WHEREAS, onthe ~.f dayof ~l//o~/r~,,~,- ,2002, awrittenagreementwas
entered into between
Nicholas Evanoff Co., of P.O. Box 4222, 997 Peiffers Lane, Harrisburg, PA 17111
(herein called Contractor),
and
Hometown Development Corporation, of 114 N. Hanover Street, Carlisle, PA 17013
(herein called Owner),
whereby the said Contractor undertook and agreed to provide materials and perform labor
necessary for roof repairs, at premises owned by Owner described as follows:
14-20 North Hanover Street, Carlisle, Cumberland County, Pennsylvania
NOW, THEREFORE, this agreement witnesseth that the said Contractor for and in
consideration of one dollar to him in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further considerations mentioned in the agreement aforesaid, and
intending to be legally bound hereby, for himself and his subcontractors and materialmen,
and all parties acting through or under him, covenants and agrees that no mechanics'
claims or liens shall be filed or maintained by him, them or any of them against the said
building and the lot of ground appurtenant thereto, or any of them, for, or on account of any
work or materials' furnished by him, them, or any of them, under said contract or
otherwise,for, toward, in or about the erection and construction of the said buildings, or any
of them, and the said Contractor, for himself and his subcontractors and materialmen and
others under him, hereby expressly waives and relinquishes the right to have, file or
maintain any mechanic's lien or claim against the said buildings, or any of them, and
agrees that this agreement waiving the right of lien shall be an independent covenant.
