon the Court's determination that Petitioner's
monthly net income/earning capacity is (nla) and Respondent's monthly net income/earning capacity is
(nla), it is hereby Ordered that the Respondent pay to the Pennsylvania State Collection and
Disbursement Unit, $434.50 per month payablc weekly as follows; $100.00 per week for alimony
pendente lite and $25.00 per week on arrears. Arrears set at $452.00 as of June 20,2000. The
effective date of the order is July I. 2000.
This order is based upon the parties' settlement agreement.
The remaining service fee of $26.00 is to be paid to the Cumberland county Domestic
Relations Section, P.O. Box 320, Carlisle, PA 17013 within five days upon receipt of this order.
Failure to make each payment on time and in full will cause all arrears to become subject to
immediate collection by all of the means as provided by 23 PaCS.g 3703. Further, if the Court finds,
after hearing, that the Respondent has willfully failed to comply with this Order, it may declare the
Respondent in civil contempt of Court and its discretion make an appropriate Order, including, but not
limited to, commitment of the Respondent to prison for a period not to exceed six months.

Unrelmbursed medical expenses that exceed $250.00 annually are to be paid 0% by the
respondent and 100% by petitioner. The petitioner is responsible to pay the first $250,00 annually in
unreimbursed medical expenses. Respondent to provide medical insurance coverage. Within thirty
(30) days after the entry of this order, the Respondent shall submit written proof that medical
insurance coverage has been obtained or that application lor coverage has been made, Proof of
coverage shall consist, at a minimum. of: I) the name of the health care coverage provider(s); 2) any
applicable identification numbers; J) any cards evidencing coverage; 4) the address to which claims
should be made; 5) a description of any restrictions on usage, such as prior approval for hospital
admissions, and the manner of obtaining approval; 6) a copy of the benefit booklet or coverage
contract; 7) a description of all deductibles and co-payments; and 8) five copies of any claim forms.
